Šiame darbe analizuojami pasirinkti elektroninių sutarčių sudarymo probleminiai aspektai bei ieškoma galimų jų sprendimo būdų. Nagrinėjami elektroninės sutarties šalių tapatybės nustatymo, elektroninės sutarties sudarymo momento ir vietos, elektroninės sutarties sąlygų pateikimo, elektroninės sutarties formos įrodomosios galios, elektroninio parašo sampratos, elektroninėms sutartims taikytinos teisės ir teismingumo klausimai. Ieškant sprendimo būdų šiems probleminiams aspektams atsižvelgiama į atitinkamas tarptautines tendencijas, tarptautinių bei nacionalinių teisės aktų nustatytą reglamentavimą bei kai kurių užsienio šalių atitinkamą patirtį. Analizuojant pasirinktus elektroninių sutarčių sudarymo probleminius aspektus lyginamuoju aspektu, siekiama atskleisti tų valstybių reguliavimą, kuriose jis labiausiai skiriasi nuo Lietuvoje galiojančių teisės normų. Taip išryškinamas elektroninių ryšių naudojimo sudarant sutartis problemiškumas tais atvejais, kai sudaromos sutartys su tarptautiniu elementu ir sutarčiai taikoma ne Lietuvos teisė. Išnagrinėjus pasirinktus probleminius aspektus, pateikiami pasiūlymai dėl jų sprendimo. / Chosen problematic aspects of concluding electronic agreements are analyzed in this paper, at the same time searching for the possible solutions of the problems concerned. The identity of parties of electronic contracts, time and place of concluding electronic contract, incorporating terms of electronic contract in different ways, evidential value of electronic contracts, the concept of electronic signature, applicable law and jurisdiction of electronic contracts are discussed. The relevant international trends, international and national acts of law and experience of some foreign countries are taken into account when searching for the possible solutions of these problematic aspects. When comparatively analyzing the chosen problematic aspects of concluding electronic contracts, it is aimed to reveal the regulation of those countries, where the relevant rules differ the most in comparison to the legal rules that are in force in Lithuania. This way the problem of different regulation is highlighted in cases when electronic means are used to conclude a contract and the relevant applicable law is not the one of Lithuania. After the analysis, suggested solutions of the problematic aspects are presented.

Elektroninių ryšių tinklų ir paslaugų reguliavimas Europos Sąjungoje yra svarbi kiekvienos šalies narės veiklos sritis. Daugelis mokslinių tyrimų bando analizuoti reguliavimo reikšmę, tikslus, principus, procesą, tačiau pasigendama darbų, kurie analizuotu reguliavimą ir jo poveikį tam tikriems faktoriams, apžvelgtu atskirų šalių narių pasiektus rezultatus elektroninių ryšių tinklų ir paslaugų reguliavimo srityje bei fiksuotu atsiradusias problemas. Šiame magistro baigiamajame darbe buvo pažvelgta į reguliavimą iš kitos perspektyvos pateikiant konkrečių šalių narių pavyzdžius. / The thesis is devoted to a challenging object of discussions about regulation of electronic communications networks and services in European Union: problems and perspectives. The aim of this thesis is to find out how regulation effects competition environment in selected member states fraught analysing factors, which identifies regulation impact on completion in the relevant market. In particular, the first chapter deals with understanding of ex ante and ex post regulation principles. It reviews the way, in which telecommunications and related services are regulated, and the new challenges created by technological and other developments such broadband and increasing use of internet-based technologies. After a brief statement of grounds of choosing this topic, its actuality and novelty in EU, the main part of the paper gives analysis of the factors, which indicates regulation impact on competition. The focus is on broadband market regulation in selected member states, as mobile services tend to present lesser problems of regulation. The second chapter analyses identified factors to find out and to understand regulation impact on competition at the same time facing out current regulatory framework problems. Magistro darbo tema yra „Lietuvos Respublikos Ryšių reguliavimo tarnyba ( kompetencija ir veiklos praktika )“. Magistro darbe analizuojama Lietuvos Respublikos Ryšių reguliavimo tarnyba, kaip viena iš viešojo administravimo subjektų, aptariama Tarnybos kompetencija ir veiklos praktika. Ryšių reguliavimo tarnyba ir kitos valstybės institucijos pagal Lietuvos Respublikos elektroninių ryšių įstatymo nustatytą kompetenciją reguliuoja elektroninių ryšių veiklą. Magistro darbo tema buvo pasirinkta neatsitiktinai. Kadangi elektroninių ryšių sektorius yra vienas dinamiškiausių, sparčiausiai besiplečiančių ekonomikos sektorių, kuriam būdinga vis didėjanti paslaugų teikėjų ir pačių paslaugų įvairovė, o Lietuvos Respublikos Ryšių reguliavimo tarnybos veikla yra reguliuoti Lietuvos informacijos ir ryšių sektorių, skatinti konkurenciją, užtikrinti vartotojų apsaugą bei atlikti įrenginių rinkos priežiūrą, todėl išties naudinga ir aktualu nagrinėti Ryšių reguliavimo tarnybos veiklą bei kompetenciją. Magistro darbe remiamasi svarbiausiais galiojančiais teisės aktais, kurie leidžia kuo išsamiau susipažinti su Ryšių reguliavimo tarnybos veikla ir atskleisti šios Tarnybos kompetenciją ir ypatumus. / Subject of master thesis is „Lithuanian Communications Regulatory Authority ( competences and Activity practice )“. The master thesis analyzes Lithuanian Communications Regulatory Authority as one of the entities of public administration; competences and activity practice of the Authority are discussed. Communications Regulatory Authority and other state institutions regulate activity of electronic communications under competences provided for in the Law on Electronic Communications of the Republic of Lithuania. The choice of subject for master thesis was not accidental. As the sector of electronic communications is one of the most dynamic and developing sectors of economy characterized by increasing variety of providers of services and services themselves and the activity of Lithuanian Communications Regulatory Authority is to regulate Lithuanian sector of information and communications, promote competition, ensure protection of consumers and perform market supervision of equipment, therefore it is in fact useful and purposeful to analyze activity and competences of Communications Regulatory Authority. Master thesis is based on the main legal acts in force which allow presentation of activity of Communications Regulatory Authority and revealing of competences and characteristics of this Authority.
