Antigas porque há um persistente fluxo de estudantes brasileiros que se volta às instituições francesas de ensino, graças à presença de relações históricas entre o Brasil e a França consolidadas nesse âmbito. No entanto, como parte das migrações internacionais contemporâneas, verifica-se também a presença de novas modalidades migratórias no recente fluxo de brasileiros para a França, deslocamentos que acompanham às transformações sociais advindas com a intensificação da chamada globalização e toda a dinâmica associada, nesse cenário, à diminuição das distâncias e à crescente mobilidade humana. Como se argumenta na tese, o uso das modalidades migratórias na análise permitiu a reconstrução dos processos sociais que engendram os fluxos, ao mesmo tempo em que contemplou a incorporação dos diferentes interesses e estratégias dos migrantes e das repercussões correspondentes nas formas de instalação na sociedade de destino. Se o nível de autonomia e de coação que os agentes experimentam não é idêntico entre os diferentes perfis de migrantes, consequentemente as práticas e os mecanismos envolvidos no projeto e na realização da migração conjugam essas especificidades / Abstract: Brazilian immigration in France after 1980 was analyzed here with regard to the heterogeneity of the modalities that make this flow, whose dynamics reveal the concomitant presence of "old" and "new" migratory logics. Old because there is a persistent flow of brazilian students that turns itself to French learning institutions, thanks to the existence of historical links between Brazil and France within that circle. However, as a part of contemporary international migrations, there are also new migratory modalities in the recent flow of Brazilians to France, displacements that go hand in hand with the social transformations resulting from the intensification of the so-called globalization and from all dynamics associated to the diminishing distances and growing human mobility in that backdrop. As it is stated in the thesis, the use of migratory modalities in the analysis has allowed the rebuilding of the social processes that bring those flows, contemplating, at the same time, the incorporation of different interests and strategies of the migrants, as well as the corresponding repercussions in the ways of installation in destination societies. Desde 1989, a França vem sendo marcada pela aprovação de um conjunto de leis que limitam o uso do véu islâmico, direta ou indiretamente. Recentemente, através da legislação contra a dissimulação da face (nº 1192), aprovada em 11 de outubro de 2010, o uso do véu integral restou impedido nos espaços públicos. Com enfoque nesta última medida, este trabalho vista compreender os argumentos que compõem o debate, a partir da análise dos pareceres e decisões judiciais dos seguintes órgãos: Comissão Nacional Consultiva de Direitos Humanos, Assembleia Nacional, Conselho de Estado e Conselho Constitucional. De um lado, explora-se de que modo os argumentos de direitos humanos contrapõem-se neste caso. Com efeito, se é com base no fundamento de gênero que a lei é justificada nos discursos políticos, os seus opositores reivindicam as liberdades de pensamento, consciência e religião, assim como a liberdade cultural. Assim, o trabalho faz a análise sobre como este embate entre direitos humanos foi sopesado, em concreto, pelas diversas instâncias de poder do país. De outro lado, considerando a relação da França com a diversidade (em especial, aquela derivada da imigração), investiga-se de que forma esta medida está associada às controvérsias sobre a inclusão dos imigrantes e seus descendentes na sociedade francesa. O objetivo deste trabalho, portanto, é estudar o desenvolvimento desta controvérsia, desde os discursos políticos até os fundamentos judiciais, investigando os argumentos que compõem este percurso. E, ao fazê-lo, evidenciar desafios relacionados às sociedades culturalmente diversificadas e à própria legitimidade do discurso de direitos humanos. / Since 1989 France has seen the adoption of a set of laws that limit, either directly or indirectly, the wearing of the Islamic veil. Recently, through legislation against the dissimulation of face (n. 1192), adopted on October 11th 2010, the use of the full veil in public spaces has been forbidden. Focusing on the latter, this work aims to understand the arguments that make up the debate through the analysis of the legal opinions and decisions by the following instances: The National Consultative Commission on Human Rights, The National Assembly, The State Council and the Constitutional Council. On the one hand, the paper examines how human rights allegations are in opposition in this case. Indeed, it is based on gender grounds that this law is justified in political speeches, while its opponents claim the right to freedom of thought, speech and religion, as well as cultural freedom. In this sense, the work presents an analysis of how this struggle between rights has been resolved by the various levels of institutions of power in France. On the other hand, considering Frances stance on diversity (especially that resulting from immigration), it investigates how this measure is related to the controversy over the inclusion of immigrants and their descendants into French society. From these perspectives, the study illustrates that if Muslim women were initially put in the position of the victim in the political debate, ultimately they would be regarded as a threat. In this sense, human rights allegations, which boosted the controversy, were gradually replaced by allegations of public order. An innovative concept is that of immaterial public order, based on the assumption of the denial of reciprocity and ignorance of the minimum requirements of society by Muslim women, which justifies the analyzed legislation.Therefore, the objective of this study is to investigate the development of this controversy from the political discourse up to the legal justifications. In doing so, the challenges facing culturally diversified societies and the legitimacy of human rights discourse are highlighted.

