Formely, there was no express prevision of the term Itinerant Justice in federal Constitution, that only exists in the states by the force of administrative acts of Court of Justice Presidents. It was developed by EC n. 45, 9/12/04, that introduced, categorically, this expression inside the text of Federal Constitution for all cases without limit of the value in controversy. Itinerant Justice, in formal sense, central issue of this thesis, provides that judge go to the place of the demand in order to pronounce the decision out of forum or court. This proceeding was inspired and created by the author who is Itinerant Chief of Police / A Justiça Itinerante é um sistema moderno, social e democrático originário no Brasil, implicitamente previsto no artigo 94 da Lei n. 9.099/95 para os juizados especiais. Antes não havia previsão expressa na Constituição Federal do termo Justiça Itinerante, mas passou a existir nos estados-membros por atos administrativos baixados pelos presidentes dos Tribunais de Justiça. Tendo sido aprimorada pela Emenda Constitucional n. 45, de 09/12/2004, que trouxe esta expressão categórica no bojo da Constituição Federal para toda e qualquer matéria sem limites do valor da causa. Justiça Itinerante no seu sentido formal, objeto central desta tese, permite que o magistrado se desloque até o local da demanda para proferir a sentença ou acórdão fora do fórum ou tribunal.
