El objetivo del presente trabajo es analizar si el Perú está vulnerando los derechos fundamentales de las niñas y los niños insertos en familias homoparentales. Si es que existe un trato diferenciado al momento de proteger a las familias y sus miembros, y como este hecho afecta directamente a los más vulnerables: las niñas y los niños. Al momento de evaluar los casos, damos cuenta que ningún operador estatal ha recogido los estándares de derechos humanos, ni ha tomado en cuenta el interés superior del niño, el cual es un principio primordial en todo el sistema universal. De manera que, al no poner este tema en agenda, no hay un compromiso por realizar políticas, ni iniciativas legislativas que garanticen derechos en igualdad. Aunado a ello, los operadores administrativos, así como los jueces, no están cumpliendo con realizar el debido control convencional. Y como cómplices de dichos actos tenemos a tos los demás ciudadanos, que en la convivencia social, menoscaban derechos. Concluimos que los prejuicios de una sociedad cisgénero- heteronormativa, opresiona al colectivo LGBTI, pero dicha situación se agrava cuando los miembros del colectivo deciden formar una familia. Debido a que los más afectados siempre serán las niñas y los chicos, y en algunos casos desde su nacimiento. / The main objective of this legal job is to analyze whether Perú is violating the fundamental rights of the children inserted in homoparental families. If there is a differential treatment when our country is protecting families ad their members, and how this fact affects directly to the most vulnerable: the children. At the time of evaluating the cases, we realice that no one state operator has collected the human rights standards, no has taken into account the best interests of the child, wich is a fundamental principle in the entire universal system. So, no putting this issue on the state diary, there isn ́t a commitment to carry out policies, or legative initiatives that guarantee equal rights. In addition to this, the administrative operators, as well as the judges, are not complying with the proper conventional control. And as accomplices of these acts, we have all the other citizens, who in social coexistence, undermine rights. We conclude that the prejudices of a cisgender- heteronormative society oppress the LGBTI, but this situation turns worse, when the members of that collective decide to start a familia. Because the most affected, will always, the children; and in some cases from their births. / Trabajo académico
