Sutarčių teisės reikšmė elektroninėje komercijoje / Meaning of Cantract Law in Electronic Commerce

The present Master’s Work “Importance of Contract Law in Electronic Commerce” explores legal regulations of electronic commerce in comparison to traditional legal regulation in Lithuania and foreign countries. Comparative analysis is focused on the significance of contract law in regulation of legal terms in electronic space. Comparative analysis of legal regulation of contract law and electronic commerce is carried out by the following aspects: concepts of contract and electronic transaction, principles and sources of contract and electronic commerce law, requirements for the validity of contract and electronic transaction, and types of contracts and electronic transactions. To explore certain features of the content of electronic transaction, several contracts on electronic services from four banks operating in Lithuania and from a few banks operating in the United States of America, Ireland, Australia and Russia were chosen to analyze. Contracts mentioned above were examined looking into legal meaning of and differences in user’s identification in electronic banking services, and regulation of civil responsibility of parties of the contract on electronic banking services. Having analyzed contracts mentioned above it is stated that user’s identification in electronic banking services corresponds to user’s signature in the sphere of electronic services, because appropriate registration of identification tools authorizes a person.
