Logical extensions of the responsibility to protect

Thesis (MPhil (Philosophy))--University of Stellenbosch, 2009. / ENGLISH ABSTRACT: Are violent and non-violent mass atrocities morally different? According to the United Nations, they are. But why? The answer to this question is important as it in part determines our obligations to people living in other countries. This thesis seeks to determine if violent and non-violent mass atrocities are morally different and, if not, whether the latter should be included under the United Nations’ doctrine of the responsibility to protect. In order to do this, the thesis first examines the conditions under which sovereignty exists in order to understand when intervention can occur. It also analyzes just war theory to discern when military intervention to halt nonviolent mass atrocities is justified. Having established these two concepts, the thesis then presents three arguments for why non-violent mass atrocities are morally indistinguishable from violent ones and should also be included under the doctrine of the responsibility to protect. A discussion of the feasibility of implementing this extension and the long-term effects of these types of interventions follows. Finally, the thesis contains three case studies in order to apply the arguments presented earlier. / AFRIKAANSE OPSOMMING: Is daar ‘n morele verskil tussen gewelddadige en nie-gewelddadige gruweldade? Volgens die Verenigde Nasies is daar so ‘n verskil, maar hoekom? Die antwoord tot hierdie vraag is deels belangrik omdat dit ons verantwoordelikhede tot mense in ander lande bepaal. In hierdie tesis word daar gepoog om te bepaal of daar so ‘n verskil tussen gewelddadige en nie-gewelddadige gruweldade is, en, indien nie, of nie-gewelddadige gruweldade ook moet tel onder die Verenige Nasies se verantwoordelikheid om te beskerm. Die tesis poog eerstens om die kondisies vir soewereiniteit te bepaal ten einde te probeer verstaan wanneer ‘n intervensie moreel regverdigbaar is. Dit analiseer ook die teorie van geregverdigde oorlogvoering ten einde te bepaal wanneer militêre inmenging om nie-gewelddadige gruweldade stop te sit geregverdig is. Na hierdie twee konsepte ondersoek is word daar drie argumente verskaf om aan te toon dat nie-gewelddadige gruweldade nie moreel onderskeibaar is van gewelddadige gruweldade nie, en dus dat nie-gewelddadige gruweldade onder die verantwoordelikheid om te beskerm behoort te tel. Dit word gevolg deur ‘n bespreking van die praktiese haalbaarheid van die implementering van so ‘n uitbreiding van die verantwoordelikheid om te beskerm, asook ‘n bespreking van die langtermyn effekte van hierdie tipes intervensies. Die tesis eindig met drie gevallestudies ten einde die argumente wat reeds gemaak is toe te pas.

Diante de questionamentos empíricos e teóricos diante de crises humanitárias de grandes proporções, a comunidade internacional foi instigada a encontrar uma harmonização entre os conceitos de soberania e Direitos Humanos. Assim, o preceito da “Responsabilidade de Proteger” surgiu e ganhou relevância na agenda de segurança internacional e nos meios políticos e acadêmicos. O objeto desta dissertação, portanto, configura-se para além de uma ideia teórica e normativa, operando concretamente no ambiente internacional através das intervenções humanitárias. Desta forma, questiona-se em que medida a sub-agenda da “Responsabilidade de Proteger” reflete as relações geopolíticas entre o Norte e o Sul Global, entre os anos 2005 e 2015. Compreendendo esta divisão Norte/Sul para além de aspectos somente geográficos e, considerando a complexidade do sistema internacional frente a classificações e divisões demonstrou-se que a “Responsabilidade de Proteger” trouxe pouca inovação prática ao cenário internacional e perpetua as assimetrias de poder entre o Norte e o Sul Global. / The end of the Cold War brought changes in the agenda of international security: flow of weapons North to the Global South, the emergence of the New Wars, the strengthening of human rights, increasing the number of formal democracies and a new type of interventionism. In the face of empirical and theoretical questions facing humanitarian crisis of major proportions, the international community was instigated to find a compromise between the concepts of sovereignty and human rights. Thus the precept of "Responsibility to Protect" emerged and gained relevance in the international security agenda and political and academic circles. The object of this paper therefore sets itself apart from a theoretical idea and rules, operating specifically in the international environment through humanitarian interventions. Thus, we question to what extent the sub-agenda of "Responsibility to Protect" reflects geopolitical relations between the North and the Global South, between 2005 and 2015. Understanding this North / South divide beyond only geographical aspects and considering the complexity of the international system against classifications and divisions demonstrated that the "Responsibility to Protect" brought little practical innovation to the international scene and perpetuates the power asymmetries between the North and the Global South

Setkávání se seniory jako příležitost pro učení žáků mladšího školního věku / Meetings with seniors as an opportunity to teach younger pupils

This Master Thesis deals with the problematics of meeting younger pupils with seniors. The theoretical part of this thesis is generally about intergenerational learning, as well about intergenerational learning in different environments and other connections. I am looking for an answer to the question of whether it is attractive for teachers organize meetings of pupils with seniors in their teaching, under what conditions they do so, what prevents teachers from organizing intergenerational learning if they do not. It also deals with the current changes in families and the importance of intergenerational meetings. Practical part of the thesis is divided into three parts. The first part is pre-research, based on that we learn topicality of the topic. The main goal of the thesis, which based on a questionnaire construction, is to know if teachers think that meeting of pupils and pensioners during classes is helpful for pupils. Partial goals are to find advantages and disadvantages of those meetings and possibile examples from practice. All the partial goals are accomplished. The last practical part is about action research. This research is based on two meetings of pupils and pensioners. During this session pupils and seniors discussed, compared their lifes, their plans, dreams and exchanged advices...

Toxisk kolonialism : uppfattningar om globalt ansvar, rättvisa och mänskligarättigheter i processen av en ändring av Baselkonventionen / E-waste colonial desposit : perceptions of global responsibility, justice and human rights in the process of amanding the Basel Convention

Purpose/Aim: The purpose of this study is to understand the meaning of global responsibility and toxicwaste control. The Basel Convention is the UN's international regulations on the import, export andtransport of hazardous waste. According to the Basel Convention, the export of electronic waste todeveloping countries is fully legal if the recipient country has given approval in writing. Is there a linkbetween toxic colonialism, global responsibility, justice and human rights?Material/Method: A qualitative case study of what delegates from three African countries think abouttoxic colonialism and global responsibility.Main results: The essay gives an explanation of the concept of toxic colonialism in relation to the BaselConvention and the Ban Amendment, from three African UN delegates, furthermore an analysis of theimportance it can have on global responsibility, justice and views on human rights.The essay results show that the Ban Amendment of the Basel Convention is in line with Rawl'sdifference principle and the principle of freedom and would contribute to increased justice on electronicwaste coding if the amendment goes through and is used in symbiosis with human rights: UDHRArticle 25 and ICESCR Article 12.1-2.
