Informed consent as a tool exercising right to health for migrants?

Spada, Stefania <1982> January 1900 (has links)
The thesis proposes a reflection on informed consent as tool exercising right to health for migrants. The national, European and international protection of the right to health for migrants, will be investigated through an anthropological reflection on the nature, the construction and the logic of universal rights; the aim of the research is to investigate any gap between legislation and policies protecting migrant health and the existence of structural barriers that prevent a full exercise of a fundamental right. The research hypothesis is based on the real performative capacity of informed consent, usually designed as a tool to ensure both full professionalism of the health care in informing the patient about the risks and benefits of a specific medical treatment and the respect of the principle of autonomy. through quantitative and qualitative analysis performed in a department of gynecology and obstetrics, the survey focused on informed consent in action, trying to grasp the specifics of doctor and patient migrant. The daily dynamics between health personnel and patients, the characteristics and limitations of the service of linguistic and cultural mediation, the practical actions of defensive medicine have been investigated by participant observation. In this sense, the theme of "informed consent", investigated interacting disciplines such as anthropology, bioethics, philosophy and sociology, has set both as reading lens privileged to understand the dynamics of relationships between health professionals and migrant population , still victims of structural inequalities, but also as a "potential trigger" for new ways of interpreting patient-physician relationship.

Modelli e strumenti di supporto alla scelta informata del paziente: un argine alla medicina difensiva / Patient's informed choice: skills and tools to prevent defensive medicine

Rizzo, Maria Livia <1985> 09 June 2015 (has links)
The exponential increase of medico-legal claims - originated in the USA in the sixties in such proportions as to talk of medical liability crisis, and developed in Italy since the mid-eighties - has led and continues to lead, together with other negative consequences, to the more frequent use of health care practices of defensive medicine, with very high costs to the NHS due to the overabundance of unnecessary treatments and hospitalizations, and worthless invasive diagnostic procedures, which generate emotional distress in patients. The cause of the increase in litigation is to be found largely in the doctor-patient relationship, especially with reference to the information that precedes the acquisition of the informed consent for clinical treatment. In Italy, the limits which mostly characterize the studies regarding informed consent derive mainly from the fact that they tend to focus solely on the written component of the same. The focus of informed consent, however, must be considered represented by a communication between healthcare and patient concerning a proposed treatment and its possible alternatives, to not subjecting the patient to any treatment, and the risks and benefits of each of these options. In such a context, the issue of communication between the physician and the patient is attracting interest because it is expected that it will lead to improvements in patient outcomes and to fewer malpractice claims. The increased attention to the doctor - patient relationship has highlighted the need to improve and enhance the communication skills of doctors, in a perspective in which the time dedicated to communication can be perceived by the professional as the core of the doctor-patient relationship, with a view to developing strategies to prevent the phenomena of defensive medicine.

The Concept of Autonomy in End-of-Life Decisions: Ethical and Legal Regulation regarding Advance Directives

Veshi, Denard <1988> January 1900 (has links)
In this thesis the concept of autonomy in end-of-life decisions is analyzed through ethical and legal comparative approaches. The definition of advance directives – living wills and the appointment of a legal proxy – is studied. In addition, Recommendation CM/Rec (2009) 11 and the “Guide on the decision-making process regarding medical treatment in end-of-life situations” is examined. Currently, end-of-life decisions are part of the exclusive competence of national parliaments. Thus, different parliaments have adopted different policies underpinned by different moral principles. What follows is an absence of a common European legal framework. National laws on advance directives in various Western European countries – such as Romance-speaking countries (Italy, France, Portugal, and Spain), English-speaking countries (Ireland and the United Kingdom of Great Britain and Northern Ireland), and German-speaking countries (Austria, Germany, and Switzerland) – are examined. This thesis seeks to analyse national norms governing advance directives by hypothesising the reasons for the lack of a common attitude towards end-of-life decisions. Particular attention is paid to the current Italian situation regarding end-of-life decisions since Italy is one of the few Western European countries that does not have a specific law governing end-of-life situations. Herein, the Italian bill no. 2350 “Provisions relating to therapeutic alliance, informed consent, and advance directives for treatments” – approved in different texts in 2009 by the Senate and in 2011 by the Chamber of Deputies – is criticized because its norms are considered controversial. Additionally, the judicial interpretation of amended Articles 404–413 of the Italian Civil Code is examined. The aim of the thesis is to identify the common European standards in end-of-life decisions. Moreover, similarities and differences between different policies will be pointed out. Furthermore, possible suggestions for modifying the Italian bill 2350 by taking the experience of other Western European countries into consideration will be made.

