The overall objective of this thesis is to investigate how the online pledge institute relates to overcoming this crisis and therefore to the realization of the right to judicial protection . Therefore , we try to analyze the constitutional foundations of this procedural tool in the context of the principles of access to justice, the effectiveness of legal protection and proportionality. / A crise de inefetividade da prestação da tutela jurisdicional, mormente no que se refere à tutela executiva, ensejou significativas modificações no diploma processual civil brasileiro, as quais redefiniram instrumentos executivos já superados pela ineficácia e que embaraçavam a obtenção de um resultado efetivo. O objetivo geral desta dissertação é investigar de que modo o instituto da penhora on line se relaciona com a superação desta crise e, por conseguinte, com a concretização do direito à tutela jurisdicional. Para tanto, procura-se analisar os fundamentos constitucionais deste instrumento processual no contexto dos princípios do acesso à justiça, da efetividade da tutela jurisdicional e da proporcionalidade.
