The thesis deals with the analysis of small accidents. Its attention is focused on the estimated amount of money needed to repair a vehicle immediately after the accident and later on the real amount that is actually necessary to fix the vehicle. In practice, it often happens that an accident may seem minor at first glance. Only after dismantling of a damaged vehicle and its parts it is found that the damage is much greater than initially predicted. Attention is focused as well on constantly growing insurance frauds. Nowadays, there is no literature concerning this issue.

The diploma thesis deals with insurance fraud and issues which comes with it. The thesis is divided into several units. The first part is dedicated to insurance fraud in general, the insurance industry in the past and in the present and legislation in the past and in the present in the area of today´s Czech Republic. The thesis continue with analyzing of fraudulent behavior according to perpetrator and type of insurance. The next is statistical evaluation. In the part “Detection of insurance fraud” are summarized current methods of detection of the insurance frauds used by insurance companies in our market. There were also analyzed insurance frauds according to perpetrator, economic sector and insurance company. In the end is presented the case study of purpose action, suggestions suitable for the fight with insurance fraud and there is also offered as another technical possibility of help not only in the fight with insurance fraud - mathematical modeling of fires.

The main target of this thesis is describing the current state of trade, where the main target will suggest more advantageous and more effective solutions for business based on the detected information and then will be applied to the practice.

A theoretical part attends to an insurance with focus on problematics of valuing of insurance events in the field of motor vehicles and categorization of a motor vehicles itself. This thesis contents an analysis of working methods used by the loss adjusters in both theoretical and practical ways. A methodology was elaborated based on an analysis and requierements on forensic expert work.

The significance of physical surveillance as a method in the investigation of insurance fraud: a Discovery Life perspective

Text in English / The primary aim of this study is to determine the significance of the application of physical surveillance as a method in the investigation of insurance fraud conducted by the Surveillance Unit at the Forensic Department of Discovery Life. Various objectives were fulfilled in this study:  To explore, identify and describe the value of the application of physical surveillance, as a forensic investigation method, in order to determine the significance of this method in the investigation of insurance fraud at the Forensic Department of Discovery Life.  To determine whether the application of physical surveillance at the Forensic Department of Discovery Life is achieving its intended objective relating to the degree to which the beneficiary’s (Discovery Life) situation has changed as a result of this method.  To apply new information, acquired from the findings of this study, to further develop good practice and enhance performance in order to empower investigators at Discovery Life with new knowledge relating to the application of physical surveillance in the investigation of insurance fraud. Semi-structured interviews were conducted with forensic investigators employed at the Forensic Department at Discovery Life. The research has revealed that the majority of forensic investigators, other than the Surveillance Unit, at the Forensic Department of Discovery Life do not utilise physical surveillance during insurance fraud investigations to assist them in gathering evidence. These investigators also had a lack of knowledge and skills regarding the utilisation of physical surveillance during insurance fraud investigations and the advantages of this method during insurance fraud investigations. As a result of the non-utilisation of physical surveillance during insurance fraud investigations conducted at the Forensic Department of Discovery Life, important information and evidence with regard to the movement and actions of identified perpetrators who commit insurance fraud are lost to the investigators. However, the significance of the application of physical surveillance in the investigation of insurance fraud is emphasised by the forensic investigators attached to the Surveillance Unit of Discovery Life who utilise physical surveillance on a daily basis to investigate insurance fraud. The research has further revealed that insurance fraud is a major concern to the insurance industry, but can be mitigated through the implementation of unconventional investigative methods, such as physical surveillance, to enhance investigative capabilities. It was recommended that all forensic investigators at Discovery Life be trained in the techniques of physical surveillance to address shortcomings of general and out-dated investigation methods. / Criminology and Security Science / M. The value of modus operandi in fraud investigation : a short-term insurance industry perspective

