Šio magistro darbo tema yra ,,Autorių teisių ir gretutinių teisių kolektyvinio administravimo muzikos srityje aktualijos“. Naujųjų technologijų raida ir interneto specifika nulėmė muzikos įrašų naudojimo pokyčius: atsirado nauji muzikos įrašų panaudojimo būdai bei galimybė nesunkai pasiekti šiuos įrašus daugeliui asmenų iš bet kurios pasaulio valstybės. Dėl šių pokyčių muzikos srityje veikiančios autorių teisių ir gretutinių teisių kolektyvinio administravimo organizacijos pastaruoju metu susiduria su tam tikrais iššūkiais. Šio darbo tikslas yra atlikti su muzikos naudojimu internete susijusių autorių ir gretutinių teisių kolektyvinio administravimo aktualijų tyrimą, atskleisti interneto keliamus iššūkius kolektyviniam teisių administravimui ir įvertinti esamą kolektyvinio teisių administravimo situaciją bei Europos Sąjungos lygiu inicijuotą kolektyvinio teisių administravimo reformą. Darbe, išanalizavus kolektyvinio teisių administravimo veiklos ypatumus ir bendruosius autorių bei gretutinių teisių apsaugos klausimus, nagrinėjami su muzikos naudojimu internete susiję kolektyvinio teisių administravimo klausimai: analizuojami muzikos naudojimo internete atvejai, su jais susijusios autorių, atlikėjų ir fonogramų gamintojų teisės, šių teisių kolektyvinis administravimas, kolektyvinio administravimo organizacijų abipusio atstovavimo sutarčių įtaka muzikos kūrinių, atlikimų ir fonogramų naudojamo internete licencijavimui bei Europos Komisijos iniciatyva dėl tarptautinio... The development of innovative technologies and the particularity of the internet have determined the changes in the use of music records: the new types of music records uses and the possibility for many persons from any country to get these records easily have emerged. Due to these changes copyright and related rights collective management societies operating in a musical field recently have faced some challenges. The aim of this thesis is to make the analysis of the key aspects of copyright and related rights collective management in a field of online music use, to reveal the collective rights management challenges caused by the internet and to evaluate the present collective rights management situation and the collective rights management reform initiated at European Union level.
