A critical comparative analysis of racial integration laws and its impact on professional team sports

The following research aims to examine the interaction of law, either hard law (legislation) or soft law (governing body regulation), on achieving a balance between racial equality and success in sport. Nearly all national jurisdictions have legislated to some degree in an attempt to affect equality or equality of opportunity for its citizens. This might be based on achieving equality of opportunity or by means of affirmative action. The research aim is to ascertain how far racial discrimination laws have positive or negative impacts on the success of sports in different countries. The research also has a series of supplementary objectives: to ascertain and consider critically the extent to which the law in various jurisdictions (Malaysia, South Africa, England and the United States) has been used to promote equality; to develop a sequential model to describe general trends to predict the influence of affirmative action and equal opportunity legislation upon the potential success of countries’ sporting achievements; to review tensions inherent in reconciling the equality of citizens at a national level and their impacts upon the international sporting success of that nation; to establish a correlative relationship between the types of anti-discrimination law within nations and the impact of these upon the degree of international sporting success of those nations. The research conducted concentrates primarily on qualitative methods by first adopting a doctrinal approach in a comparative legal study of four jurisdictions (Malaysia, South Africa, England and the United States). A non-doctrinal approach is then adopted and a qualitative intrinsic case study completed, including interviews concerning the subject area. Thus, the research has used multi-method qualitative approaches. The research indicated different anti-discrimination approaches taken in achieving equality. This can be typified by countries such as the United States or England based primarily on meritocracy and countries such as South Africa and Malaysia based primarily on preferential treatment. There is evidence to suggest that these approaches do have a certain correlation, albeit not similar in the outcome of achieving equality for selection. From the evidence presented, the overall study illustrates that racial discrimination laws in the four jurisdictions produced a mixed outcome in relation to the success of professional team sports. Specifically, England and the United States witnessed a positive impact in terms of achieving international success in sports even though there are inherent difficulties in reconciling the equality of citizens at a national level. For Malaysia and South Africa, the result tends to be positive in general at this stage although it is equally recognised that this approach might result in some negative impacts in the long run. The research however is subject to certain limitations which are outside the scope of this thesis, but it is recognised that these might affect the overall success of professional team sports within those countries.

Discursos e pr?ticas na forma??o de profissionais fisioterapeutas: a realidade dos cursos de fisioterapia na regi?o nordeste do Brasil

