Denna uppsats redogör för vad som idag kan kategoriseras som industritillbehör utifrån gällande rätt. Den uppmärksammar även flera problem med nuvarande lagstiftning gällande industritillbehör och presenterar ett förslag på ändrad ordalydelse som bedöms vara lämpligare. Förslaget grundas på en bredare kategorisering av vad som ska kunna tillhöra industritillbehörskretsen som presenterades i de förarbeten som ligger till grund för den nuvarande lagen. Ändringen motiveras delvis på samma sätt som det tidigare förslaget i och med att det anses ha varit befogat redan då och delvis med stöd av de nya förhållanden som råder idag vilka ytterligare framhäver nödvändigheten av en så bred krets som från början föreslogs. Så som lagen är utformad begränsas industritillbehörskretsen bland annat till att enbart innefatta utrustning som används inom ”industriell verksamhet”, ett begrepp som endast är applicerbart på verksamheter vilka bedriver varuproduktion. Det ansågs inte vara nödvändigt att inkludera en bredare krets av verksamheter i och med att utrustning av det slag som åsyftades bedömdes finnas främst i fabriker. Med den teknikutveckling som skett sedan dess har liknande och ibland även likadan utrustning dock kommit att användas inom flera verksamheter som inte ägnar sig åt varuproduktion. De gamla motiveringarna till varför sådana verksamheters utrustning inte ska kunna utgöra industritillbehör är därför inte längre försvarbara  Denna uppsats presenterar ”industriell eller därmed jämförlig verksamhet” som ett förslag på ändrad ordalydelse i 2:3 JB, vilket är taget direkt från lagens förarbeten. Det hade varit lämpligt att låta lagen lyda så från början, men det framstår som särskilt lämpligt i dagsläget. Industritillbehörskretsen bör utvidgas främst för att fler verksamheter ska kunna nyttja dyrbar utrustning till att förstärka kreditunderlaget för fastighetspant. En utvidgad industritillbehörskrets hade troligen även undanröjt viss gränsdragningsproblematik. / This essay gives an account of what can today be categorized as industrial fixtures according to the law. It brings attention to several problems with current law concerning industrial fixtures and presents a suggestion for changed wording which is considered to be more appropriate. The suggestion is based on a broader categorization of what should belong to the range of industry fixtures which was presented in the bills which lay as the basis to the current law. The change is partly motivated the same way as the previous suggestion since it is thought to have been justified already then and partly by support of the new circumstances of today which further exposes the necessity of a range as broad as was originally suggested. Such as the law is designed, the range of industrial fixtures is limited among other things to only include equipment used in “industrial business”, a term which only is applicable for businesses which deal with the manufacture of products. It was not thought to be necessary to include a broader range of businesses, because equipment of the applicable kind was judged to exist mostly in factories. With the technological development which has happened since then similar and sometimes even identical equipment has come to be used in several businesses which do not deal with the manufacture of products. The old arguments for why such businesses equipment should not constitute industrial fixtures is therefore no longer justifiable. This essay presents “industrial or there with comparable business” as a suggestion for changed wording in 2:3 JB, which is taken directly from the original bill. It would have been appropriate to let the law read this way from the beginning, but it appears as especially appropriate today. The range of industrial fixtures should be expanded mainly so that more businesses can be able to use valuable equipment to strengthen credit for real estate mortgage. An expanded range of industrial fixtures would probably also clear away some problems concerning demarcation.
