Kaohsiung has positioned itself vis-à-vis Mainland China which is situated in East Asia and has embraced two rapidly increasing global commercial centers: one of the massive cities group of Greater Hong Kong, including Hong Kong, Shenzhen, Guangzhou, Zhuhai and Macau and the other, Greater Shanghai, including Shanghai, Wuxi, Suzhou, Nanjing, and Ningbo. It is estimated that by 2020 the development of the coastal areas of Southeast Mainland China and the Yangtze River Delta will bring a second wave of rapid economic growth. Utilizing such a massive market power and regardless an economic integration via a CEPA formation, a West coastal economic area model or a shared market model across the Taiwan Strait, Kaohsiung should deem it important to seize the opportunity and function as a pioneer for direct cross-strait transportation with its advantageous position in the above-mentioned area. It should join the ensuing market and, through the massive market power of a harbor city, strengthen its advantages to attract more students from Mainland China to study in Kaohsiung. It is hoped that those who come to study in Kaohsiung will recognize Kaohsiung¡¦s advantageous position and learn democracy at campus and how to tolerate multi-culturalism. Moreover, it is hoped that through interpersonal interactions they will see Kaohsiung as their dwelling place for their work and life and subsequently utilize the city as a nexus point to reach the rest of the world. Employing the research method of Interactive Management (IM), the present study conducted two interactive symposiums on researching how to enhance the human resources in Kaohsiung in the aftermath of the direct cross-strait transportation. The participants to the interactive symposiums have come up with 12 strategies as the prerequisite preparations for the ultimate purpose of the symposiums ¡V to enhance the economic development of Kaohsiung and to attract high-quality human power to move to and dwell in Kaohsiung in order to contribute to the development of Kaohsiung. Concerning the issue of recruiting the students of Mainland China to receive the higher education in Kaohsiung, the result of the study indicates that the symposium participants demonstrate a higher degree of consensus on 1) how the universities and colleges in Kaohsiung should enhance their competitiveness and 2) a mutual recognition of the academic certificates as the most important pre-condition of the communication of the higher education across the strait. Moreover, in the second interactive symposium, in spite of the escalation of opinion diversion, it also shows that the symposium participants gradually adjusted their individual opinions to respecting and understanding others¡¦ opinions. Subsequently, a consensus was reached through brainstorming, independent thinking, rational debating and publicly opinion-expressing.

淺析簽署海峽兩岸共同打擊犯罪及司法互助協議之影響 / The study of consequences of signing “the agreement on cross-strait cooperation in combating crimes and mutual legal assistance between Taiwan and China”

This study focuses on the impact of signing " the Agreement on cross-Strait cooperation in combating crimes and mutual legal assistance" between Taiwan and mainland China. It intends to explore motivation and necessity of signing this agreement, the legal issues and operational process of this agreement, the history of cross-Strait cooperation of fighting against crimes and mutual legal assistance, and current status and problems. There are three major parts in this thesis. First, this study defines cross-Strait mutual legal assistance and of cross-Strait crime, confirms its meaning and scope, and then introduces judicial mutual assistance and cooperation in the international society of both sides. It analyzes the situation and trend of cross-Strait crimes, history of cross-Strait cooperation in combating crimes, the existing legal provisions on mutual legal assistance, and difficulties before the signing of the agreement. Secondly, this study introduces the content and effects of this agreement, includes the provisions, the actual operation, the laws related to it, the impact, and follow-up legislation as well as negative criticism. Finally, this study compares the situation before and after the signing of the agreement, understands the real benefits and finding the existing problems, and make evaluations on this agreement.

從法規透明化比較兩岸貿易便捷化之發展 / The cross-strait development of trade facilitation in respect of transparency

國際貿易是經濟發展的重要手段之一,然而無論在開發中或已開發國家,貿易商皆面臨貿易流程的繁文縟節。隨著各國的關稅逐漸降低,業者進行國際貿易時的貿易成本甚至已超過關稅成本。因此,有望透過貿易便捷化來簡化貿易程序,降低貿易成本。  近年來,兩岸貿易依存度日益提高,中國大陸更成為台灣最大的出口市場。兩岸各自推動的貿易便捷化皆獲得相當成效,然法規不透明為目前中國大陸對台最嚴重之非關稅障礙,而法規透明化又是貿易便捷化工作的其中一環,因此法規透明化為當前亟需進行之貿易便捷化工作。 由於兩岸皆為世界貿易組織會員,且貿易便捷化已納入WTO的談判架構,而GATT 1994第十條(貿易法令之公布與施行)亦揭示法規透明化乃世界貿易組織協定重要原則,因此本文檢視兩岸的法規公布、措施通知、提供草案評論、回覆諮詢、正當程序和司法救濟等透明化之世界貿易組織義務,作為兩岸法規透明化程度的衡量指標。 透明化雖然是內部即可進行之工作,但由於透明化的重要性不受中國大陸重視,因此其透明化成效有限。為解決此問題,有待建立法規透明化的兩岸合作機制,而該機制之完善將使兩岸業者受惠,雙方政府基於互惠立場,會使兩岸業者獲得更大幅公開的政府資訊,所適用行政程序中的相關權利更受到保障。 / International trade is important to economics, while there are plenty of red tape still existing in moving goods across borders, whether in developing or development countries. Following the decreasing of tariff barriers, trade costs to traders are much more than tariff costs. Therefore, it is necessary to cut down the trade cost by trade facilitation. Recently, cross-strait trade relationship is closer and Mainland China has become the biggest trade partner of Taiwan. The cross-strait development of trade facilitation is significant, but the greatest trade barrier between is non-transparency. Since transparency of trade policy is part of trade facilitation programs, the authorities have to improve the transparency of trade policies. China and Taiwan are the members of the WTO, and WTO Members agreed to launch negotiations on trade facilitation several years ago. Besides, Article X of the GATT 1994 provides that transparency is also the principle of the WTO Agreements. Transparency obligations in WTO include publication of trade policies, notification on measures, providing the opportunity for prior comments, responding to requests for information, due process of administrative procedures and ensuring the right of review and appeal. This article aims at assessing the compliance of China and Taiwan with WTO obligations in transparency. Because the importance of transparency, which can be improved unilaterally, is neglected by China, efforts paid to this transparency issue limited. To solve this problem, it is necessary to establish a cross-strait cooperation mechanism that benefits the traders in both China and Taiwan. Accordingly, the authorities would take reciprocal actions on opening information of the government and ensuring the rights of administrative procedures in a larger extent.
