1 Abstract Legacy of current law of succession This master's dissertation focuses on the traditional legacy of Roman law institute which, through the law no. 89/2012 of the Civil Code, has found its way back to the Czech legal system. The text of the paper is divided into two main parts which are not split equally by what they cover, however, the aim of the dissertation determined such division. The first part the dissertation outlines the historical foundations for the nowadays' form of the legacy. In short, the shape of the Roman law is covered in the introduction as an essential ground for further law adjustments. A comparison of two, from these days' perspective most important sources of law modification - the legacy's modification of the ABGB, and the modification of unimplemented government proposal of civil code of 1937 - follow. The comparison is replenished by an overview of the diminishing legacy's modification of civil code of 1950, and of the final legacy's refusal in civil code of 1964. The second part of the dissertation covers the in-force legal form of the Civil Code. The current form of the legacy is elaborated, following the taxonomy of the law. 1 New institutions of inheritance law in comparison with the Swiss law Abstract The new legislation of the civil code no 89/2012, brings major changes to the Czech inheritance law. Institutes, that has been traditionally part of most of the European countries has been after decades reintroduced into the Czech legal system. Moreover there are also institutes, which are completely new. These institutes are namely inheritance contract, legacy, renouncement of inheritance, surrender of inheritance, alienation of inheritance and codicil. This thesis aims to describe these institutes in detail, including their historical background. The new inheritance law legislation has been mostly influenced by the legislation effective in Czechoslovakia during 1920s and 1930s, meaning ABGB - the Austrian Civil code enacted in 1811. Also parts of the draft of a new civil code from 1937 were used as a template, as well as current civil codes of other European countries, as for example the German BGB or the Swiss ZGB. For the purpose of a legal comparison, this thesis contains also a brief description of the Swiss legislation concerning the above mentioned institutes.

Siblings and Inheritances: A Phenomenological Study Exploring the Relational Outcomes Following the Inheritance Distribution Process

The purpose of this study was to contribute to a more complete understanding of the family inheritance experience by exploring the perspectives of beneficiaries. This qualitative study aimed to describe and discuss how individuals' sibling relationships were impacted following the distribution process of an inheritance that was intended to be equally distributed. Eight individuals participated in semi-structured interviews, with areas of inquiry covering perceptions of challenges and benefits of the distribution process, fairness of the outcome of distribution among siblings, and the impact the process has had on their sibling relationships. The data was analyzed using transcendental phenomenology. Findings suggest families experience varying degrees of conflict during inheritance distributions, but not all conflict was devastating to the relationships following the distributions. Specific relational aspects were identified in contributing to the level of satisfaction of the distribution, which subsequently affected their relationships afterward. Additionally, the handling of conflict and efforts to repair relational strains significantly contribute to relational outcomes following the distribution. The majority of participants reported stronger relationships following the inheritance distribution. The findings provide a foundation for further research to explore beneficiary's experiences of receiving an inheritance within multi-child families. / Master of Science
