The Analysis of The Disputes in Construction Contact

The properties of Construction Engineering include: (1) high building cost, (2) unpredictability of construction risk because of the fact that the period of executing the contract is long and the external environment is easy to change, (3) the phenomena that disputes and conflicts happen easily since a construction project normally requires a large number of constructing units, each of which owns their complicated construction technology and expertise. As the process of the construction project involves various risks, the awareness of these risks and the method of diversifying the risks become important. This dissertation focuses on study of the legal aspects of the construction contact; It first tries to analyze the properties of the construction contract, its related properties which cause higher risks than contract with consideration, and different types of disputes and conflicts in common dispute decision and arbitration judgment in construction projects. Then it studies the commitment resulting from the disputes, and the comments on disputes of same kind in the real cases. Further it makes a basic proposition to the comments. Finally it examines the feasibility of the proposition through interviewing with some experts (adopting the method of Delphi). Meanwhile it modifies the proposition and adds more comments onto it proposition, in the hope that both of the owner and the contractor can prevent the disputes at the time of making contract.¡@ In most of the real case, the owners normally transfer the risks they should have taken to the contractors. This way of distributing risks may not either bring efficiency or benefits to the contract; instead it brings more losses to both sides. There are no many clauses in the section Hire of Work in Civil Code regarding distribution of risks. Those clauses leave incomplete resolution of various risks likely to happen in the contract. Therefore it is necessary to emphasize the principles of risk distribution in the construction contract¡Gmainly the just and reasonable principle, principle of change of circumstances, and principle of good faith, etc. The construction conventions can be referred too, such as convention of project fact, and the commom law which ie formed of the opiom by the court¡Barbitration judgment¡Bmediation¡C

Approach to the Influencing Factors of Partnership in E-Marketplace Abstract In light of the inter-dependency between emerging technology and inter-organizational relationship, an initial research framework is built upon the spirit of Adaptive Structuration Theory. This research aims to explore the influencing factors of three-phased partnership in e-marketplace. As a result, through literature review and expert interview, the framework is verified and presented as the research model. An empirical study is conducted to verify the research model. Through literature review, expert depth interview and questionnaire survey, the viewpoints from practical experts, leading companies in IT industry, and management level are generalized. The forecast of prospective relationship style of partnership in e-marketplace is also constructed in this study. By means of the comparison among those surveyed groups, the common points are explored, as well as the differences. Urban development would be halted with the over-concerned of material life, the rising unemployment, the increase in crime rate, the deterioration of living standards, the decrease in population, the deficiency of tax revenue, and the difficulty of industrial change. The sustainable development of a city would be also endangered. Urban development world not move. The sustainable development of a city would be also endangered. To successfully deal with these problems and gain the new-vitality for the city, besides the renovation of hardware and facilities, soliciting investment, upgrading industry, and reorganization of urban appearance all are very significant strategies for the city to survive and thrive. However, to a city, it is necessary to introduce innovations in the way that sustainable development is done. The application of the theory and concept of urban marketing is a revolution of the concept of urban management. Marketing is originally the part of business in which is concerned with the way in which a product is sold. The application of marketing techniques to urban development would cover a wider range of city selling. It helps to revive vitality of cities through the marketing management of urban tangible and intangible value. Generally speaking, with the increase in vitality of industry and the rival of the economy, urban can become active again. However, these are only rigid developments. To guarantee the sustainable development for a city, it is necessary to propagate the idea of marketing, and build up the culture of citizens. It has been over twenty years since the reformation and liberalization in Mainland China. Indeed, the reformation and liberalization has resulted in a vivid progression for the whole country, especially in the economical achievement of the alongshore cities. It is something like a huge magnet, attracting capital from all over the world. The investments of Taiwan merchants in Mainland China have been seen one after another. Even so, in Chinese, there is still not enough systematic research of urban marketing done by the government or the academic system. Furthermore, the economical and trading development discussed in China has always been more concentrated on the southern part than on the northern part of China. In fact, the role of economical power of the district around Po-Sea has been significant during modern history of China. From local economical point of view, Dalian is the most important city in the area of northern China. The pattern of its development is different from those of other alongshore cities in the southern China where the economy and society system has been reformed and liberalized. The leader of the city government possesses very clear rules for administration. The characteristic of infrastructure of the city, plus achievements of various soliciting investment, has possessed the basic elements of urban marketing. According to the result of checking the strategy and policy of Dalian urban marketing by using theory of strategic planning and measuring the actual achievement of its urban marketing by the method of Delphi, it is discovered that Dalian¡¦s urban marketing strategy¡Ð¡¨not for the biggest but for the best¡¨, is very accurate. It has become the common value of the residents regarding their city; therefore, both of the defining urban appearance and the international costume festival can be accepted by the public. People also highly accept the role of Dalian as a harbor city. Nevertheless, the city government has no way to satisfy what people need about this point. Another important point discovered in this research is that the culture deficiency has a negative effect on the city development, although Dalian obtained very significant achievement in soliciting investment and upgrading industry. It is an obvious problem that Dalian is much more concentrated on economy and less on cultural development during the process of urban construction. To solve the problem of urban development not moving, Kotler, the mastic of marketing, proposes the theory of urban marketing, which has been proven work well in many European countries. But it is the first time to examine Mainland China¡¦s urban development by using urban marketing theory. Based on the theory and real case study, it has been proven that the reorganization and development of economy can reduce the barrier of the different political system. Furthermore, it also riches and strengthens in contents of Kotler¡¦s urban marketing theory.

