1 Abstrakt - Examination of a witness in civil proceedings The theme of this thesis is an examination of a witness in civil proceedings. The reason for choosing this theme was the internship at the District Court I had absolved, which allowed me to become more familiar with this topic and to know certain specifics of this means of evidence. Since the examination of a witness is one of the most frequent and used means of evidence, it deserves attention by itself. The thesis is composed of eight chapters. The first chapter deals with history of examination of a witness in the Czech lands, which was significantly influenced by old Roman civil procedure. Medieval civil proceedings in its early stages used in particular official witness provided in written form. In the course of time, the civil proceedings desisted from the official witness and oral testimonies prevailed. An interesting part of this chapter is an excursion into the heart of the oldest Czech legal documents and the view of the literal legislation of testimony. The aim of the following chapter is an overview of basic concepts and principles affecting the process of inquiry and evidence in general, which makes it easier to understand the following chapters, which are already dealing with the current legislation of examination of a witness. Designing Professional Development for Elementary School Teachers

Within a Northeast urban school, there is little empirical evidence to indicate the effectiveness of the district professional development (PD) program. Elementary teachers at the study site reported that they encountered problems accessing professional development programs applicable to their needs. The purpose of this case study was to examine teacher perceptions of district PD programs and to discover teacher perceptions of PD best practices. Knowles' adult learning theory provided a frame of reference for this study. The research questions assessed teachers' perceptions of the format, content, and process of professional development programs and examined how teachers applied new knowledge, concepts, and skills offered in professional development training. A case study design was used to gather focus group data from a critical case sample of 6 elementary teachers who were participating in PD training or who had participated in PD within the past 3 years. Emergent themes were identified from the data. Findings were developed and validated with member checking. The findings indicated that these 6 teachers desired more involvement in planning relevant PD, greater time allocated to collaborative activities, and more grade-level customized programming. Implications for positive social change include improved district professional development opportunities that align with best teaching practices for effective student instruction and increased student achievement.

This diploma work completely deals with problems of the evaluation by a teacher. In the introductory part there are described specifics of the school evaluation, its importance and sense. There is also mentioned a survey of many types, functions of the evaluation and methods, which are mostly being used for the pupils{\crq} evaluation at school. It also discusses an influence of the evaluation on the pupil. It summarizes principles and processes of the pupils{\crq} evaluation, which are established and obligatory for schools in the Czech Republic. It analyzes the problems of basic forms of the evaluation, which are mostly being used at our schools; those are the word evaluation and the classification by marks; and it also describes the portfolio that is a new alternative form of the evaluation. It concentrates on important aspects of pupil{\crq} evaluations, principles, those are important to know and they must be observed. It devotes to an importance of positive and negative evaluations and also to a smart question of the evaluation objectivity. It refers to mistakes which are important to avoid. It points out the importance of individual approach to pupils, especially to pupils with specific learning difficulties. It analyzes the evaluation problems of the pupils with learning disability and it refers to the mistakes that are necessary to remember in the evaluation of pupils with specific learning difficulties.
