Dědictví dle nařízení Evropského parlamentu a Rady č. 650/2012 / Inheritance under Regulation No. 650/2012 of the European Parliament and the CouncilPrůšová, Terezie January 2015 (has links)
This thesis deals with the Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession (regulation on succession). This regulation will be applicable in the matters of successions with cross-border implications of people who will decease on 17 August 2015 or later. Regulation on succession unifies legislation in matters of succession with cross-border implications, both in terms of substantive law and procedural law. This regulation has been expected for a long time in the European Union because the succession matters were expressly excluded from the scope of other regulations. Also thanks to the free movement of persons, the unification of this area of law is becoming more necessary from day to day. The preparation of this regulation and the connected discussions lasted several years. Not only for the numerous differences between the national rules of the Member States but also for the intention to create a complete unification of the substantive law, the succession proceedings itself and of the recognition, enforceability and enforcement of decisions. Politika EU v oblasti fúzí a dominantního postavení / EU merger and and dominating position policy: Forming of Visegrad countries banking sectors by cross-border mergers and acquisitionsHartmann, Ivo January 2008 (has links)
An unprecedented process of financial consolidation has taken place in the European Banking Sector over the past 20 years, which in the Visegrad countries was combined with economic transformation. As such, analysis of mergers and acquisitions is made with a view to the importace of the recent economic transformation and scope for further economic development and the Thesis is introduced by an analysis of the banking transformation in the Visegrad countries. Afterwards follows a theoretical part describing and analysing European legislation concerning banking mergers and acquisitions, incentives for them, factors, that support and hamper them, and the synergy following banking consolidation and its impact for supervisory bodies. Finally, building on the abovemetioned theoretical knowledge and premises, we apply them to the economic and banking environment of the Visegrad countries, i.e. we analyse the impact of the European cross-border mergers and acquisitions law on structural indicators of the banking sectors in the Visegrad countries.

Přeshraniční spolupráce v Euroregionu Nisa / Cross-border cooperation in Euroregion NisaŠachová, Anna January 2014 (has links)
Cross-border cooperation is an important instrument of European integration. The thesis deals with cross-border cooperation within euroregions, more precisely in the oldest Czech Euroregion Nisa. The objective of this thesis is to find asymmetries in the cooperation of the Czech part with the German and Polis hone, and how these asymmetries are reflected in realized projects. The thesis comes to a conclusion that the three parts of Euroregion Nisa are different when it comes to economic potential, and that the projects almost do not deal with the most pressing problems. Another conclusion is the existence of an asymmetry in cooperation, i.e. absence of common trilateral projects.

Antecedents and performance outcomes of the marketing integration process in cross-border mergers and acquisitions: the case of Malaysia and IndonesiaJedin, Mohd Haniff bin Haniff January 2011 (has links)
Cross-border mergers and acquisitions (M&As) are strategic business expansions across national boundaries, which provide bundle of resources and opportunity for growth strategies, however can prove rather problematic and complex. One of the most complex stages in cross-border M&As is when two firms are in the integration process. The most challenging part in a cross-border M&A, is the integration of two different firms that feature different management styles and organizational cultures. Once the integration seeps deeper into functional levels, the strategic level M&A commitment is faced with operational implementation issues. The marketing department is usually heavily involved in this integration process. These are the people who create and generate the sales which thereby increase the income of the combined firm. However, research on marketing integration related to M&As has paid little attention to the amalgamation of similar resources from two similar departments, particularly in the cross-border M&A context. Furthermore, the existing research does not clearly demonstrate the success factors that contribute to the marketing integration process in cross-border M&As. Hence, this thesis explores the role of the antecedents that influence the marketing integration process in cross-border M&As. Results indicate a significant impact on integration from marketing synergy and the redeployment of marketing resources. Meanwhile there is a striking result pertaining to the relationship between interaction and the speed of integration which is significant but negatively to influence the marketing integration process. In addition, cost savings and relationship effectiveness among the marketers of both the acquirer and the acquired firms are found to be highly significant and to positively support the M&A performance. This means that the commitment of the marketers from both firms relies on a close relationship in order to uphold the integration synergy while at the same time reducing cost and improving M&A performance.

State Strategy for Migration Management: Canada's Two Temporary Foreign Worker Programs, The Seasonal Agricultural Workers Program & The Live-in Caregiver ProgramReed, Austina J. 09 1900 (has links)

This study applies an IPE approach to examine the economic conditions, motivations and interests which have driven the Canadian government and two sending countries, Mexico and the Philippines, to accept the terms and conditions of a regulatory framework encouraging short-term labour migration between them. The features of program development which underpin the Seasonal Agricultural Workers Program (SAWP) and the Live-in Caregiver Program (LCP) have not been compared side by side. Nor have the two programs been compared for the relationship that has developed over the years between the Canadian government and the two sending governments of Mexico and the Philippines. The study's core research question asks how the process of regulating cross-border labour migration works and how it is coordinated between two or more governments that form part of a migration system.

