In this thesis, the author studies the ethical and legal aspects of research conducted on stored tissue samples of deceased persons in North America. / The first part of this thesis presents an overview of what constitutes human tissues and how are they used in research. The author describes the process in which human tissues are acquired and stored by health facilities, their utility for scientific research, and currently used techniques. / The second part is dedicated to the analysis of the current normative framework associated with research involving human tissue samples in North America. The author underlines the presence of two different normative regimes depending on whether the human tissues were removed before or after death. Finally, the author examines international documents in order to evaluate whether or not they can provide guidance to North American national legislation. / The third part evaluates the normative limitations associated with the use of stored tissue samples of deceased persons for research. The author considers that these limitations are related to the presence of conflicting interests, the difficulties in establishing rights over human tissues, the difficulties of establishing the rights of the dead, and the limitations of the theory of informed consent with regards to stored tissue samples. / The last part of this thesis suggests that stored human tissues should be interpreted as if they were part of an individual's medical record. After presenting some of the philosophical arguments in favour of such an interpretation, the author underlines the presence of legal precedents supporting the "tissue as information" model. The author finally examines the legal implications and the potential limitations of this proposal.

Comentadores de várias tendências se dividem quanto a como situar o pensamento político do Doutor de Aquino frente à religião. Seria possível fazer uma interpretação naturalista da política em Tomás de Aquino? Ou o seu pensamento político se encontra influenciado por uma esfera superior necessária para que se possa compreender em profundidade o que o autor propõe? No intuito de se posicionar sobre esse antigo debate, pretendemos pesquisar o pensamento de Tomás para buscar entender o conceito de lei, e daí os limites para a lei humana e alguma possível influência do elemento religioso. Para lançar luz sobre o problema, analisaremos as questões sobre o conceito de lei, a lei eterna, a lei natural e a lei humana presentes na Primeira Parte da Segunda Parte da Suma de Teologia, em comparação com outros escritos de Tomás, notadamente a Primeira Parte da Suma de Teologia, a Suma Contra os Gentios e o opúsculo De Regno. Os comentadores divergem a respeito e a pesquisa busca, a partir da releitura das obras de Tomás e dos principais comentadores do século XX e XXI, uma clara tomada de posição clara a respeito, concluindo pela dependência do pensamento político de Tomás de Aquino de uma ordem superior à esfera humana. / Commentators of several trends split themselves as how to situate the political thought of Doctor Aquinas regarding religion. Would it be possible to do a naturalistic interpretation of politics in Thomas Aquinas? Or is his political thought under the influence of a superior sphere necessary to understand in depth what the author proposes? Aiming to set a position about this ancient debate, we attempt to research the thought of Thomas in order to search understanding of the concept of law, and so forth the limits for the human law and any possible influence of the religious element. To bring light on this matter, we will analyse the questions about the concept of law, the eternal law, the natural law and the human law which are enclosed in the First Part of the Second Part of The Summa Theologica, in comparison with the other writings of Thomas, mainly the First Part of the Summa Theologica, the Summa Contra Gentiles and the opuscule De Regno. The commentators disagree in this respect and the research aims, through the carefull reading of the works of Thomas and of the main commentators of the XX and XXI centuries, a clear view in this respect, concluding for the dependency of the political thought of Thomas Aquinas of a superior order above the human sphere.

Assumptions about the structure and shape of the ’proper’ or ’traditional’ family - as a heterosexual two-parent unit with biological children - and its claim to naturalness, are embedded in policies related to reproductive technologies and family formation. O plano deste estudo se caracteriza por entender a relação entre lei divina e lei humana concebida por Agostinho no L. I de O Live-Arbítrio e no L. XIX de A Cidade de Deus. Assim almejamos analisar primeiramente a relação entra as duas leis no L. I do diálogo e posteriormente confrontá-la com a análise retirada da Cidade de Deus, verificando as possíveis implicações de uma reformulação no entendimento da política para Agostinho. Desse modo, pretendemos evidenciar como Agostinho reformulou seu pensamento sobre as duas leis e mostrar as conseqüências de tal mudança em noções como justiça, paz, Estado, guerra e escravidão / The purpose of this study is defined by understanding the relationship between divine law and human law conceived by Augustine in On Free Choice of the Will, book I, and The City of God, book XIX. Thus, we aim first to analyse the relation among the two laws in the dialogue, then comparing it with the analysis from The City of God by checking possible implications of a reformulation in the understanding of politics for Augustine. As such, we intend to show how Augustine reformulated his thought about the two laws and the consequences of such a change in notions as justice, peace, State, war and slavery

Surrogate motherhood: legal issues

Surrogate motherhood is one of the most controversial issues of our time. The increase in infertility and the shortage of babies available for adoption, have provided an incentive for research in assisted reproductive techniques. Rapid advances in this field have caught the legal system unprepared in many ways. The object of this thesis is to investigate the legal aspects of surrogate motherhood. A background is provided by an in depth examination and analysis of the practice of surrogacy in foreign jurisdictions. For this purpose a selection of interdisciplinary, medical and juridical reports, court decisions and legislation is analysed. The surrogacy agreement is affected by principles of both public and private law. As the agreement is based on consensus between the parties, Roman Law principles of the law of obligations, provided a valuable point of departure in establishing a theoretical basis for the classification of surrogacy agreements. Having determined the nature of the agreement, the content is analysed with due regard to statutory and other relevant considerations, such as the boni mores, and submissions made regarding the enforceability and legality of such agreements. A surrogate mother agreement model is proposed and analysed in the light of existing South African law. The various ways in which surrogacy contracts may be breached are examined and recommendations put forward regarding possible delictual or contractual remedies. The legal relationship between the surrogate child and its gestational (birth) mother and her husband on the one hand and the intended parents on the other is investigated. The role of the courts in custody issues - related to surrogacy - is examined and recommendations put forward as to how they may be included in the process by determining the best interest of the surrogate child prior to artificial insemination. The civil and criminal liability of medical practitioners involved in assisted reproductive technology and specifically surrogacy are expounded. Key issues in the practice of surrogate motherhood are interpreted in the light of existing statutory and common law principles. Recommendations are put forward on these issues and a bill proposed for the regulation of surrogate motherhood in South Africa. / Private Law / LLD
