A comparative analysis of the regulation of mergers in Canada and the European Union /

Merger review has gained in importance in both Canada and the European Union since the enactment of the Competition Act in 1986 and the Merger Regulation in 1989 respectively. The increase in international trade and the globalization of the world economy have forced both jurisdictions to reform the relevant provisions of their Competition law as concerns mergers in order to keep pace with these rapid changes. / The thesis offers a thorough description of the current merger review laws in both systems, and the proposed amendments under consideration in Canada and the EU. In the last chapter, the author compares both procedures and comes to the conclusion that, notwithstanding certain differences in objectives and perception, merger regulation in both systems seems to flow along the same lines. Canada does, however, hold a (lonely) special position as far as the 'efficiency defence' is concerned.

Energy and Environment - The “Coal and Steel” of the Union for the Mediterranean: How Sustainable Development can Ensure Democratization in the Middle East and North Africa

The main objective of this dissertation is to analyze the cooperation potential and institutional feasibility of a regional integration scheme in the Mediterranean region that would follow a similar pattern as the one proposed by the Schuman Declaration on May 9th 1950, establishing energy and environment (as the new “Coal and Steel”, the sectorial pillars of an ambitious Union for the Mediterranean. The argument defended in this dissertation is that both Europe and Mediterranean countries will face either environmental hazards or energy supply concerns in the coming years. First of all, the European Union is threatened today by a growing dependence on politically risky countries for its energy imports following the decrease of Norwegian reserves. Hence, Mediterranean countries and most of all oil-rich Libya and gas producer Algeria are among the priorities on the European Union foreign policy agenda. At the same time, Mediterranean countries suffer from growing environmental stresses that prevent their economies from reaching their potential while European Union could and should strongly invest in a Green new Deal together with its Mediterranean neighbors. As Mediterranean countries experience an historical and uncertain wave of democratization, political science theories have strongly underlined the importance of economic development to sustain democracy. A Union for the Mediterranean addressing the environmental concerns that hamper such a development would therefore be a key asset in ensuring stability and freedom in the region.

Since the signing of the Treaty of Paris in 1951, the European Union has emerged from a limited economic confederation to a supranational federal polity. There is, however, little work based in federal theory that seeks to understand the European Union as a federation nor the process by which that was achieved. Federal theory gives us two means of understanding federal government – federalism as techne and as telos. Federalism as techne informs us of the institutions and structures involved in federal governance. Federalism as telos provides the ideas, norms and values of federalism. Thus it is possible to speak of the federal idea (telos) and the institutions that embody it (techne).The process of federalisation of the European Union has seen the separation of these strands. Federal ideas do not necessarily lead to federal governance regimes; federal governance outcomes are not necessarily based on federal ideas. The European Union has adopted, over time, federal governance structures due to pragmatic concerns with institutional efficiency, bargain implementation, defection from agreement, and the equality of member states. The institutions created by the member states have themselves contributed to the federalisation process. Rarely has the federalisation process moved forward due to a belief in the value of federation itself.
