Nesse período de discussões intelectuais sobre o Novo Mundo, muitos teólogos e juristas procuraram estabelecer diretrizes sobre as populações indígenas e o modo de governar da Coroa castelhana. No caso de Vitoria, líder e mestre catedrático da Universidade de Salamanca, as soluções para o problema das Indias foram pensadas pelas suas teses tomistas de colonização, tendo como base a prática do bom governo que administra a justiça para o bem comum dos “bárbaros” a fim de garanti-los na “civilização” cristã espanhola e “inseri-los” nos corpora da hierarquia universal ordenada moralmente pelas leis eterna, divina, natural e humana positiva, sendo as leis naturais mediadoras de toda a justiça e direito do bom governo. / The aim of this work is to understand how the scholastic-thomist doctrine was conceived by Spanish monarchy through the ideas defended by Dominican priest Francisco de Vitoria (1492-1546), through his work Relectio de Indis. In this period of intellectual discussions about the New World, many theologians and jurists sought to establish guidelines about the indigenous people and the way of governing the Castilian crown. In the case of Vitoria, leader and master professor of the Salamanca University, solutions to the Indias problem were thought their colonization thomist theses, based on the practice of good government that administer justice to the common well of the “heathens” in order to ensure them in Spanish christian “civilization” and insert them into the corpora of the universal hierarchy morally ordered by eternal, divine, natural and positive human laws, which the natural laws are mediators of all justice and right of good government.

It is an attempt to tell the moral evolution of history of war from the perspective of philosophy's history. The core of this work intends to show the philosophical and Christian influences for the moralization of war throughout the centuries until its peak in Francisco de Vitoria. For this, it is presented three distinguished authors from different eras who have constructed throughout their literature and war experiences their conception of just war: Cicero, Augustine of Hippo, and Thomas Aquinas. In this scenario, we will try to connect Cicero's natural Roman law, the adoption of Augustine's Christian principles, and the systematization of Aquinas's just war, all of which are present in the work of Francisco de Vitoria. From this frame of reference, we will investigate the meaning of State in Francisco de Vitoria, as well as explain how his ethics of war follows from such a conception. In the end, we will demonstrate through a detailed exposition the whole theoretical composition of the Victorian "Bellum Iustum" and its historical and philosophical importance for the inauguration of the international rights. / Esta disserta??o tem como objetivo apresentar a constru??o do conceito de guerra justa desde os prim?rdios da filosofia antiga at? o seu refinamento atrav?s da reformula??o moderna de Francisco de Vitoria. Trata-se de uma tentativa de contar a evolu??o moral da Hist?ria da Guerra sob a ?gide da Hist?ria da Filosofia. O eixo central deste trabalho pretende mostrar as influ?ncias filos?ficas e crist?s para a moraliza??o da guerra ao longo dos s?culos e at? o seu auge em Francisco de Vitoria. Para esse fim, foram selecionados tr?s autores distintos de diferentes ?pocas que constru?ram atrav?s da sua literatura e experi?ncia com a guerra a pr?pria ideia de guerra justa, s?o eles: C?cero, Agostinho de Hipona e Tom?s de Aquino. The Spanish masters : the 16th century presence in the Universal Declaration of Human Rights

The Universal Declaration of Human Rights (UDHR) was adopted in 1948 as a response to the atrocities of the Second World War. This analysis seeks to trace the influence of three Spanish masters of the 16th century, Las Casas, Vitoria and Suárez on the rights language and theory presented in the UDHR. Particular attention is given to the debates surrounding the Amerindians and the Spanish Conquest of the Americas, as well as burgeoning discussions of international relations in the emerging modern age. These debates provided the context in which the three theorists developed their understanding of rights and how the rule of the natural law was to be understood in the modern age. While the vision of the UDHR still remains to be achieved, the influence of the three masters is clearly recognized and much credit is due them for laying the foundation of modern human rights theory. / text

This diploma thesis deals with the theory of Francisco de Vitoria and his concept of suicide. The first part focuses on the life of the thinker himself and other historical contexts that have influenced his work. In the second part the sources and the basics of his legal theory are solved, taking special account of its rationalistic interpretation. The last part is more practical and focuses on the issue of justifying self-killing in the light of Vitoria's work.