The aim of this work was to investigate the relationship existing between the process of physical therapist formation and the practical activities developed during the undergraduate course in the Northeast of Brazil. This is an exploratory descriptive study with qualitative significance. The sample consisted of 73 subjects (33 professors and 40 students) from 6 physical therapy courses at different institutions in the Northeast of Brazil. Data collection was conducted through focus group interviews. In addition, we used a school assessment instrument from the health area. The data, analyzed using dialectical hermeneutics, showed that the Northeast of Brazil has the second largest number of physical therapy courses in the country, with 93 (11 public and 82 private) out of a total of 510. These numbers represent a growth of 1062.5% since 1991. The pedagogical projects are guided by National Curricular Directives as well as by the country s health system. The prevalent pedagogy is that of transmission, and the contents/disciplines are generally not integrated with practice, a situation that hinders the integrality and interdisciplinarity of health care. It can be concluded that there is a need for implementing integrated curricula and for better qualified professors to effectively put this process into practice / Este estudo teve um enfoque multidisciplinar, ao abranger as ?reas da educa??o e da sa?de, e se prop?s a discutir a forma??o dos profissionais de sa?de, exigindo uma compreens?o dos fatores que a envolvem para a produ??o do conhecimento, uma vez que reflete essa forma??o na qualidade de vida humana e social. Este estudo teve como objetivo investigar a rela??o existente entre o processo de forma??o de profissionais fisioterapeutas e as atividades pr?ticas desenvolvidas durante o curso de gradua??o na Regi?o Nordeste do Brasil. A pesquisa teve car?ter descritivo explorat?rio com significa??o qualitativa. Contou com 73 participantes, sendo 33 docentes e 40 discentes de 06 cursos de Fisioterapia distribu?dos nas unidades da federa??o que comp?em a regi?o Nordeste do Brasil. A coleta foi feita atrav?s de entrevista com grupos focais. Adicionalmente, utilizou-se o Instrumento de Avalia??o das Escolas, da ?rea da sa?de. Os dados foram analisados utilizando-se a hermen?utica dial?tica, e revelaram que a regi?o Nordeste do Brasil det?m o segundo lugar no quantitativo de cursos de Fisioterapia do pa?s, com 93 cursos, do total de 510, sendo 11 de administra??o p?blica e 82 de administra??o privada. Esses n?meros representam um crescimento de 1.062,5% desde 1991. Os projetos pedag?gicos dos cursos est?o orientados pelas Diretrizes Curriculares Nacionais e para o sistema de sa?de vigente no pa?s. The current Brazilian condition reflects that the working environment of healthcare professionals in long term care is conducive to the construction of a new identity and reference for these professionals, who incorporate their personal and social activities to professional activities and build cooperative relations with their peers beyond the professional environment. In this context, where healthcare professionals are re-analyzing their relationship with work and issues that affect the quality of life and the quality of their professional activities, the support of technological resources is a strong partner, especially in sharing and disclosure information and also in management daily tasks. In order to incorporate technology requirements that naturally may be included in the workflow of these professionals without interrupt their routines, software developers have been mobilized to create natural interaction applications that help healthcare professionals and promotes the adoption of applications. Natural interactions are defined here as the way users share information using technological resources and applications instinctively, in a transparent way, without concern the peculiarities of the application or technological appeal. For the development of these applications, which considers users’ profiles who naturally mix professional, personal and social contexts, it is required a process model to guide and assist developers in this task. Thus, as scientific contribution in Computer Science, an application development process model and a set of guidelines to supports the developer’s work to create applications for healthcare professionals have been proposed. The proposed model encourages and provides the integration of different contexts of the healthcare professionals, enabling resource appropriation through the perception of abilities and prior knowledge of these professional, and encourages the addition of some new abilities. / Esta tese apresenta a pesquisa desenvolvida para a criação de um modelo de processo de design de aplicativos e um conjunto de diretivas para orientar e apoiar o trabalho de desenvolvedores de aplicativos para profissionais da área da saúde. O momento atual reflete que o ambiente de trabalho dos profissionais da área da saúde que atuam nos cuidados constantes e durante longos períodos é propício para a construção de uma nova identidade e referência para estes profissionais, que incorporam suas atividades pessoais e sociais às atividades profissionais e constroem relações de cooperação com seus pares além do ambiente profissional. Diante desse contexto, em que profissionais da saúde repensam sua relação com o trabalho e os aspectos que afetam a qualidade de vida e a qualidade das suas atividades profissionais, o apoio dos recursos tecnológicos é um forte aliado, principalmente nos processos de troca, divulgação de informações e gerenciamento de tarefas. Com o intuito de incorporar recursos tecnológicos que naturalmente se insiram no fluxo de trabalho desses profissionais, sem que sejam empecilhos em suas rotinas, mas que os apoiem na realização de suas tarefas, desenvolvedores de software têm se mobilizado na criação de aplicativos com interação natural que auxiliem os profissionais da saúde e favoreçam a adoção de aplicativos desenvolvidos. Interações naturais são definidas aqui como a maneira que o usuário troca informações com aplicativos e recursos tecnológicos de forma instintiva e transparente, sem se inquietar com as peculiaridades do aplicativo ou recurso tecnológico manipulado, por serem formas de interação mais próximas da realidade do usuário. Para o desenvolvimento desses aplicativos, que levam em conta perfis de usuários que naturalmente misturam contextos profissionais, pessoais e sociais, constatou-se a necessidade de um modelo de processo que oriente e auxilie os desenvolvedores nesta tarefa. Assim, como contribuição científica na área de Computação, um modelo de processo de design de aplicativos e as diretivas que orienta e apoia o trabalho de desenvolvedores de aplicativos para profissionais da área da saúde foram propostos. O modelo e as diretivas incentivam e proporcionam a integração dos diferentes contextos dos profissionais da saúde, facilitando a apropriação de recursos tecnológicos através da percepção das habilidades e conhecimentos prévios desses profissionais, e estimulam a adição de novas habilidades.
