Deferral and discontinuance of the enforcement of judgment (execution) Carrying out the enforcement of the judgement represents a rather great impact on the obliged person's rights. Despite the fact that it is this obliged person who has caused such enforcement by not fulfilling voluntarily what has been imposed upon him by the enforceable decision, the law has to provide a certain standard of protection. Thus, in the Czech legal environment, it creates above all a deferral and discontinuance of the enforcement of judgement (execution). The main purpose of this thesis is to focus on these two institutes and also on costs in connection with them as they are a concern not only for the obliged person but for the entitled person as well. The thesis is divided into four chapters. While the first one presents general information about the enforcement of judgement and execution, its legal sources and difference between both concepts, the main part of the thesis lies in the three following chapters. Teismo sprendimų vykdymas yra baigiamoji civilinio proceso stadija, kurios metu siekiama įvykdyti teismo sprendimą, o isieskotojas ir skolininkas realiai patiria teisinį ir materialinį teismo sprendimo poveikį. Vykdant teismo sprendimus, svarbu griežtai laikytis įstatymo nustatytos priverstinės teismo sprendimų vykdymo tvarkos, kad nebūtų pažeidžiamos išieskotojo, skolininko bei trečiuju asmenų teisės ir teisėti interesai. 2003 m. sausio 1d. įsigaliojo naujieji vykdymo procesą reglamentuojantys įstatymai. Šiandien jau galime daryti pirmas išvadas, dėl naujos antstolių darbu reglamentuojančios tvarkos. Darbe aptariami turto realizavimo būdai ir aktualiausios jų taikymo problemos. Populiariausiu turto realizavimo vykdymo procese būdu yra turto pardavimas iš varžytiniu. Kiti būdai, kaip parodė autorės atliktas tyrimas yra praktiskai nenaudojami. / The implementation of court judgements is the final stage of civil procedure during which a court judgment comes into force. Further a plaintiff as well as a debtor faces juridical and real actions concerning the property. The implementation of court judgements requires following the order accurately. Lawful concerns and rights of a plaintiff, a debtor and a third person mustn’t be violated. New laws that regulate the enforcement of judgments came into force in 1 January 2003. The first inferences maybe drown today concerning the new order that regulates bailiff actions. The main issue discussed in this research is the ways of the realization of property and the problems arising in the process of realization. It is considered that the most popular means of realization of property is bidding in an auction. The other means, as it was demonstrated in this research, are not used in the real life.

The European Court of Human Rights - Enforcement of Judgement and its Comparison with the Procedure of the European Court of Justice of the European Union Abstract This thesis aims to provide an overview of the enforcement of judgments of the European Court of Human Rights, following the proceedings held before that court, without which enforcement proceedings cannot be opened. The thesis is focused both on the bodies of the Council of Europe, which play a key role in this process, as well as the national bodies and the measures adopted by them in accordance with the judgments of the European Court of Human Rights. The author also focuses on the mechanisms applied both for the implementation of the measures, and during the supervisory activities of the bodies of the Council of Europe. Within a comprehensive perspective, the author focuses on the execution of judgments of the European Court of Human Rights in three Central European countries, in order to compare both the anchoring of international human rights protection in the legal systems of these countries, and the systematics of the bodies involved in the judgment enforcement, demonstrating, on concrete cases, the practical steps during the enforcement of the ECHR judgments in the Czech Republic, Slovak Republic and Austria.
