Sem desconsiderar a natureza régia e religiosa da instituição, é como tribunal de justiça que o Santo Ofício português se mostra neste estudo: um tribunal que se dizia santo, mas que pragmaticamente processava e julgava seus réus com base em indícios e provas judiciais de condutas à época entendidas como crimes; tribunal de uma justiça de outros tempos, em que o pecado era criminalizado por leis civis e religiosas. Importantes documentos jurídicos negligenciados por parte considerável da historiografia, os manuais e regimentos da Inquisição portuguesa eram a base do conjunto de normas que orientava as práticas de justiça do Tribunal. Compreender a cultura jurídica luso-cristã presente nestes documentos foi o objetivo que conduziu a pesquisa histórica apresentada nesta dissertação. / Religious tribunal that owed its creation more to the portuguese king than to the roman church, it was as criminal justice of the external forum of sin that the Tribunal of the Santo Ofício of the Inquisition established itself before the other powers in Portugal, achieving relative autonomy from the church and from the monarchy. Not disregarding the royal and religious nature of the institution, it is mainly as a justice tribunal that the portuguese Santo Ofício of the Inquisition appears in this study: a so-called holy tribunal, but that pragmatically processed and judged based in evidences and judicial proofs of practices deemed as crimes at that time. Justice tribunal of other times, when sin was criminalized by civil and religious laws. Important juridical documents neglected by a considerable part of the historiography, the handbooks and regiments of the portuguese Inquisition were the basis of legislation to guide the Tribunal practices of justice. The main goal of this work was to understand in a historical perspective the lusitanian-christian juridical culture offered by those documents.
