Občanskoprávní aspekty ochrany zdraví / Civil law aspects of health protection

The subject of this paper is the civil law aspects of health protection. The aim of the thesis is to analyse the relevant law concerning the topic and compare it to regulation suggested in the new civil code. Considering the breadth of the topic, the thesis does not deal with all aspects of this issue but just focuses on some of the most debatable questions. Not only the current law and related literature is considered, but a particular emphasis is also put on related case law. In some parts the paper also takes into consideration the fundamental masterpiece of European tort doctrine - Principles of European Tort Law (PETL). The thesis is composed of five chapters, each of them dealing with different aspects of the topic. Chapter One provides an outline of relevant Czech and international law. Chapter Two analyses the concept of right to health protection as a part of personality protection and deals with its object, content and subjects. Chapter three is devoted to the unlawful infringement of the right to health protection and its consequences. Chapter Four focuses on civil law responsibility for unlawful infringement and on the circumstances which are necessary for the responsibility for injury to health to arise and also on the subjects to this responsibilty. The diploma thesis deals with the issue of catering of employees, three selected workplaces, with regard to the job position, the way of meals and also the possible health problems related to the performance of their work. The aim of this diploma thesis is to find out whether there is an influence of the working environment on employees' meals, as well as how eating habits reflect their health status during working hours. The theoretical part deals with health issues, the Health 2020 program and also with procedures to protect and prevent disease. The practical part analyzes and evaluates the data obtained through the questionnaire survey among the three selected workplaces. It is clear from the questionnaire survey that the position affects not only the way of eating, but also the possible health problems. Analisou-se também de que modo se desenvolveram, desde sua origem no século XIX até o final do século XX, as principais tarefas dos órgãos do Serviço Sanitário do Estado, quais sejam: controle das localidades, habitações, ocupação e parcelamento do solo; controle do meio ambiente, da poluição do ar e das águas; fiscalização da alimentação pública, do fabrico e consumo de alimentos e bebidas; controle do exercício de profissões ligadas à saúde; normalização do funcionamento de serviços de assistência à saúde e conexos; controle de drogas e medicamentos; controle de produtos ligados à saúde e conexos; saneamento das fábricas, oficinas e saúde do trabalhador; notificação e supervisão de doenças infecto-contagiosas e, finalmente, ações de educação em saúde, que constituem atribuições e funções dessa atividade. Muitas das funções e tarefas desenvolvidas atualmente pelos serviços de Vigilância Sanitária vêm sendo realizadas desde a criação do Serviço Sanitário do Estado, em 1892, ou mesmo anteriormente, apesar da Vigilância Sanitária, enquanto atividade sistematizada e organizada, ser algo recente no Estado de São Paulo, pois o CVS- Centro de Vigilância Sanitária foi criado em 1986. Sendo assim, apresenta-se aqui a evolução histórica dessa atividade sob a responsabilidade do Governo do Estado de São Paulo, apontando fatos relevantes no seu desenvolvimento, bem como os organogramas correspondentes a várias estruturas organizacionais. São analisadas também, segundo as atribuições mencionadas anteriormente, as evoluções da legislação básica presente nos sete Códigos Sanitários Estaduais vigentes nesse período. / This paper analyze the evolution of the practice on health protection in São Paulo State , developed by State Service of Public Health, also studies the evolution of these services known as health surveillance. It also analyzes how the main duties from States Services of Surveillance, such as : home place control, habitation, occupation and parcel ground; environmental control, including air and water pollution; control of food and drink production; control of professional practice related to health; health care services standardization; drugs and medicines control; health products correlated control ; working and occupational health; infectious diseases notification; and finally health education. These are functions and attributions of this activities, that developed from the beginning of the XIX Century until the end of the XX Century. Many of the functions and practices developed nowadays by the health surveillance services have been done since the origin of the State Sanitary Service in 1892, or even before, even though the health surveillance, while organized and systematized activity, is new in São Paulo State, because 'CVS – Centro de Vigilancia Sanitaria' was created in 1986. On this sense, it´s presented here, the historical evolution of this activity under de responsibility of the São Paulo State Government pointing relevant facts in its development, as well as the correspondent organization chart of the many organizational structure. Its also analyses, according to attributions in the seventy State Code Health Law valid in this period.

