O objetivo deste trabalho é analisar a relação que a peça Musik für Renaissance-Instrumente (1966), de Mauricio Kagel (1931-2008), estabelece com o material musical da tradição e das vanguardas, na segunda metade do século 20. A partir da definição de material musical em Adorno investigaremos historicamente a crítica que se delineia em sua peça com relação às posturas estéticas em questão. Este trabalho pretende refletir criticamente sobre o sentido do movimento de interpretação historicamente informada e dos movimentos de vanguarda, identificando suas convergências e afinidades estéticas. Por fim, nosso objetivo é traçar o sentido estético e filosófico da obra de Kagel no contexto musical de sua emergência, buscando refletir sobre a importância de sua obra para o contexto atual de produção musical. / The aim of this research is to analyze the relation established by Mauricio Kagel\'s Musik für Renaissance-Instrumente with traditional musical material and also with material built by the musical avant-garde from the second half of the 20th century. Based on the definition of musical material in Theodor Adorno\'s philosophy we also intend to investigate through historical perspective how Kagel\'s criticism in composition applies to both of the aforementioned tendencies. Furthermore a critical assessment of the historical interpretation movement as well as of the avant-garde has been carried out, with the main purpose of establishing their mutual aesthetical affinities. Lastly, our foremost objective was to outline the meaning of Kagel\'s composition in the context of its appearance, in order to ponder about its importance for contemporary context of musical production.

Dictionary learning methods for single-channel source separation / Méthodes d'apprentissage de dictionnaire pour la séparation de sources audio avec un seul capteurLefèvre, Augustin 03 October 2012 (has links)
Nous proposons dans cette thèse trois contributions principales aux méthodes d'apprentissage de dictionnaire. La première est un critère de parcimonie par groupes adapté à la NMF lorsque la mesure de distorsion choisie est la divergence d'Itakura-Saito. Dans la plupart des signaux de musique on peut trouver de longs intervalles où seulement une source est active (des soli). Le critère de parcimonie par groupe que nous proposons permet de trouver automatiquement de tels segments et d'apprendre un dictionnaire adapté à chaque source. Ces dictionnaires permettent ensuite d'effectuer la tâche de séparation dans les intervalles où les sources sont mélangés. Ces deux tâches d'identification et de séparation sont effectuées simultanément en une seule passe de l'algorithme que nous proposons. Notre deuxième contribution est un algorithme en ligne pour apprendre le dictionnaire à grande échelle, sur des signaux de plusieurs heures. L'espace mémoire requis par une NMF estimée en ligne est constant alors qu'il croit linéairement avec la taille des signaux fournis dans la version standard, ce qui est impraticable pour des signaux de plus d'une heure. Notre troisième contribution touche à l'interaction avec l'utilisateur. Pour des signaux courts, l'apprentissage aveugle est particulièrement dificile, et l'apport d'information spécifique au signal traité est indispensable. Notre contribution est similaire à l'inpainting et permet de prendre en compte des annotations temps-fréquences. Elle repose sur l'observation que la quasi-totalité du spectrogramme peut etre divisé en régions spécifiquement assignées à chaque source. Nous décrivons une extension de NMF pour prendre en compte cette information et discutons la possibilité d'inférer cette information automatiquement avec des outils d'apprentissage statistique simples. / In this thesis we provide three main contributions to blind source separation methods based on NMF. Our first contribution is a group-sparsity inducing penalty specifically tailored for Itakura-Saito NMF. In many music tracks, there are whole intervals where only one source is active at the same time. The group-sparsity penalty we propose allows to blindly indentify these intervals and learn source specific dictionaries. As a consequence, those learned dictionaries can be used to do source separation in other parts of the track were several sources are active. These two tasks of identification and separation are performed simultaneously in one run of group-sparsity Itakura-Saito NMF. Our second contribution is an online algorithm for Itakura-Saito NMF that allows to learn dictionaries on very large audio tracks. Indeed, the memory complexity of a batch implementation NMF grows linearly with the length of the recordings and becomes prohibitive for signals longer than an hour. In contrast, our online algorithm is able to learn NMF on arbitrarily long signals with limited memory usage. Our third contribution deals user informed NMF. In short mixed signals, blind learning becomes very hard and sparsity do not retrieve interpretable dictionaries. Our contribution is very similar in spirit to inpainting. It relies on the empirical fact that, when observing the spectrogram of a mixture signal, an overwhelming proportion of it consists in regions where only one source is active. We describe an extension of NMF to take into account time-frequency localized information on the absence/presence of each source. We also investigate inferring this information with tools from machine learning.

