Analýza postavení osob se zdravotním postižením na trhu práce v letech 2000 - 2014 / Analysis of the position of persons with disability in the labor market in the years 2000 - 2014

This thesis deals with a position of persons with disability (PWD) in the labor market from the perspective of these individuals. Based on the data obtained by questionnaire survey was conducted SWOT analysis which shows that PWD do not perceive negatively their own position on labor market. However, there is always something to improve, whether by themselves or in the surroundings in which they move. Furthermore, this thesis analyzes the impact of legislative measures to promote the employment of people with disabilities in 2000 - 2014. Based on the data obtained by the Czech Statistical Office was conducted regression analysis of three models. Estimates of econometric models support the hypothesis that higher unemployment in the case of persons without a disability employment is declining persons with disabilities. Further, it failed to confirm the hypothesis that the impact of legislative changes to promote employment for persons with disabilities has a positive effect on the employment of these persons. The last hypothesis that says that these legislative changes have no impact on the unemployment rate of persons without a disability was confirmed.

India and Intellectual Disability: An Intersectional Comparison of Disability Rights Law and Real Needs

Given its vast population, India has one of the highest absolute numbers of people with intellectual disability (PwIDs) in the world. Studies have placed the prevalence as high as 3.1% of children aged between 2 to 5 years and 5.2% of children aged between 6 to 9 years. India recently passed the Rights of Persons with Disabilities Act, 2016 (RPwD Act), to align itself with the United Nations Convention on the Rights of Persons with Disabilities. This thesis applied the complementary methods of the review of academic and grey literature, document analysis of the RPwD Act, and in-depth informant interviews to become the first full study on the extent to which the RPwD Act meets the needs of PwIDs. Drawing on the biopsychosocial model of disability and intersectional theory, the findings show that the RPwD Act only partially meets the needs of PwIDs. The RPwD Act does incorporate progressive elements such as affirmative action provisions in the labour market, measures to prevent unethical research on PwIDs, and steps toward inclusive education. However, the Act stipulates a disability certification process that remains mired in the medical model of disability and is mostly inaccessible in rural areas. It also continues the system of legal guardianship dating to the colonial era which deprives many PwIDs of legal capacity and leaves some of them confined to long-term institutions with highly inadequate levels of care. Other problems in the Act include inadequate provisions to provide privacy, reproductive rights and education, and protection from discrimination.

Employees’ perception of the factors that prevent disclosure of disability status to the employer: case of a selected higher education institution

Magister Commercii - MCom / There is an increase in the number of people with disabilities entering, and in the workplace. Industrialised countries are encountering a workforce that is ageing, which makes the prevalence of disability, due to chronic illness amongst employees, more evident. However, even with legislation and policies that support people in the workplace, such as the Employment Equity Act 55 of 1998, the Broad-Based Black Economic Empowerment Act 53 of 2003 and the Code of Good Practice on Disability in the Workplace, many people still choose not to disclose their disabilities. Therefore, the main purpose of the study is to identify the perceived factors that could possibly prevent the disclosure of disability in the workplace. The study was conducted at one of the universities in the Western Cape. The study was qualitative in nature and made use of semi-structured interviews. Ten participants took part in the study and comprised of two academic staff members from each of the faculties on the main campus. Content analysis was used to analyse qualitative data where various themes and subthemes emerged.

A Study of School Social Worker Involvement with Section 504 of the Rehabilitation Act in Georgia Public Schools

This study explored the level of involvement of school social workers in the 504-Plan process as it relates to the administrative culture of school administrators, collaboration with school personnel, training on the 504-Plan process, and finally knowledge of Section 504. Attention-deficit hyperactivity disorder affects over six-million children in the world today that may benefit from the use of a 504-Plan. A total of 147 school social workers participated in this study. A self-administered survey was used, and data analysis was conducted on two levels: descriptive which employed frequency and percent distributions of respondents and analytical procedures. The Kruskal-Wallis H test utilized for this study which indicated a statistically significant relationship which rejected the null hypotheses of all four research questions. A second test was then performed, Mann Whitney U test, to determine where the significance of the hypotheses lied. Findings revealed that overall there is a low level of involvement of school social workers in the 504-Plan process of 64.8%. Twenty-nine and a third percent reported a moderate level of involvement. There was a low to moderate level of administrative culture, moderate level of collaboration, training and knowledge among the school social workers.

Service Animals In Higher Education: A Legal And Qualitative Exploration On The Impact Of Legislation And Policy

<p>  </p> <p>There is a deficiency in scholarly research on higher education service animal policy that has created definitive gaps in how disability service office (DSO) directors approach policy development and how higher education institutions (HEIs) ensure access for service animal handlers. Through a three-paper model, this dissertation addressed the intersection between federal and state civil rights legislation and the leadership qualities needed in developing higher education service animal policies. The first academic law review paper, titled “Service Animals in the Higher Education Environment: How the Law Guides Institutions in Supporting Disabled Student Handlers” laid a foundation for higher education service animal policy through a review of the Americans with Disabilities Act of 1990, Section 504 of the Rehabilitation Act of 1973, and the Fair Housing Act of 1968, which is federal civil rights legislation that grants protections and access for students with disabilities using service animals in higher education. The second academic law review paper, titled “State Legislation Regarding Service Animals: Informing Big Ten Higher Education Disability Policy” provided a comprehensive overview of six Midwest state’s service animal legislation and the legal application to higher education policy. The third paper is a qualitative research study, titled “A Big Ten Leadership Approach to Service Animal Policy Development in Higher Education” that explored how Big Ten Academic Alliance HEI DSO directors lead when developing institutional policy related to service animals.</p>
