Atualmente estamos verificando um aumento significativo de processos judiciais na Odontologia e também em relação à especialidade de Endodontia. Frente a esses fatos este trabalho teve como objetivos fazer um levantamento no SEAP (Serviço de Assessoria Pericial da FOP/UNICAMP) num período entre 2005 e 2010 de processos envolvendo a Endodontia. Dentre esses processos envolvendo a endodontia, foi levantado o que se segue: a incidência de processos judiciais junto ao SEAP; a existência de prontuários e seus documentos constitutivos enviados para a perícia; o motivo principal que uma lide judicial e também discussão dos aspectos éticos e legais inerentes ao tema. Obtiveram-se como resultados: a incidência de processos judiciais em endodontia no período proposto (2005 a 2010) foi da ordem de 6,97% (n=6) do total de processos arquivados (n=86); os documentos (prontuários) apresentados pelos Cirurgiões-Dentistas nas perícias se encontravam incompletos, sem anuência do paciente em relação ao tratamento proposto e sem contrato de prestação de serviço; o principal motivo que gerou a ação judicial foi a quebra da relação paciente/profissional, além dos motivos de ordem técnica; os Cirurgiões- Dentistas deveriam realizar diariamente um prontuário completo, pois a falta de documentos deixa o C.D mais propenso a uma demanda judicial / Abstract: The Endodontics as well as any other area of Odontology is subjected to failures. We are currently observing a significant increase in Odontology litigation and also in the specialty of Endodontics. Given these facts, this study aimed to survey the SEAP for a period from 2005 to 2010 of processes involving Endodontics. Among these processes involving Endodontics were raised: the incidence of cases at the SEAP; the existence of records and its constituent documents sent to the medical examination; the main technical reason involving Endodontics that motivated the lawsuit and also the discussion about legal end ethical issues inherent in the subject. Were obtained as a result: the incidence of litigations in endodontics in the period proposed between 2005 and 2010 was 6,97% (n=6) of a total number of cases filed ( n=86); documents ( medical records) submitted by Surgeon Dentists to medical examination were incomplete, without consent of the patient regarding the treatment proposed, and no service contract; the main reason which generated the lawsuit was the breach of relationship patient/professional, besides of technical reasons, the Surgeon Dentists should daily fill up complete medical record, as the lack of documentation makes the Surgeon Dentists more vulnerable to a lawsuit / Mestrado / Odontologia Legal e Deontologia / Mestre em Biologia Buco-Dental

Name of the thesis: Employee Liability for Property Damage and Harm To a Person The aim of this thesis is to analyze employee's liability for damage in a broader historical context, extending also to the theory of law, to distinguish the specifics of labour law liability from the civil law liability and to define the prerequisites for the emergence of different types of employee's liability for damages and to elaborate on them in detail, especially through scientific literature and case law. In the first chapter, I describe labour law in brief historical context relevant for the topic, with reference to key changes in the development of labour law legislation. In accordance with aforementioned, in chapter two I then focus on the theory of liability, namely liability for damage, and then in chapter three I analyze in detail the liability for damage as regulated in the Act No. 262/2006 Coll., Labour Code. Chapter four strives to outline the functions of liability for damage in employment relationships and defines the prevention of damage. The aim of this thesis is to give an analysis of liability for damage in the Czech labour law, viewed by the practise of the courts. The thesis is composed of seven chapters, each of them dealing with different aspects of liability for damage in labour law. Chapter one is subdivided into two parts. Part one describes liability for damage in general and it's specifics and functions in labour law. Part two deals with how the Labour Code governs prevention of damage. Chapter two looks at binding nature of case-law in the civil law from a different point of view. Chapter three deals with all kinds of the liability of an employee. It is subdivided therefore into four parts. The first one that explores General liability of an employee, is divided into another six parts, each focused on one of the basic conditions of liability for damage in labour law, namely: employment relationship, breach of legal obligation, damage, causal connection, fault and performance of working tasks (together with following acts in direct connection with it). Résumé Liability for damage in the judicial practice The intention of my thesis is to analyze the contemporary state of legal regulation concerning liability for damage in employment relations, considering not only the respective provisions of Act N. 262/2006 Sb., the Labour Code, as amended, but also with respect to the significant judicial practice. The composition of this topic basically follows the systematics of the Labour Code. The script is composed of six chapters, each of which is further subdivided in order to preserve a certain sequence and hierarchy. The opening chapter is dedicated to the theoretical conception of legal liability for damage in general, concluding with a brief article about the General liability for damage according to the Civil Code. Chapter two describes the integration and the purpose of the practice of the courts in relation to the Czech legal order. Com a mudança do comportamento da sociedade, influenciada