La protection du consentement du consommateur représente l'essence même de l'intervention du droit pénal dans la sphère consumériste. La question fondamentale qu'il convient de se poser est donc celle de savoir si ce droit pénal sanctionne les comportements délictueux dont peut faire preuve le professionnel de manière accessoire au droit civil ou bien, plus intéressant, s'il revêt une autonomie dans la protection du consentement du consommateur, sans être un simple droit sanctionnant et dissuasif. / The consumer’s penal protection is an essential stake, even more so following the last legislative reforms that occurred in the matter. The consumer’s consent’s protection represents the very essence of criminal law’s intervention in the consumerist sphere. The fundamental question that must be asked is whether criminal law punishes the criminal behaviour that a professional might show as an additional legislation which is dependent on civil law or, more interestingly, if criminal law is in fact autonomous in the consumer’s consent’s protection without being nothing more than a repressive and dissuasive legislation.

1 Abstract Contract for health care under the Civil Code The subject of this thesis is a new type of contract, which was brought into Czech civil law by the Civil Code effective since 1 January 2014 - contract for health care. By including this special type of contract, the legislators practically agreed with a group of legal experts stating that health care is provided under contract, even before the new Civil Code became effective. This paper deals with the very conception of health care used in Czech legislation and with its comparison with the interpretation on this matter in legal codes, which were used by the authors of the provisions on contract for health care as inspiration. First part of this thesis discusses the legal regulation of health care in the Civil Code. With aim to provide a coherent point of view of this type of contract, this part briefly describes other possible conceptions of this legal institute. Besides the solutions, which provided a source of inspiration to Czech legislators, and those which are similar to the new Czech regulation, conceptions of health care used in other states of mainly continental Europe are mentioned. In relation to recent development in the field of private law there is a need to examine the aspects of personality rights separatelyy and also in broughter context. This Master's thesis sets as its goal to follow the current legislation and to point out situations where the personality rights can be especially endangered. The second goal is to evaluate current legal issues in foreign countries of the protection of personality rights in relation to the provision of health services in order to see if there is a probability that Czech law will have to deal with similar problems in the future as well. In the first part the concept of personality rights and their protection is introduced. The aspects related to the provision of health services that may be especially endangered are highlighted. Also the possibilities of resolving situations where there is infringement of personality rights are presented. Les méthodes de NMF permettent la factorisation aveugle d'une matrice non-négative X en le produit X = G . F de deux matrices non-négatives G et F. Bien que ces approches sont étudiées avec un grand intêret par la communauté scientifique, elles souffrent bien souvent d'un manque de robustesse vis à vis des données et des conditions initiales et peuvent présenter des solutions multiples. Dans cette optique et afin de réduire l'espace des solutions admissibles, les travaux de cette thèse ont pour objectif d'informer la NMF, positionnant ainsi nos travaux entre la régression et les factorisations aveugles classiques. Par ailleurs, des fonctions de coûts paramétriques appelées divergences αβ sont utilisées, permettant de tolérer la présence d'aberrations dans les données. Nous introduisons trois types de contraintes recherchées sur la matrice F à savoir (i) la connaissance exacte ou bornée de certains de ses éléments et (ii) la somme à 1 de chacune de ses lignes. Des règles de mise à jour permettant de faire cohabiter l'ensemble de ces contraintes par des méthodes multiplicatives mixées à des projections sont proposées. D'autre part, nous proposons de contraindre la structure de la matrice G par l'usage d'un modèle physique susceptible de distinguer les sources présentes au niveau du récepteur. Une application d'identification de sources de particules en suspension dans l'air, autour d'une région industrielle du littoral nord de la France, a permis de tester l'intérêt de l'approche. À travers une série de tests sur des données synthétiques et réelles, nous montrons l'apport des différentes informations pour rendre les résultats de la factorisation plus cohérents du point de vue de l'interprétation physique et moins dépendants de l'initialisation. / NMF methods aim to factorize a non negative observation matrix X as the product X = G.F between two non-negative matrices G and F. Although these approaches have been studied with great interest in the scientific community, they often suffer from a lack of robustness to data and to initial conditions, and provide multiple solutions. To this end and in order to reduce the space of admissible solutions, the work proposed in this thesis aims to inform NMF, thus placing our work in between regression and classic blind factorization. In addition, some cost functions called parametric αβ-divergences are used, so that the resulting NMF methods are robust to outliers in the data. Three types of constraints are introduced on the matrix F, i. e., (i) the "exact" or "bounded" knowledge on some components, and (ii) the sum to 1 of each line of F. Update rules are proposed so that all these constraints are taken into account by mixing multiplicative methods with projection. Moreover, we propose to constrain the structure of the matrix G by the use of a physical model, in order to discern sources which are influent at the receiver. The considered application - consisting of source identification of particulate matter in the air around an insdustrial area on the French northern coast - showed the interest of the proposed methods. Through a series of experiments on both synthetic and real data, we show the contribution of different informations to make the factorization results more consistent in terms of physical interpretation and less dependent of the initialization

