Entrapment in Florida

Chanoine, Jean-Marc 01 January 2007 (has links)
Since the acknowledgement of the entrapment defense by the Supreme Court in the case of Sorrells v. United States 287 U.S. 435 (1932) there have been discussions on how it should be applied. There are two schools of thought for the application of the entrapment defense. One is the objective test and the other is the subjective test for entrapment. The subjective test focuses on the defendant's predisposition while the objective test focuses on the activity of the government. The federal courts and thirty eight states use the subjective test for entrapment. Florida is one of the states that use the subjective test for entrapment. The majority of this study is focused on the history and application of the entrapment defense, with a focus on the state of Florida. The study will aim to examine the ramifications of applying a subjective test for entrapment. Furthermore, this study will shed some light on problems with the way the entrapment defense is applied in Florida. This study has led to new ideas about how and why a new test for entrapment should be embraced by the courts in Florida.

Absoliutūs sprendimo negaliojimo pagrindai / Absolute bases of nullity judgement

Bričkutė, Rima 09 March 2006 (has links)
Hearing a civil case court must ensure due application not only of material, but also of procedural rules of law. The infringements of civil procedure were already defined in the procedural law of 1964 in Lithuania. They always used to determine the absolute nullity of legal proceedings and decreed judgement. Currently these procedural breaches are regulated in final enumeration of the second and third parts of 329 article of valid civil procedure Lithuanian code.

Has the pendulum swung too far? a legal evaluation of Florida's child abuse and neglect registry

Debler, Julianna 01 August 2012 (has links)
Over the past several years, increasing public emphasis on preventing child maltreatment has resulted in substantial changes to Florida's child abuse and neglect central registry. Many of these recent changes, aimed at preventing child maltreatment, have resulted in over one million false, unsubstantiated, and inconclusive reports of child abuse and neglect within the last decade. While the information held in reports may be useful for identifying and preventing potential child abuse or neglect, due process concerns have been raised with regards to the process of placing a person's name in a report without providing a hearing for challenging or removing inaccurate information. Focusing on Florida law, this research concentrates on: 1) the child maltreatment reporting process, 2) the procedures for maintaining reports, and 3) the accessibility of these reports in order to determine whether due process constitutional rights are protected under Florida's child abuse and neglect reporting laws. The intent of this thesis is to analyze the occurrence of unsubstantiated cases of child maltreatment, incidences of false reporting, and legal remedies available for those wrongfully accused of abusing or neglecting a child. Through the analysis of case law, federal and state statutes, available statistics, child abuse resources, and personal interviews with members of the Florida Legislature, evidence shows that due process constitutional rights are not protected under Florida's child abuse and neglect reporting laws. By raising awareness of the areas of child protection that require legal re-evaluation, this thesis aims to discover the balance between protecting children from harm and protecting adults from the severe ramifications resulting from false and improper allegations of child abuse and neglect.

O efeito rescisório do recurso de revista e o seu cabimento para que o tribunal superior do trabalho atenda sua função de instância extraordinária com base nos princípios constitucionais do processo

No. of bitstreams: 1 Carlos Augusto Marcondes de Oliveira Monteiro.pdf: 1850422 bytes, checksum: 0aa420a4caf4e09cb3c47d14b2cab9e3 (MD5) Previous issue date: 2015-10-29 / This works derives from the certainty that judicial reviews are the main cause for the delays in lawsuits, specially at the Labor Courts, in which the plaintiff or the defendant are sometimes forced to waive their rights due to such lawsuits delays. It shall discuss alternatives, in the Extraodinary Review Procedure to adjust it to the constitutional procedural principles, since in practical terms one can verify 3 judicials instances, while we maintain that the Superior Labor Court should be restricted to its role as an extraordinary instance. This is not possible when one can not distinguish the effects of an Ordinary Review from that of the Extraordinary Review. The Extraordinary Review is subject to the competence of the panels of the Superior Labor Court and applicable to review the rulings of the Regional Labor Courts on Ondinary Reviews of individual claims whenever the requirements of CLT's article 896 are present. The limitation of the applicability of the Extraordinary Review is not enough to grant TST the status of a true Extraordinary Review Court. The scope of this work is to establish the exact function of the Superior Labor Court and its efectiveness, based upon the constitutional procedural principles, specially the due process of the law and the reasonable procedural length, which comprises the effectiveness and fast-track of the procedure by analysing the effects of both Ordinary and Extraordinary Reviews / Este trabalho tem origem na crença de que os recursos são os principais responsáveis pela morosidade dos processos, mormente na justiça do trabalho, onde a parte se vê obrigada, muitas vezes, a abrir mão de seus direitos em razão da demora judicial na solução do processo.