L'ambiene in comune. Etica ambientale beni comuni / The shared environment. Environmental Ethics and common goods

Visani, Jacopo <1982> 07 June 2016 (has links)
Vengono, quindi, proposte alcune possibili integrazioni. / This work wants to face an urgent and not postponable issue: the environmental emergency on Planet Earth. The topic is explored from an historical point of view, focusing on some philosophically considerable issues – as, for example, the connection between science and technology – and showing how a change of human behaviour is needed, especially regarding global warming. A taxonomy of the environmental ethics is described, dividing them in anthropocentric and anti-anthropocentric and considering the exception of Hans Jonas. Ethic has problems to face such a complex, global, and with widespread responsibility task which does not offer a sound ground for motivation as environmental protection. In order to exceed these limits, the attention is focused on the notion of common goods, which has encountered a large use over the last few years. This topic is firstly described under the perspective of the history of ideas. Then some proposals are critically examined as the one of Garret Hardin, Elinor Ostrom and some among the different line-ups of the Italian debate as the “benecomunisti”, the juridical and the ethic of care approach. Moreover the notion of commons is related in a dialogic way to other concepts such as common good, democracy and rights and a taxonomy of its uses is proposed diving them into: economical, juridical, ethical and social uses. Finally the different proposals of the commons and the one of their integrated approach are critically analysed regarding the help they can offer from an ethical and normative point of view to the task of environmental protection. Also the crisis/opportunity dialectic and topics from animal ethics are described. In conclusion, the common goods approach is considered not sufficient to face a global issue as environmental emergency because of its lack of a global perspective. Therefore some possible integrations are offered.

Toward An Optimal DRM Regulatory Model in China: An Analysis of the U.S, Europe and China

Xu, Cong <1988> January 1900 (has links)
In the scramble for an adjustable and effective copyright law mechanism that can successfully tackle the impediments created by the internet and other new technologies, China began exploring various legal reform models that are in alignment with international conventions and treaties and that is desirably relevant to the mounting demands of the developing Chinese socio cultural and economic setting. In the frantic search for an unassailable solution, China simply borrowed legislative approaches from developed societies, such as the U.S and the EU; China enacted a set of statutes, regulations, and judicial interpretations for the DRM regulatory model mainly through the domestic implementation of international obligations and legal transplant. The transplantation of the DRM model to advance the struggle of copyright protection in China seems somewhat futile owing to the daunting challenge of implementation which has been rather unsatisfactory. The unanticipated technological expansion that is marked by the advent and growth of internet and other groundbreaking innovations caught the legal system largely unprepared and has had many unintended ramifications on copyright laws creating many complications that jeopardizes the efficacy of the most comprehensive international copyright regulatory model. The transplantation and implementation of international copyright regulatory framework by China has been rendered leading to escalating concerns about borrowed laws from other jurisdictions. More than ever, there is an overwhelming need for careful evaluation and scrutiny of foreign regulatory model against the extent of its applicability and relevance in local context. Based on the comparative analysis and the research outcomes, This thesis tries to figure out Direct and indirect strategies for predicament in which China’s legal system has been trapped and also explores to sketch the outline of tentative DRM regulatory model in China to consider.

Responsabilità penale e automazione nell'E-Health / E-Health: Criminal Liability and Automation

Lagioia, Francesca <1985> January 1900 (has links)
This research thesis investigates all the issues related to the criminal liability that arise when highly automated and/or artificial intelligence systems are used in e-Health. This investigation has been conducted looking at the health system with a socio-technical point of view, paying specific attention to the human-machine interaction, the specific level of automation involved, and finally to concepts of error and risk management. Some topics over the others have been deeply examined, e.g. product liability for defective medical devices; medical liability in case of highly automated systems with defects; criminal liability in presence of artificial intelligence systems, along with the doctrine models developed to cope with these issues. The following models have been analysed: the zoological model, the perpetration through another model, the natural and probable consequences model, and finally the direct liability model. The existence of the criminal requirements, actus reus and mens rea, as mandatory elements to identify the criminal liability, has also been investigated. All the liability profiles have been analysed using real world case and scenarios. Eventually, some solution and remedies have been proposed as a conclusion, using also the theory elements of normative agents.

Informatica forense e processo penale: la prova digitale tra innovazione normativa e incertezze giurisprudenziali / Computer forensics and criminal proceedings: digital evidence between legislative innovations and case-law uncertainties

Gammarota, Antonio <1966> January 1900 (has links)
The work moves from the stages of Forensic Informatics development in Italy, continues through a systematization of the discipline, then moves on to the analysis of the technical issues and legal significance constituting the assumption of fact common to the legal topics being investigated. The research not only focuses on an examination of the forensic IT issues and of those interdisciplinary with Criminal Law, Procedural Digital Law and computer forensics, but especially deals with difficult themes of Forensic Informatics and issues little explored by the legal literature in order to isolate and develop them with innovative originality, moving from the rules of the Budapest Convention and Law 48/2008 of its Ratification in Italian acts. In this analysis, the innovative elements of the work are many, varied and relate to: • clarifications of the legal terminology of Forensic Informatics over which the candidate often dwells, demonstrating even today what is often misused; • scientific-ontological definition of the digital data, considered key to the whole Forensic Informatics foundation; • the physical and legal nature of digital data, object of investigations and surveys and their material-immaterial dimension, affecting the exegesis and the practice of the legal doctrines; • repeatable and /or unrepeatable nature of the acts of investigation involving digital data, considered one of the most serious systemic idiosyncrasies of the discipline; • digital documentary evidence and the relationship between the original, primary and copied digital documents, in the criminal process; • consequences of such reasoning, still neglected by Criminal Processual Law, in the most recent jurisprudence of merit and legitimacy.