Magister Legum - LLM / There is a growing interplay of competing realities facing the international community in the general areas of innovation, technological advancement and overall economic development. The highly industrialised wealthy nations, largely located on the Northern hemisphere are on the one hand undoubtedly at the forefront in global research, technology and infrastructure development. The developing and least developed countries on the other hand are mostly situated on the Southern hemisphere. They are not as wealthy or technologically advanced as their Northern counterparts, but are naturally endowed with unique variations of plant, animal and micro-organism species occurring in natural ecosystems, as well as the traditional knowledge on how to use these unique species. This knowledge has been adjudged to be responsible for the sustainable maintenance of the earth biodiversity. Increasing exploitation of biodiversity spurred on by the competing realities identified above, has left the earth in a present state of alarm with respect to the uncontrolled loss of biodiversity. The traditional knowledge of local peoples has significantly offered leads to research institutes from the North in developing major advancements in drugs, cosmetics and agriculture. Little or no compensation has however been seen to go back to the indigenous communities and countries that provide resources, and indicate various possibilities through their traditional knowledge to the use of such resources. Efforts by some biodiversity rich countries to ddress this trend through legislation developed in accordance with the principles of the Convention on Biological Diversity have been frustrated due to the inability to enforce their domestic laws outside their borders. Theft of genetic resources and its associated traditional knowledge from such countries has therefore remained a major challenge. Against this backdrop, and on the insistence of biodiversity-rich developing countries, an international regime on access and benefit sharing was negotiated and its final text adopted in 2010. This international regime is as contained in the Nagoya Protocol. This research sets out to examine whether the Nagoya Protocol offers a final solution to the protection of traditional knowledge associated with biodiversity in biodiverse countries. It further examines the importance of domestic legislation in achieving the objectives of the Protocol. The research has been tailored to African biodiverse countries, and seeks these answers within the context of Africa. / South Africa

Competent adults can exercise their autonomy and can choose to take on risk for the sake of others, therefore are able to protect their own interests while in the pediatric research the ‗best interests of the child‘ takes precedence over autonomy. In other words giving informed consent in the pediatric context, is not ‗who decides‟ but „what is the best decision for the child‟. Due to lack of consensus gold standard to guide researchers and assess the quality of parental informed consent in Botswana, the practical and ethical challenges posed in
obtaining parental informed consent for child enrolment in pediatric HIV clinical trials were examined. The study aimed to determine the readability of the consent forms used in pediatric HIV clinical trials; assess communication methods, practices and perceptions of the trial staff regarding the informed consent process; assess the extent to which parents recall and understand the information disclosed to them and their satisfaction with the informed consent process as well as to identify and describe the reasons for parental approval to child enrolment into HIV clinical trial studies.

Understanding Evidence-Informed Decision-Making in a Community-Based Network Working Towards the Baby Friendly InitiativeLukeman, Sionnach January 2013 (has links)
Objective: To understand the use of evidence-informed decision-making within an interorganizational network, and identify the facilitators and barriers to achieving network goals.
Design: Case study.
Setting: Rural health district in Nova Scotia, Canada (2006 to 2011).
Participants: Members from 4 organizations representing community and hospital groups participating in a regional Baby Friendly Initiative network.
Methods: A descriptive mixed methods study using focus group and questionnaire methodology. Data were analyzed using framework analysis and social network analysis (SNA).
Results: The SNA results highlighted the role that relationships have on the sharing of knowledge among network members. The findings highlight the need for leadership at multiple levels (community, network members, primary organizations, and the provincial government). A lack of resources to achieve the network’s goals was a key barrier. Conclusions: The role of multi-level leadership is important for future network development and community consideration. The case study methodology facilitated momentum towards the network’s goals.

The aim of this dissertation is an analysis of the regulatory framework for the procurement and distribution of stem cells in South Africa. This research includes aspects of the law of obligations, medical law and human rights law as found in the Bill of Rights. More specifically however, this dissertation attempts to bring to attention the shortcomings of chapter 8 of the National Health Act. An examination is undertaken according to the multilayered approach and therefore the proposed regulatory framework is examined within a constitutional framework, an ethical framework, the framework as established by common law, in this case the doctrine of informed consent and lastly within the national legislation framework as found in the National Health Act of 2003 and the regulations made in terms of the Act. This dissertation further entails a brief comparative study of the regulatory mechanisms of the United Kingdom as entrenched in the Human Fertilisation and Embryology Act of 2008 and the Human Tissue Act of 2004 and as practiced by the Human Fertilisation and Embryology Authority and the Human Tissue Authority. The analysis in this dissertation firstly provides an overview of the clinical manifestations and science of stem cell technology. Secondly, the impact of the Constitution of the Republic of South Africa is discussed with particular reference to the Bill of Rights on stem cell research and therapy. The most noteworthy conclusion to be made in this regard is that the embryo is not the bearer of constitutional rights. The ethical guidelines which act as regulatory tools in this field are then discussed with attention to general ethical principles as provided for by the Health Professions Council of South Africa as well as the Medical research Council. The doctrine of informed consent further enjoys attention as it is discussed in context of medical research and key issues are addressed regarding the process of obtaining consent in context of stem cell technologies. Certain recommendations are then made pertaining to the minimum scope required for lawful consent. Lastly a critical analysis is made of chapter 8 of the National Health Act.