pela reforma da Constituição Federal (1988), do Código de Proteção e Defesa do Consumidor (1991), do Código Civil Brasileiro (2002), tem sido observado um aumento no número de processos éticos e judiciais, contra a classe odontológica. Concomitantemente, gerou-se também uma transformação no sistema de assistência odontológica, com a criação das empresas de prestação de serviços odontológicos. Assim, estas têm exigido uma mudança na personalidade jurídica dos profissionais, obrigando-os a se tornarem pessoas jurídicas, sem que estes tenham consciência real desta transformação. De acordo com o Código de Proteção e Defesa do Consumidor, o cirurgião-dentista enquanto pessoa física somente será responsabilizado, mediante apuração da culpa, respondendo nos moldes da Teoria da Responsabilidade Subjetiva. Entretanto, se o profissional estiver caracterizado como pessoa jurídica responderá nos termos da Teoria da Responsabilidade Objetiva, isto é, a culpa é presumida pela lei, bastando a prova da relação entre o ato e o dano, para que se tenha a obrigação de indenizar. Outro ponto importante consiste nas implicações que os profissionais passam a ter perante os órgãos públicos e tributários. Propôs-se observar o grau de conhecimento dos profissionais em relação aos aspectos éticos e legais relacionados à personalidade adotada, bem como em relação a legislação aplicada à odontologia. Para tanto foram avaliados 122 questionários e os dados obtidos foram agrupados segundo variáveis classificatórias. A análise estatística incluiu Testes de Qui-quadrado e Teste Exato de Fisher. Os resultados finais demonstraram que os cirurgiões-dentistas não estão devidamente preparados em relação aos conhecimentos éticos e legais pertinentes ao exercício profissional, tornando-se vulneráveis em casos de litígios. Em relação aos impostos, concluiu-se que os profissionais não possuem conhecimento sobre os principais impostos relacionados à cada personalidade jurídica. Em relação aos aspectos positivos e negativos de cada uma das personalidades, os principais aspectos positivos em atuar como pessoa física são a adoção da teoria da responsabilidade subjetiva e a questão tributária mais suave. Já o aspecto negativo seria a maior dificuldade em se conseguir convênios. Em se tratando da pessoa jurídica, o principal aspecto positivo é facilidade de credenciamento junto aos planos de saúde. Quanto aos aspectos negativos, temos a carga tributária, e a responsabilidade civil que não é pacífica na doutrina, nem na jurisprudência, podendo ser entendida como sendo objetiva ou subjetiva. Por fim, concluiu-se que a responsabilidade civil do profissional liberal enquanto pessoa física é, em regra, subjetiva. A responsabilidade dos planos de saúde, segundo a doutrina majoritária e jurisprudência, é objetiva. A responsabilidade civil das clínicas odontológicas é em regra, objetiva. Contudo, em relação aos danos decorrentes da prática profissional/clínica, o ato profissional regular romperia o nexo de causalidade devendo-se, avaliar a conduta do profissional antes de se responsabilizar em juízo a clínica. / Abstract: A short time ago, a greater number of surgeon-dentists who practised their functions in the cities of Betim and Contagem (Metropolitan Region of Belo Horizonte), restringed to carry out their work as an individual person, that's to say, as an independent professional. With change of behavior in society, influenced by the Federal Constitution reform 1988, the Consumer's Protection and Defender Code (1991), and the Brazilian Statue Book (Civil Code) in 2002, it has been observed an increasing number of ethical and juridical processes against the odontological class. Concomitantly, this has also originated a transformation in the odontological assistance rendered companies. So, they have urged a changing in the professionals' juridical personality, obliging them to become juridical people, even without being really conscious about this transformation. According to the Consumer's Protection and Defender Code, the dentist, as long as being in individual person, will only be considered professionally responsible, by means of a check of his culpability, answering according to the Subjective Responsibility Theory. In the meantime, if the professional is characterized as an juridical person, he will answer in the terms of the Subjective Responsibility Theory, that's to say, the guilt is presumed by law, being enough only the proof of the relation between action and damage, so that one has the obligation of indemnification. Another important point consists in the implications that the professionals begin having, before the public and tributary organs. It has been proposed to watch the professionals' rate of knowledge relating to the ethical and legal aspects concerning to the adopted personality, as well as, in regard to the legistation that is applied to Odontology. Thus, 122 questionnaires have been evaluated and the obtained results were gathered according to variable ranks. The statistic analysis has included Chi-square and Fisher exact tests. The final results showed that the surgeon-dentists are not duly prepared, concerning to the ethical and legal kwowledges, pertinent to the professional practice, becoming this way, vulnerable in case of litigations. Concerning to taxation, it has been concluded that the professional's don't have knowledge about the main taxes related to each juridical personality. In regard to the positive and negative aspects of the personalities: the main positive ones, in acting as an individual person are the adoption of the Subjective Responsibility Theory and the taxation matter, that is lighter in this case. On the other side the negative aspect would be a bigger difficulty