Nuovi diritti e privacy genetica: profili giuridici e bioetici / New rights and genetic privacy: juridical and bioethical profiles

Tonutti, Stefania <1985> January 1900 (has links)
Science has an exemplary role in the world, also compared to the social and economic develop: public institutions and law are dedicating to regulation of technoscience. The mixture of science, society and politics is so important that they influence all the "State-System" and express a need to rethinking about fundamental principles of Law of the New Technologies. In Italy this type of analysis is studied by a bioethical point of view. Now are born new rights and new juridical status: biological citizenship, genetic citizenship, biological identity, genetic identity, and so others. In this work I write about genetic, all fields of genetic (medicine, biobanks and patents); in particular it speaks about bioethical problems and also about genetic data protection (it called genetic privacy).

Legal Ontology for Nexus: Water, Energy and Food in EU Regulations

Rahman, Md Mizanur <1980> 29 January 2016 (has links)
The objectives of the thesis are – (a) to identify the problems in water-energy-food nexus from ICT and Law point of view and to propose theoretically a legal knowledge framework for water-energy-food nexus in order to reduce those problems technologically, (b) to construct and implement legal ontology for nexus extracted from EU water, energy and food Regulations in OWL 2 language, which is a part of the grater work of implementing legal knowledge framework for water-energy-food nexus proposed through the compilation of objective (a). Considering these objectives, this thesis presents total five chapters. First chapter investigates current start of art of nexus in order to identify (1) major knowledge gaps in the nexus and (2) ontological existence of the nexus in the EU regulations, particularly in the legal definitions accommodated in EU Regulations and Directives associated with nexus domains. It also rationalizes the need for legal ontology for nexus. Second chapter evaluates existing perspectives and methodologies available for constructing legal ontology. The purpose of such evaluation was to select correct perspective and methodology for constructing legal ontology for nexus. It, at the end, justifies the need for developing new methodology for constructing the legal ontology for nexus. Third chapter explains the methodology used for engineering legal definitional knowledge extracted from the selected EU regulations in order to construct the legal ontology for nexus. Fourth chapter explains in detail the legal ontology for nexus while fifth chapter evaluates legal ontology for nexus. In addition, conclusion of the thesis shares critical issues faced throughout this doctoral thesis work. Furthermore, annexes contain a list of all formulas of restrictions implemented in legal ontology for nexus and links of all modules of legal ontology for nexus. LODE documentation of the legal ontology for nexus is available at http://codexml.cirsfid.unibo.it/post-doctoralresearchers/mizanur-rahman/.

ForensicStorage. Custodia, gestione e analisi dei reperti informatici / ForensicStorage. Custody, management and analysis of computer exhibits

Paselli, Andrea <1972> January 1900 (has links)
The thesis develops the discipline of Computer Science Forensics, starting from the beginning to the most recent regulatory and technological developments, by analyzing the discussion along the main legal and technical issues. In the pages of this research are discussed the main types of crimes with particular reference to offenses concerning online child pornography. In the handling of this matter are also highlighted regulatory issues regarding privacy by providing a full discussion of the current regulations concerning the handling of sensitive data and the minimum required safety measures. And the important changes brought by the New Privacy Regulations soon to be applied are also outlined. The research moving from the innovations introduced with the ratification of the Budapest and the Lanzarote Convention, facing numerous technical and legal issues, as well as some differences between the various European rules on the subject, analyzes the state of computer forensics in its various regulatory and methodological aspects, finally proposing an innovative acquisition, analysis and use of computer evidence with particular reference to criminal investigations, called ForensicStorage. This project based on the operational Best Practices and facing the operational issues that the Judicial Police has to deal every day, suggests an important innovation by introducing a new and totally original modus operandi that allows to optimize timing and costs. The ForensicStorage project, as described provides for the possibility of concentrating in suitable areas and places, all the computer media seized by the Judicial Police and then pour the same on a storage platform with the help of appropriate software and forensic tools combined with large capacity computational hardware will enable real-time, even remotely search for the computer evidence by the investigators. Just starting from these assumptions is finally illustrated the ForensicWeb Project which is a web application part of the Project ForensicStorage.