Defining a competency framework to shape the professional education of national security master strategists: a web-based Delphi study

The purpose of this study was to develop a competency framework to shape development of a professional education program for master strategists in national security. The research problem focused on the absence of a competency framework to guide professional education of strategists who must be capable of conceptualization and innovation master strategists. The outcome of this study was a set of the most important components that constitute a professional education framework for master strategists. This Web-based study followed a RAND Delphi heuristic model that is qualitative in nature. Instrumentation for the first round consisted of a short vignette that placed panelists in a unique situation of being able to engage a "time traveler" from 20 years in the future. The time traveler represented a source of perfect knowledge, but could provide only a "yes" or "no" response to panel member questions concerning master strategist professional education needs in the year 2022. In the subsequent two Delphi rounds, the instruments consisted of panel member questions from the previous round. The panel of experts consisted of 12 professional strategists in the field of national security strategy. The results of the study provided support to the description of master strategists as strategic leaders, strategic theoreticians, and strategic practitioners. Panelists highlighted four content domains of personal attributes, security framework, theorybased knowledge, and culture and values that encompass the range of competencies for a master strategist professional education framework. Panel members detailed a need for master strategists to have a higher order temporal perspective to conceive time as epochs and ages, defined as shifts in development punctuated by events and prominent periods in progress, respectively. Panelists described a master strategist professional education framework that mirrored the theory of profound knowledge with meta-competencies as the basic building blocks.

A study of the Competence-based Model to Choose Labor Conflict Mediators Based on the Application of Analytic Network Process

Labor conflict mediators play a very important role during the process of labor dispute resolution; their competence will help enhance the quality of labor dispute mediation and improve the relationship between labor and management. The main purpose of this research is to probe into the criteria that labor conflict mediators should possess. Based on the Competence Theory, this research collects opinions from experts and scholars and utilizes Fuzzy Delphi Method and Analytic Network Process respectively to construct a competence-based model to select labor conflict mediators. Results are achieved as follows: 1. To firmly establish critical competence items and definition of labor conflict mediators, including practical experience, problem resolution, professional expertise, fairness and objectivity, integrity, thinking and judgment, and investigation ability, in order to set up the hierarchical structure of competency indices. 2. In consideration of the dependency relation among principles of competency, this research utilizes Analytic Network Process to systematize decomposition and quantify judgment, in order to firmly establish the weight of competency indices, as well as to construct a competence-based model with an evaluation standard of weight to select labor conflict mediators. 3. Through the empirical study, the competence-based model to select labor conflict mediators which is constructed in this research can effectively discriminate outstanding labor conflict mediators. 4. The competence-based model developed in this research to choose labor conflict mediators utilizes the following procedures: (1) collate the competence indices; (2) To utilize Fuzzy Delphi Method to identify critical items of competence; (3) To utilize Analytic Network Process to firmly establish the weight of competence items; (4) To develop the competence-based model; (5) To examine the effectiveness of competence-based model.
