Por definição, pode ser considerada como toda e qualquer conduta ou manipulação sexual entre adultos e crianças/adolescentes, com a finalidade precípua de estimular ou utilizar sexualmente estes últimos, para obtenção de prazer sexual, sem a necessidade de que haja expedientes violentos, ou força física, por parte do agressor. A ausência/insuficiência de investigações científicas abordando o fenômeno da violência sexual infanto-juvenil doméstica/intrafamiliar, notadamente com enfoque direcionado para a revelação, bem como a experiência profissional que acumulamos, atuando nas áreas criminal, civil e da infância e juventude compõem, entre outras, o quadro de justificativas para esta pesquisa. O objetivo foi caracterizar uma tipologia do fluxo de procedimentos e dos atos normativos (inquéritos policiais e/ou processos judiciais) adotados a partir da revelação do fato, até a finalização do processo de responsabilização do acusado/agressor, com vista a identificar que aspectos (supervalorizações, subjetivações, lacunas, omissões, etc., deliberados, ou não) podem ter sido decisivos para o desfecho dos casos.A pesquisa se deu numa cidade de aproximadamente trinta e cinco mil habitantes, do interior do Estado de São Paulo, abrangendo casos ocorridos no período compreendido entre os anos de 1992 e 2003, utilizando-se como fonte inquéritos policiais e processos arquivados no Fórum da Comarca. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: Child and juvenile sexual abuse has been for ages a complex phenomenon that trespasses the boundaries of our comprehension, occurring indiscriminately in our society regardless economic status, culture, race and gender. By definition, it can be considered any kind of behavior or sexual manipulation between adults and children / adolescents with the aim of stimulating and sexually using the latter, to obtain sexual satisfaction, without the use of violence or physical strength on the part of the perpetrator. The lack of scientific research covering the subject of child and juvenile sexual abuse within the family environment, focusing at the "revelation", as well as the professional experience acquired for the past years working in the criminal and civil areas, child and juvenile areas, among many other facts, justify this research. The aim of this study was to highlight a chain of procedures and the normative rulings (police investigation and/or court suits) adopted from the moment of the "revelation" of the fact itself until the finalization of the process of making the perpetrator responsible for his acts, aiming to identify what aspects ( overvaluations, subjectivities, blanks, omissions , either intentional or not) must have been decisive to the outcome of the cases. Data de trabalho que realizamos com adolescentes de rua, como voluntário, há mais de duas décadas, e mais recentemente nosso interesse em estudar este tema, decorre de mudanças significativas no comportamento de adolescentes e jovens de Altinópolis-SP, comunidade onde vivemos, a partir da ocorrência de fatos inéditos na cidade, como a infiltração vagarosa do uso de drogas no seio da família altinopolense, bem como pequenos furtos realizados por adolescentes e a formação de gangues de jovens que perambulam pela cidade. Sendo esta cidade estritamente agrícola e as ocorrências acima se concentrarem entre jovens pertencentes a famílias de trabalhadores rurais, esta pesquisa busca conhecer como se dão as interações afetivas desses trabalhadores no trabalho e na família e que conseqüências têm no comportamento de seus membros. Para tanto, nos apoiamos nos teóricos humanistas, estabelecendo uma nova perspectiva para ver este fenômeno subjetivo à observação empírica, coletando dados através de entrevistas não diretivas realizadas com os pais. Concluímos que as famílias, na sua maioria, estruturadas de forma não convencional, nem sempre conseguem contribuir para o desenvolvimento afetivo/emocional de seus filhos. A desestrutura da personalidade dos adultos que encabeçam algumas famílias, o uso de álcool por estes e a violência em casa, são fontes de marginalização dos adolescentes. A pesquisa mostrou ainda que famílias melhor estruturadas, demonstram sua afetividade através de recompensas materiais, se preocupam com a integração dos jovens no trabalho porém não têm um projeto que facilite o desenvolvimento afetivo/emocional de seus jovens. Postulamos que urge um plano político social que qualifique os pais na difícil tarefa de educar seus filhos. / Abstract: Our interest for the family is not recent. It dates of work that we accomplished with street adolescents, as volunteer, there is more than two decades, and more recently, our interest in studying this theme, elapse of significant changes in the adolescents' behavior and young of the community of Altinópolis-SP, where we lived, starting from the occurrence