Na Encruzilhada da Democracia : um diálogo entre as teorias de Jurgen Habermas e Hans Kelsen /

Orientador: Carlos Eduardo de Abreu Boucault / Banca: Gustavo José de Toledo Pedroso / Banca: Antônio Ianni Segatto / Resumo: A atual pesquisa objetiva analisar o pensamento democrático, em contraponto e apontando outrossim suas semelhanças, de Jürgen Habermas e de Hans Kelsen. Partiremos do estudo do pensamento de grandes filósofos gregos e europeus, de épocas variadas, que fundaram as bases filosóficas para a compreensão da democracia, seja através de uma teoria política, seja através de uma teoria de caráter sociológico ou metafísico. Além disto, analisaremos as questões democráticas no pensamento de Hans Kelsen e sua Teoria Pura do Direito, bem como seus escritos sociais e filosóficos, durante o segundo capítulo. Ao terceiro capítulo, analisaremos as teorias relativas à democracia propostas por Jürgen Habermas e abriremos caminho para o diálogo propriamente dito entre as teorias democráticas de ambos os autores, ocorrendo este no quarto quinto. Finalmente, proporemos uma aproximação, se possível, entre a Teoria do Agir Comunicativo de Habermas e as bases conceituais da democracia estudadas nos capítulos anteriores, a fim de verificar a atualidade e importância das teorias de Habermas, buscando ensejar a continuidade das pesquisas científicas nesta área temática. / Abstract: The present research aims to analyze democratic thinking, in counterpoint and pointing out also its similarities, of Jürgen Habermas and Hans Kelsen. We will start from the study of the thinking of great Greek and European philosophers of varied epochs, who founded the philosophical bases for the understanding of democracy, whether through a political theory or through a theory of a sociological or metaphysical character. In addition, we will analyze the democratic issues in Hans Kelsen's thinking and his Pure Theory of Law, as well as his social and philosophical writings, during the second chapter. In the third chapter, we will analyze the theories on democracy proposed by Jürgen Habermas and open the way to the dialogue itself between the democratic theories of both authors, occurring this in the fourth chapter. Finally, we propose an approximation, if possible, between Habermas Theory of Communicative Action and the conceptual bases of democracy studied in the previous chapters, in order to verify the relevance and importance of Habermas theories, seeking to provide continuity of scientific research in this thematic area. / Mestre