This study sought to examine the value of modus operandi (MO) information in the investigation of short-term insurance fraud. A comprehensive literature study was conducted concerning the dynamics of MO information in forensic investigation and short-term insurance fraud in South Africa and internationally, and individual semi-structured interviews were conducted with forensic investigators at Santam and MiWay to promote knowledge and understanding of the importance of MO information in short-term insurance fraud investigations. Results of this research indicate that participants did grasp the significance of MO information in the investigation of short-term insurance fraud. It is, however, apparent that they did not optimally exploit MO information regarding insurance fraud as a result of limited experience, ineffective databases and the inaccessibility of available data – all of which prevent the improvement of utilising MO data pertaining to short-term insurance fraud. Forensic investigators in the short-term insurance industry isolate themselves from each other and fail to share the available MO information amongst each other, resulting in a non-systematic fragmented approach to short-term insurance fraud investigation. The study identifies the challenges and shortcomings experienced by forensic investigators at Santam and MiWay that prevent the optimal utilisation of MO information in the investigation of short-term insurance fraud. The study then suggests a set of recommendations that could assist forensic investigators and other role-players in enhancing the utilisation of such information. / Criminology and Security Science / M. 我國強制汽車責任保險自西元1998年1月1日開始實施,迄今已逾10年之久,主要精神為使交通事故之受害人迅速獲得基本保障及維護社會大眾之安全與權益,所以採無過失責任精神,即在交通事故傷亡之受害人不論有無過失皆可獲得保險金給付,使許多受害人及其家庭之經濟即時獲得補償,所以有近九成民眾對於強制汽車責任保險之實施成效給予高度肯定。 近年來,強制汽車責任保險已成為保險犯罪集團覬覦之目標,保險詐欺案件有日益增加之趨勢,保險詐欺犯罪也發展成組織化及專業分工之保險詐欺集團,詐欺手法也不斷翻新且日益猖獗,也使強制汽車責任保險之實施精神遭受扭曲及破壞。本研究係透過產物保險業者蒐集不同類型之強制汽車責任保險詐欺案例,針對個案之犯罪手法加以比對分析,希冀從所蒐集不同類型之案例中探討保險詐欺之詐欺手法及特徵,以期研擬出一套具體措施能夠對保險詐欺作有效之防制,以遏止保險詐欺案件之發生。 本文研究有鑒於美國、英國、德國、挪威、日本及中國大陸等國家對於保險詐欺之防制不遺餘力,同時參考各國有關保險詐欺之法律規定與防制概況,保險詐欺資訊之提供及為對抗保險詐欺之教育宣導,這對於保險詐欺防制工作剛起步之我國,當有許多值得學習之處。當然保險詐欺之防制需要社會大眾、保險業者及政府檢警消相關單位正視保險詐欺問題之嚴重性,大家共同聯手一起來防制,才能有效遏阻保險詐欺之歪風。 / Compulsory automobile liability insurance in Taiwan has been implementing more than ten years since January 1, 1998. Its law-making intention is to ensure prompt and basic coverage for the injured parties in the automobile traffic accident and maintain the safety and rights for the public so it is adopted the system of no-fault basis. It means any injured party who is injured or lost of life in the automobile traffic accident can require the reimbursement regardless of who’s fault. Many injured parties and their families have received the prompt reimbursement from compulsory automobile liability insurance, so there are almost ninety percentage of the public in Taiwan giving the highly positive feedback to the implementation of compulsory automobile liability insurance. Within recent years, the compulsory automobile liability insurance which becomes a crime means and target of organized crimes of insurance fraud. The case of Insurance Fraud has the tendency in growth and the trick of insurance fraud become organized and professionalized, which has seriously affected the law-making purpose and normal developments of compulsory automobile liability insurance. This research, through the various organized criminal fraud cases of compulsory automobile liability insurance provided by non-life insurance companies. In order to prevent the fraud case from being on compulsory automobile liability insurance, this research collects and provides various types of fraud cases containing different means and characteristics. By the research, we hope to provide an effective measure to prevent fraud case from being on compulsory automobile liability insurance. The research is on the basis of the fact that many countries, for example, United States of American, England, Germany, Norway, Japan and China, have left on stone unturned to prevent insurance fraud and also on the basic of their laws and situations about insurance fraud, to furnish information about insurance fraud, and to educate the public about how to fight against insurance fraud, which is very beneficial to promote the development of insurance anti-fraud in Taiwan. There is no doubt that the prevention of insurance fraud needs the public, the insurer and authority cooperate closely. Only by doing so, we can prevent efficiently insurance fraud from spread.

The main aim of the thesis is to provide a complex view of the problems. The thesis analyses the issue from both legal and economic angle of view, deals with the insurance fraud typology and proves the theory by evidence of particular cases. The thesis thereinafter discovers causations of commiting insurance frauds and describes the insurence fraud abatment. In the end the thesis tries to disclose the weak points of the system of prevention, to point at them and to come up with the improvement suggestions and recommendations.

The thesis deals with the terminology used in forensic engineering practice at the analysis of road accidents. It means defining the concepts describing specific expert research in the area of car accident analysis such as the option of evasive action and the possibility of preventing collision. Further on, the thesis focuses on the terminology used in areas closely related to analysis of road accidents namely dealing with cases of criminal activities in the field of motor vehicle insurance from an expert point of view. In this area, terms such as extent of the damage, character of the damage, correspondence of the damage and the technical acceptability of accident, are solved. These terms constitute a formal process that can serve as a tool for experts when dealing with such cases. In addition, selected terms from the technical-legal area, which the experts often encounter, are processed here. At the same time, there is no uniform approach to their evaluation from a technical perspective. Here, there is a possibility of setting the limits of a sudden change of speed and a sudden change of direction.