Hygienická problematika faktorů hluk, prach a vibrace na pracovišti broušení odlitků / Hygiene Factors Issues of Noise, Dust and Vibrations in the Workplace Grinding Castings

My diploma work is focusing on the health problems of selected factors in the working enviroment of grinding the metal castings. There are high-risk factors, which are harmful to worker´s health, especially physical stress, noise, dust and vibrations, which are passed on hands. The employer is under the obligation to take precautions to carry on worker´s health, in consideration of exceed the health limits. The aim of this diploma work was setting the efficiency of precautions to health protection in work enviroment. The situation had been monitoring in a company in the South Bohemia over ten years. There were used results of factor´s precautions (noise, dust, vibrations) in work enviroment, where workers grind the metal castings by hand grinders. The monitoring ensemble was created by employess in a company, which makes the metal castings by hand grinders in its work enviroment. To data collecting were used the following methods: non-aligned observation, conversation with the chief of the company, studying of positive law and technical literature incl. test codes of the health institute (department Ceske Budejovice). The data of the test codes were processed by the secundary analysis and summarized to tables and graphs. Within qualitative analysis I determinated four research questions, which were answered gradually in my work: 1)Which precautions are carry out by employers to particular factors of employee´s health protection? 2)What is the factor´ s efficiency? 3)What impact do the precautions have on results of factor´s measuring? 4)Which precautions can I recommend on the grounds of the evalutation of the work enviroment? Both means of collective and individual protection belong to the precautions of worker´s health protection today. The technical, technologiacal and organisational precautions are included to collective protections. The individual precautions are focusing especially on employees and offer the substitute solutions. All precautions are specific to individual factors. I found out, that all precautions, which are used by the employers in work enviroment of metal casting, are effective. Especially we can talk about the precautions to protection of employee´s health against excessive dust (instalation of air ventilation with strong effect), which caused the exceed of dust concetration in work enviroment of grinding. Finally I can say, that this branch of metal casting has been connecting with certain high-risk factors all the time. Although all the protective precautions has been realized, the health limits given for noise, vibrations passed on hands and dust are still exceed. For this reason it´s very important to regularly inform the workers of high-risk factors, which they could meet in their work enviroment of cast grinding.

The thesis dealing with the occupational safety and health protection for acute care department nurses had three goals. The first goal was to map the specifics of health protection and safety at work for acute care department nurses. The second goal was to ascertain the most frequent occurrence of failures to adhere to the H&S rules. The third goal was to find out whether the duration of the practice and the level of education affect the H&S knowledge among nurses. Qualitative as well as quantitative research was applied to the ascertainment of the answers to the prepared questions. When the two kinds of research had been set it was necessary to set research questions and hypotheses. The method of hidden observation of nurses working at an anaesthesiology and resuscitation department was applied within the qualitative research. Ten nurses were observed. The method of questionnaire survey sent through the Internet was used to obtain the quantitative results. Surprisingly, two hundred and forty respondents replied to the questionnaire. To confirm the hypotheses a statistical processing was carried out, which confirmed or refuted the significance level of the individual questions and replies. The asset of this work and of a part of its results is a finding that nurses from an anaesthesiology and resuscitation department are aware of the necessity of the adherence to the H&S rules and instructions, which protects their health, but they fail to do it in practice. This is why the results of this thesis might stimulate further solutions. The thesis also contains a proposal how to deal with complicated situations. All solutions are however completely individual and depend on the internal and further rules set by the hospital management.

Diploma thesis is focused on occupational risk management, safety and health protection at work. The aim of my diploma thesis was to review level of OHSAS 18001 requirement filfilment in a particular organisation. Inseparabily part of standard requirements is observing the state legislation. Since the firm chosen carry on business in SR, the teoretical part of the thesis compares czech and slovak state legislation with purpose of illustrating differences between czech and slovak legislative environment in field of occupational safety and health protection. Practical part of the thesis contains review of OHSAS 18001 requirements fulfilment in organization and evaluates the possibility of succesful certification.

For main structure has been processed time schedule of the construction, single item budget, machine configuration design, drawing of building site, coordination situation of the building with connection to the infrastructure, safety and health protection during work on building site. Part of the thesis is processing study of main construction technological parts. Diploma thesis in technological prescript focuses on implementation of floor structure with cast epoxy walking surface. There has been elaborated testing and quality plan of this technological part. Additional chapter approximates built-in technology – cooling ceiling structure. For elaboration of this diploma thesis were used programs AutoCAD, CONTEC, BuildPowerS, Microsoft Excel, Microsoft Word.

Then follows description of the Labour Inspection authorities, which are the State Labour Inspectorate and the Regional inspectorates. The area of safety and health protection in the construction industry, concept of Safe enterprise and "Švarc" systém are processed separately. Finally, analysis of the Labour Inspection activities in construction between 2006 - 2011 is performed, with a detailed focus on the year 2011.

Fluid dynamic vibration absorber for cabin suspension

Truck drivers spend all day moving goods. They are exposed to vibrations every time they drive. Modern cabin suspension and an air-suspended seat already offer a high level of comfort. This, however, is designed for vertical dynamics and you can observe the cab of a truck performs large pitching vibrations during acceleration. These are examined here. A pitch model of the cabin is set up for this purpose. On the basis of this model it is examined which reduction of the vibration can be achieved by the use of a hydraulically translated vibration absorber. The advantage of this absorber is the use of the hydraulic transmission to reduce the heavy mass at high absorber inertia. 4 kg of fluid mass act as 131 kg absorber mass reducing vibrations by more than 10%. The conventional vibration absorber is inacceptable due to the additional load. The investigation based on VDI 2057 Part 1 shows that driving comfort can be increased.
