Marriage is an important legal institution, which is connected with the development of Christian-Jewish culture and concerns, whether directly or indirectly, every one of us. In this is seen topicality of chosen topic and this fact is underlined by the adopting of the Act. No. 89/2012 Coll, the Civil Code, which is progressing in the continuity of the previous legislation, but it also brings a number of changes. In this work was used a large number of books, commentary literature, technical articles or legal textbooks. Finally, there are theoretical conclusions and statutory provisions, supported by higher Courts jurisprudence, which is despite of the changing in legislation, still apply. The work is divided into three parts which are preceded by Introduction and terminated by Conclusion. Part One is named Marriage, aims to bring readers the institution of marriage and to point out interdisciplinary character and the number of different approaches and attempts to define it. Marriage The aim of this thesis is to describe legal institution of marriage - from the conclusion of marriage to the ending of it - according to the current legislation. I compare main changes introduced by the new Civil Code with legislation before 1st of January 2014. The reason I chose this topic was the fact that institute of marriage affects everyday life of almost every individual. My thesis is composed of five chapters. Each of them deals with different aspects of marriage. Besides these five chapters this thesis includes Introduction, Conclusion, Index of Appendices and the List of Bibliographical References. Chapter one concentrates on the most important changes in the Family law area during the modern history, including recent recodification of private law. This chapter also contains summary of the main legal sources of marital law and examines the term marriage itself and its purpose. Chapter two focuses on the conclusion of marriage. MARRIAGE The purpose of my thesis is to describe and to analyse individual aspects of marriage. The reason for choosing this topic is the fact that the marriage is legal institution which is part of life of nearly every single person. The aim of this paper is to analyse this topic from the view of the current legislation on the conclusion of the marriage, on mutual relationships between spouses and on the end of marriage. The thesis is composed of four chapters, each of them dealing with different aspects of the marriage. This Master's degree thesis addresses the issue of the divorce of marriage and problems of divorce with minor child in Czech and English law. It includes informations about changes brought by new Civil Code Act No. 89/2012 Coll., which is coming into force on 1.1.2014. The purpose of the thesis is to analyse current regulation of the divorce of marriage and problems of divorce with minor children in the Czech Republic and England and its comparison with Civil Code Act 2012. The thesis is composed of six chapters. They are divided into many subchapters in way that it is easy to look up and compare individual law problems of any main topic. It covers present legislation in force and Civil Code Act 2012 in the Czech Republic and present legislation in force in England. 1 Abstract Marriage The topic of my Master's degree thesis is Marriage. The reason for choosing this topic is that I believe marriage is everlasting and is still a very current legal institute that influence day-to-day live of individuals. The purpose of my thesis is to analyze and describe the entire existence of the legal institute of marriage from the beginning to the end. My research is mainly focused on entering into marriage, content of marriage itself, means of the termination of marriage and finally on associated legal consequences. The topic of the thesis is divorce and its consequences on property - comparison of Czech and German legal regulation. The thesis is divided into four basic chapters, in which there is described the history of divorce, then there is explained the term of divorce itself followed by definition of different matrimonial property regimes in the Czech republic and in Germany. In the end the thesis concerns settlement of property between spouses after the divorce. The thesis profits from both analytical and comparative methods of approach. Each chapter is divided into subchapters for better clarity and easier orientation. The subchapter consists of first explonation of Czech legal regulation, followed by German legal point of view and both of them are compared at the end of each section. The aim of this thesis is to explore similarities and differences between both legal regulations. First chapter deals with the history of divorce. M.A. (Social Work) / The study focuses on the meaning of divorce for mothers of divorced women, and consists of two parts : * A review of literature related to the extended family, social networks, research, families of origin and divorce; * an empirical investigation. During the latter, practicing social workers assisted with the identification of the sample group consisting of 25 mothers. The major findings of the empirical part of the study are summarised as follows On the whole mothers reported that : At an early stage of their daughters marriage they were aware of the likelihood that the marriage would end in divorce; - approximately 50 percent of mothers maintained a stable relationship with their son-in-laws after the divorce; - the most common reaction of mothers after having been informed of the divorce was one of sorrow and the second most common reaction interestingly enough was relief that the divorce would bring an end to disharmony; - the mothers preferred to discuss the divorce of a daughter with a family member for emotional support; - most mothers found it necessary to financially uphold their daughters after the divorce; - sixty-eight percent of the mothers accepted the divorce of a daughter within one year after the divorce took place...

Le rétablissement de l’égalité rompue entre les époux était l’une des questions épineuses qui ont motivé les différentes réclamations des réformes du droit de la famille au Maroc.La nouvelle voie de divorce pour discorde s’inscrit dans cette logique qui est d’octroyer à la femme le droit de se libérer du lien de mariage sans qu’elle ait besoin d’établir aucun motif, tout comme le droit du mari à la répudiation.La procédure de discorde, d’origine purement religieuse, est appelée à assurer une double fonction, d’une part, répondre à la question du référentiel religieux, d’autre part, rétablir l’égalité entre les sexes lors de la rupture du lien conjugal. Mais la réglementation législative de cette institution cache un consensus entre les deux courants : conservateur traditionaliste et celui favorable à la promotion des droits de la femme, ce qui ne manque de se répercuter sur la pratique jurisprudentielle et l’appréhension doctrinale de la procédure de divorce et menace l’existence même des motifs classiques de divorce voire de la répudiation. / Restoring the equality disrupted between spouses is one of the big issues which motivated the claims to reform the family code in Morocco.The new divorce on the ground of discord is to grant women the right to free herself from the marriage bond without providing a cause, same as the right of men of repudiation.The discord procedure, which is purely religious, aims at answering the religious terms of reference and restoring the equality between men and women when the marital bond is terminated.However, the legislative regulation in this institution hides a consensus between the two parties: conservative and traditionalist vrs the one in favor of promoting women’s right. Research in the field of divorce has primarily focused on women and children, and there is a definite lack of literature that addresses divorce from a male perspective. This lack of knowledge has influenced the clinical treatment and general social support available to men who get divorced. This study aims to explore which, if any, of the personality factors in the 16PF are correlated with adjustment to divorce using the Fisher Divorce Adjustment scale in South African men. The divorce-stressadjustment perspective was used to conceptualise adjustment to divorce and the factors that influence adjustment to divorce (Amato, 2000). The sample consisted of South African men who were divorced. A sample size of 40 participants was obtained using convenient sampling. The results of the study indicated that the personality factors ‘Anxiety’ and ‘Emotional Sensitivity’ are significantly and negatively correlated to adjustment to divorce. This indicates that aspects of personality that relate to a robustness of ego, low anxiety and a self-confident individual who is emotionally mature, is more likely to adjust significantly better to divorce and thus contribute significantly to the well-being of an individual post divorce.