in achieving partnerships. Concerning to the juridical person, the main positive aspect is the facility of getting credentials near the health cares. As for the negative side we have high taxes and also the damage liability which can be objective or subjective (the matter is not pacifical in the doctrine nor in the jurisprudence), so it is possible to be understood as objective or subjective. At last, it has been conclueded that the damage liability of the liberal professional, as an individual person is, as a rule, subjective. The responsibility of the insurance health, according to the majority doctrine and jurisprudence is objective. The damage liability of the odontological clinics is, as a rule, objective. Resumé This diploma thesis deals with compensation for damage under the civil law. The work gives a detailed explanation regarding this institution and highlights the most significant changes that have been brought by the new Civil Code. The aim is mainly to introduce different methods of compensation and basic procedures, that are used in determining the extent of compensation. This thesis is composed of six chapters. In the introductory chapter, the attention is given to the most significant changes that occurred in the area of tort law in comparison with the previous legislation. Moreover, there is discussed the change in the concept of liability for damage and its basic functions in more details. The following parts are focused on the analyze of duty of care and the limitation of the rights to compensation. The main topic of the second chapter is the definition of the basic assumptions leading to the obligation to compensate for damage. These assumptions include tort, damage, causation and the fault. The liability of the employee for damage in theory and practice The purpose of this thesis is to analyse the national legislative framework and highlight the differences between theory and practical application of the employee's liability for damage caused to the employer. The reason for my research is based on the fact that the importance of this issue is increasing driven by the fact that more people are employed with the multinational corporations. And there is an obvious trend to broadly interpreted, unilaterally extend and refine duties of the employees to such an extent that it is appropriate to raise a question, whether these approach is still in accordance with the law. Especially due to the fact, that such duties are often bound by sanctions in the form of claiming damages or even termination of the employment by notice. While the Labour Code in its general provisions clearly states that the adjustment of the employee's duties may only be stipulated as a result of bilateral legal negotiations. v německém jazyce Haftung des Skigebietsbetreibers für Schäden stellt ein spezifisches Rechtsproblem in der Tschechische Republik dar, das in der wissenschaftlichen Umgebung oft übersehen wurde. Diese Arbeit soll grundlegende Orientierung des Skigebietsbetreibers in der unübersichtlichen Rechtslage dienen. Gleichzeitig können Sie hier eine Inspiration finden, wie man das Skigebiet besser absichert soll, damit man die Entstehung von potenziellen Schäden verhindern kann. Für diese Problematik ist die rechtliche Verankerung grundlegend, die wir in der öffentlich-rechtlichen und auch in zivilrechtlichen Normen finden. Von den öffentlich- rechtlichen Normen kann man das Gesetz über Bahnen Nr. 266/1994 Sb. erwähnen, das den Betrieb von Seilbahnen, Sesselliften und Skiliften reguliert. Eine wichtige Rolle spielt auch die Tschechische technische Norm "ČSN 01 8027 über Markierung und Absicherung in dem Wintergebieten", die die Markierung, Absicherung und Bewegung in dem Skigebiet verankert. The topic of this Master's degree thesis is "Comparison of the legislation of the damage liability in the Czech and Austrian civil law". The purpose of the thesis is to give the general summary of the topic and to point out the main differences and similarities in the area of damage liability in the Czech and Austrian civil law. The core of the thesis consists in the comparison of the tort liability, i.e. damage liability arising from the illegal act (tort law) and the strict liability. The thesis should also verify, if the legislation of the damage liability in the traditional Austrian Code - Civil Code of Austria - is similar to the legislation in the Civil Code of the Czech Republic and if the Civil Code of Austria was an inspiration for the new Czech Civil Code. Právní aspekty odstraňování ekologických škod / Legal Aspects of Removing environmental Damages

A widespread occurrence of the former ecological damages and contaminated locations in the Czech Republic has been a rudiment of more than 60 years of non-democratic regimes in 1938-1989. Then, the preserving of nature and handling of harmful substances for industrial and other purposes was at a very low level. A systematic removal of these detriments of the past extended after democratisation in1990. The Czech State has taken on the responsibility for removing some of these damages, especially as a part of privatization. This has been a long-term, risky and legally demanding enterprise. A unified, co-ordinated approach to the matter at a national level has not been established yet, despite of the enormous budget. Moreover, some of the issues have not been addressed at all. Such a situation requires an immediate action since the public health has been put at risk either because of a direct contact with harmful substances or due to the groundwater contamination. Time-wise, the legal commitment of the State regarding the budgeting for decontamination of the former ecological damages of the privatized assets has not been limited.