of unpublished facts in the city, as the slow infiltration of the use of drugs in the breast of the family of Altinópolis, as well as small thefts accomplished by adolescents and the formation of youths' gangs that wander for the city. Being strictly this city agricultural and the occurrences above concentrate itself among young belonging to rural workers' families, this research search to know as the those workers' affective interactions are given in the work and in the family and that consequences have in the behavior of its members. For so much, we leaned on in the theoretical humanists, establishing a new perspective to see this subjective phenomenon to the empiric observation, collecting data through non directive interviews accomplished with the parents. We ended that the families, in its structured of non conventional form majority, not always they get to contribute for the development affective/emotional of its children. The loss of structure of the adults' personality that they head some families, the use of alcohol for these and the violence at home, they are sources for the adolescents to turn themselves marginal. The research showed although families better structured, they demonstrate its affectivity through material rewards, they worry about the youths' integration in the work however they don't have a project that facilitates the development affective/emotional of its youths. We postulated that urges a social political plan that describes the parents in the difficult task as educating its children. / Mestre

É nela que a primeira socialização acontece; sua organização e relações são definidas histórica e socialmente; na sociedade capitalista, seu funcionamento é pautado na hierarquização etária e sexual e no binômio autoridade/amor, constituindo, inclusive situações de violência doméstica. Às famílias denunciadas por abusos físicos, psicológicos e/ou por atos negligentes é lançado um olhar e uma intervenção culpabilizadora, na maioria esmagadora dos casos. Conforme Martin-Baró (1997), tais famílias também são vítimas de toda uma conformação e estrutura social violenta, que lhe nega a possibilidade efetiva de se humanizar. O presente trabalho objetiva pesquisar os sentidos e significados da violência doméstica praticada por pais e/ou responsáveis contra crianças e adolescentes sob a perspectiva desses mesmos pais e/ou responsáveis, então envolvidos com o Conselho Tutelar de Bauru-SP. Como elementos teórico-metodológicos norteadores temos a Psicologia Social Sócio-Histórica, fundamentada no Materialismo Histórico e Dialético, e a Teoria da Vida Cotidiana de Agnes Heller. Foram realizadas entrevistas semi-estruturadas com cinco familiares abarcando os seguintes pontos: a compreensão e significação atribuídas aos motivos da procura e/ou encaminhamento ao Conselho Tutelar; a compreensão acerca de aspectos da história de vida com a família de origem; a vivência da realidade no cotidiano; e a compreensão, significação e subjetividade envolvida na educação dos filhos. A análise dos dados obtidos seguiu o método explicativo de Vigotski, no qual a fala, a palavra, o relato da família entrevistada constituem o ponto de partida. It is within the family that the first socialization process takes place; its organization and relationships are historically and socially defined; in the capitalistic society, its function is based on an age and sex hierarchy and on the authority/love binomial, producing for that very reason situations of domestic violence.The families accused of physical and psychological abuse and/or negligence are investigated and often found guilty of it. According to Martin-Baró (1997), such families are also victims of a violent constitution and social structure which denies them an effective chance of humanization. The dissertation at issue was carried out to investigate the domestic violence used by parents and/or their substitutes against children and teenagers according to the point-of-view of such parents and/or their substitutes involved with the Guardianship Council of Bauru - SP. The theoretical-methodological foundations of this research are found in the Socio-historical Social Psychology based on the Historical-Dialectic Materialism, and the Theory of Daily Life of Agnes Heller. Semi-structured interviews with five relatives were held comprising the following items: purport and meanings assigned to the reasons of searching for and/or guiding to the Guardianship Council; understanding of life history features within the family at issue; the grasp of reality in their daily lives; and the understanding, meaning and subjectivity involved in bringing up their children. The analysis of the data collected in the research followed the explanatory method outlined by Vigotski, in which their speech, the word, the report given by the interviewed families is the point of departure.