Le travail bénévole en soutien aux migrant·e·s dans le sud-est de la France : enjeux, affect et utopie d'une solidarité par l'hébergement

Titre de l'écran-titre (visionné le 20 novembre 2023) / En réponse à la précarisation des personnes en exil en France causée par un système politique et juridique déshumanisé et déshumanisant en matière d'immigration, des mouvements citoyens de solidarité émergent. Cette recherche ethnographique se penche sur une partie de la population locale du sud-est de la France qui s'est organisée en associations indépendantes afin de proposer un hébergement temporaire aux nouveaux·elles arrivant·e·s sans domicile. Le soutien, aussi bien moral, juridique, qu'administratif offert aux migrant·e·s, se déploie dans le quotidien de la cohabitation et se met en acte à partir d'un réseau de solidarité. Sur la base de cinq mois d'observation participante dans plusieurs lieux d'hébergement collectifs et individuels, ainsi que treize entretiens réalisés avec les hébergeant·e·s et hébergés, ce mémoire étudie le bénévolat par l'hébergement à travers son vécu et les liens affectifs qui se développent avec les personnes soutenu·e·s. La relation qui se construit entre bénévoles et migrant·e·s, ancrée dans l'utilisation du champ lexical de la famille, témoigne d'un engagement émotionnel de part et d'autre. Étudiée comme un levier destiné à atténuer les effets du processus d'isolement et d'exclusion créés par le système d'immigration en France, la pratique de l'hébergement solidaire révèle une capacité à générer des transformations sociales. Sous l'angle de l'anthropologie de l'utopie (Hébert 2016), la lumière est mise sur la portée sociale et politique de la rencontre, puis de l'engagement relationnel entre bénévoles et migrant·e·s. Leurs aspirations tendent vers un imaginaire collectif politique alternatif. En interrogeant l'opposition entre citoyen et non-citoyen, iels transforment socialement le territoire d'accueil. / In response to migrants' precarity caused by the dehumanized and dehumanizing political and juridical immigration system in France, civic solidarity movements emerge. This ethnographic research focuses on local people located in the south-east of France who are organized into independent associations and propose accommodation for migrants in precarious situations. That administrative, legal, but also emotional support provided manifests itself through everyday cohabitation and local solidarity network. Based on five months of participant observation in different collective and individual accommodation settings and thirteen interviews with both migrants and volunteers, the following dissertation examines the volunteers' work through the affective bounds they develop with the people they support. The relationship built between migrants and volunteers using kinship terminologies shows emotional engagement. As a way to overcome barriers such as isolation and exclusion erected by the French immigration process, the practice of hospitality reveals the capacity of local solidarities to foster social transformations. In line with the anthropology of utopia (Hébert 2016), I mean to bring forward the political and social significance of the encounter between migrants and volunteers and their commitment to the relationships they develop. Participants' aspirations offer an alternative collective political imagination. By questioning citizen and non-citizen's institutionalized delimitations, they socially change the host country.

The aim of the analysis is to question the meaning of the idea of "mixed neighborhood" today in France. The research focuses on Arnaud-Bernard, city center district of Toulouse, during the beginning of the 1990's. Three aspects are significant: different waves of immigration, different names, and a singular event, the "district's dish" (repas-de-quartier") as social link's creator. The mechanism of the Carrefour-Culturel, main association in the neighborhood in order to build a "mixed neighborhood", has been studied in this thesis. Interviews and sources from the association have been analyzed. Moreover the literature has been examined in order to underline the complexity of the idea of "mixed neighborhood". Résumé L'objet de l'analyse est de questionner ce que signifie la « mixité » et ce qu'elle désigne à l'échelle d'un quartier aujourd'hui en France. La recherche se focalise sur le quartier Arnaud-Bernard du centre ville de Toulouse à partir des années 1990.