An important research finding that emerges from the comparison is the categorization of different types of migration systems. I argue that the SAWP and LCP differ in how they are administered because relations between the various actors differ. Furthermore, what defines these relationships is the set of geopolitical and economic interests that each government carries when it negotiates the regulation of cross-border labour migration. Findings suggest that the geopolitical and economic imperative which has driven the SAWP's development is not the same for the LCP.
/ Thesis / Doctor of Philosophy (PhD)

Möjligheter och problem för en cross-borderregion – En fallstudie av Greater Copenhagen and Skåne CommitteeSilic, Tea, Stigertsson, Alexander January 2016 (has links)
Regional planning has become an important part of today’s politics. As a result of the ongoing globalization municipalties and cities now have to form partnerships accross borders to be able to compete for resources, residents and businesses establishments. Oresund collaboration was initiated when Denmark and Sweden formed The Oresund Committee, which today is called Greater Copenhagen and Skane Committee. The aim of this bachelor thesis is to investigate what the cooperation actually means to three selected municipalties in the region, how the region is perceived by media and how it is portrayed in planning documents. This has been done through a case study.Since the region is a cross-border region it struggles with problems that a region located in one country does not. The biggest issue that we have identified has to do with different laws and economic systems that exists within the region. This has affected the many residents living in Oresund, especially those who travel across the border on a daily basis. Another problem that has arisen concerns the undefined identity that is created by politicians and authorities, which becomes a problem when the citizens do not perceive themselves as a part of the mutual region. Furthermore we have identified an issue that affects the matter of democracy and the recently established border controls. This issue has become apparent due to low priority from the government and the politicians of the capital of Sweden. There are elements that demonstrate that some people consider Stockholm to be the most important actor for Sweden’s future growth, which leads to unequal distribution of power. This brings us to the final problem, dealing with the decision to impose border controls between Sweden and Denmark. The border controls have proven to be very costly for the society and for the travellers who lose a lot of time because of the inflexibility of the way the border controls are carried out. In the final section of this bachelor thesis we discuss what needs to be accomplished to be able to create a better future for Greater Copenhagen and Skane Committee.

Sources and Transport of Black Carbon at the United States-Mexico Border near San Diego-TijuanaShores, Christopher 08 June 2011 (has links)
At international border areas that suffer from poor quality, assessment of pollutant sources and transport across the border is important for designing effective air quality management strategies. As part of the Cal-Mex 2010 field campaign at the US-Mexico border in San Diego and Tijuana, we measured black carbon (BC) concentrations at three locations in Mexico and one in the United States. The measurements were intended to support the following objectives: to characterize the spatial and temporal variability in BC concentrations and emissions in the border region, to identify potential source areas of BC emissions, and to characterize the cross-border transport of BC and assess its impact on local and regional air quality. BC concentrations at Parque Morelos, the campaign's supersite, averaged 2.1 ?g m?? and reached a maximum value of 55.9 ?g m??. This average value is comparable to levels in large American cities like Los Angeles and similarly sized Mexican cities like Mexicali. The maximum value occurred near midnight, and similar incidents were observed on nearly half of the overnight monitoring periods. BC and carbon monoxide (CO) were strongly correlated at the Mexican sites. The BC/CO ratio was ~3 times higher in Tijuana than in Mexico City, suggesting that gasoline-powered vehicles in Tijuana emit more BC than is typical or that diesel vehicles comprise a relatively high proportion of the vehicle fleet. Tijuana's emissions of BC are estimated to be 380-1470 metric tons yr??. BC measurements were used in conjunction with modeled wind fields to simulate forward and backward particle trajectories. Generally, BC in Tijuana appears to originate locally, as backward simulations showed transport from the US into Mexico at only one site. The majority of the trajectory analyses indicate that there is often transport from Tijuana into the US, crossing the border in a northeasterly direction to the east of San Diego-Tijuana and sometimes as far east as Imperial County at the eastern edge of California. These results suggest that any air quality management strategies considering BC should account for contributions from the border region, as BC is chemically inert in the atmosphere and can travel up to thousands of kilometers. / Master of Science

Culture matters to multinationals' intellectual property businesses.Yang, Deli January 2005 (has links)
No / This paper will examine how intellectual property issues arise due to the influence of cultural origins and background in cross-border businesses. With this aim in mind, this study is contextualised within three inter-related research questions applying a case study strategy with 13 Chinese and US managers. First, the paper discusses what IP problems managers have encountered. Second, it focuses on why such problems have arisen, i.e. why these problems are related to culture. Finally, the paper synthesises how the interviewed managers endeavour to solve the identified problems. To conclude, the paper draws to the attention of international business managers and researchers the fact that culture should be taken into account when dealing with IP-related cross-border businesses.
