Based on this perspective, the present study aims to investigate what are the criteria adopted by police officers in the conduct of investigations and in the production of evidence during the investigation and to what extent these criteria imply social selectivity. It is also intended to investigate the implications that the police model adopted in Brazil infers on the criminal selectivity. The discussion is based on the concepts of labeling, tagging, stigma and criminal subjection, articulated in order to allow the reflection on the possible influences of the perceptions of police officers in conducting the investigations. The methodological path chosen was the conduction of a case study in a district police station in the city of Porto Alegre, accomplished through the application of semi-structured open-ended interviews, based on a previous script, and through ethnographic observation. This field was selected with the intention of carrying out a qualitative research to better understand how, in the police practice, are the interactions and the decision making processes that modulate the legal application to a factual reality. The results obtained point out that the choices are made directly by the police officers, without a clear and objective institutional guideline, which provides a dirigisme in the investigations, based on the perceptions of each agent, as well as by a police habitus. This habitus is structured mainly on historical and institutional issues related to chauvinism, racism, social and urban segregation and a legal culture based on dissent and punishment. We also observed that the registry and bureaucratic model adopted by the police in Brazil directly influences the increase of agents? discretion, giving rise to arbitrary decisions. There is little control over these actions, which generates an unequal application of criminal law, going against what is expected of a democratic rule of law. / Considerando que o sistema de justi?a criminal ? marcado pela seletividade voltada ?s camadas mais vulner?veis da sociedade e que, desde a Constitui??o de 1988, nossas pol?cias nunca sofreram reformas substanciais, preservando em seu interior caracter?sticas autorit?rias e elitistas, o presente estudo objetiva investigar quais s?o os crit?rios adotados pelas e pelos policiais na condu??o dos inqu?ritos e na produ??o de provas durante a investiga??o e em que medida esses crit?rios implicam em uma seletividade social. Tamb?m pretende investigar quais as implica??es que o modelo policial adotado pelo Brasil infere sobre a seletividade penal. A discuss?o tem como base os conceitos de rotula??o, etiquetamento, estigma e sujei??o criminal, articulados no intuito de permitir a reflex?o sobre as poss?veis influ?ncias das percep??es das e dos agentes policiais na condu??o das investiga??es. O caminho metodol?gico adotado foi o da realiza??o de estudo de caso concretizado por meio de aplica??o de entrevistas abertas, semiestruturadas, partindo de um roteiro pr?vio, e de observa??o etnogr?fica. O que se pretendeu com esse campo foi a realiza??o de uma pesquisa qualitativa para melhor compreender como se d?o, na pr?tica policial, as intera??es e as tomadas de decis?o que modulam a aplica??o legal a uma realidade f?tica. Os resultados obtidos trazem que as escolhas s?o realizadas diretamente pelas e pelos policiais sem uma diretriz institucional clara e objetiva, o que proporciona um dirigismo nas investiga??es, pautado pelas percep??es de cada agente, bem como por um habitus policial. Esse habitus est? estruturado em quest?es hist?ricas e institucionais ligadas ao machismo, ao racismo, ? segrega??o social e urbana e a uma cultura jur?dica baseada no dissenso e na puni??o. Tamb?m se p?de observar que o modelo cartor?rio e burocr?tico de pol?cia adotado no Brasil influi diretamente no aumento da discricionariedade das e dos agentes, dando margem a decis?es arbitr?rias. H? pouco controle sobre essas a??es, o que gera uma aplica??o desigual da lei penal, indo de encontro ao que se espera de um estado democr?tico de direito.
