Sentencing the juvenile accused

Cassim, Fawzia 11 1900 (has links)
The abolition of corporal punishment in S v Williams and Others 1995 (3) SA 632 (CC) provided the state with the impetus to consider alternative sentencing options. Unsystematic efforts by the government to reform the juvenile justice system have failed abysmally. The government was forced to review its policies on juvenile sentencing. An examination of international trends reveals the imposition of stricter measures of punishment for serious and violent juvenile offenders. Community-based sentencing options are used mainly for first-time offenders. The focus has also shifted from punishment and retribution to prevention and treatment. It is advocated that serious and violent juvenile offenders be incarcerated in secure-care facilities and/or juvenile prisons and that community-based sentencing options be utilised for first-time offenders. The government should also design programmes that deal with situations that lead to crime and delinquency / Criminal & Procedural Law / LL.M. (Law)

Interações intersetoriais nas políticas públicas de apoio aos catadores: a atuação do Comitê Interministerial para Inclusão Social e Econômica dos Catadores de Materiais Reutilizáveis e Recicláveis (CIISC) entre 2008 e 2014 / Inter-sectoral interactions in public policies to support waste pickers: the work of the Inter-ministerial Committee for Social and Economic Inclusion of Waste Pickers (CIISC) between 2008 and 2014

Stella, Erica Aparhyan 11 April 2018 (has links)
This dissertation discusses inter-sectoral interactions in the formulation of policies by the federal government to support waste pickers occurring in the Inter-ministerial Committee for the Social and Economic Inclusion of Waste Pickers (CIISC) between 2008 and 2014. This analysis highlights the executive secretariat of this committee, as well as an important member: the Labor and Employment Ministry (MTE) that acted through its National Secretariat of Solidarity Economy (Senaes). In this respect, we made a historical reconstitution of CIISC from 2003 to 2015 based in documental analysis (legislation and government reports), in the related literature and in interviews with public managers made in the course of this research. Thus, this dissertation seeks comprehending influences and interactions between different federal agencies and entities that took part in CIISC, on federal public policies in support of waste pickers. In this regard, we analyzed both the coordination of this committee by its executive secretariat and its relations of collaboration, indifference and opposition that permeated its existence. We found that, in the midst of coordination and other interactions, the role of public managers was central, whose performance as bureaucratic activists was crucial for the inter-sectoral coordination in the formulation of policy to support waste pickers. It is then analyzed the different dimensions of this inter-sectoral articulations, as well as it is traced its limits in the formulations of federal policies of support to waste pickers. We found that exists some policies in support of waste pickers that, although relatively isolated, were internally formulated, financed and executed in an articulated manner, such that, despite not being capable of being described as a system, it is inadequate of being treated as punctual in spite of it frailties

Marthinus, Mercia 12 1900 (has links)
Thesis (MEd (Education Policy Studies))--University of Stellenbosch, 2005. / During his presidency, Mr Nelson Mandela could not emphasise enough the rights of children and the conditions of children and youth in detention. In his first opening speech of Parliament in 1994 he made it quite clear that the rights of children had to be prioritised. In May 1995, a year after the Government of National Unity came into power, Mr Mandela recommended that an Inter-Ministerial Committee for Youth at Risk should be appointed to draft an improved system for Child and Youth Care. With regard to children who are guilty of lawlessness, drug abuse, gangsterism and juvenile delinquency, Places of Safety occupy an important position in the South African education system. In this research I conclude that the biggest stumbling block for the effective application of moral education in Places of Safety could be attributed to the fact that children admitted to these places are hardened street children. They form a sub-culture on their own, who could easily be influenced by the group of whom they are part. The multi-disciplinary teams who are responsible for the moral education of these learners are not always adequately trained to handle their tasks effectively, and do not always realise the necessity thereof. The limited time that these learners/children spend at Places of Safety also has an influence on the effective application of their moral education. The programmes at Places of Safety are specifically designed to support the regeneration of morality for children who stray from accepted social norms and values of society. The National Institute for Crime Prevention and the Reintegration of Offenders (NICRO) has support structures in the community in places which support children and youth, who are guilty of unacceptable social behaviour, such as violent crimes, house burglary and rape. One may refer to support structures as diversion programmes, and they are managed by NICRO to support institutions that are currently working with persons in conflict with the law.

(1961-1972) / Strategy of the KMT government on Taiwan independence movement in the United States (1961-1972)

Unknown Date (has links)
(World United Formosans for Independence,W.U.F.I),將海外台獨運動帶入另一波新階段卻也是不爭的事實,如此之發展自然非國民黨政府所樂見。 / By criticizing the KMT rule in Taiwan, questioning the claim about Taiwan being retroceded to China, overseas Taiwan Independence Movement brings double challenges to the KMT government in Taiwan. In public, the KMT government always claims that the so-called “Taiwan Independence Movement” is just an absurd proposition claimed by merely a handful of people as well as a malicious scheme to separate Taiwan from the motherland, and participants in Taiwan Independence Movement are labeled as“seditious elements’’. However, overseas Taiwan Independence Movement grew rapidly in the 1960s. In the early 1970s, groups in the United States, Japan, Canada and Europe worked together to establish the “World United Formosans for Independence’’ (W.U.F.I), which brought overseas Taiwan Independence Movement to a new stage, a fact the KMT government doesn’t want to face. The strategies the KMT government, opposing any type of“Taiwan independence”adopts in response to the situation is a topic deserving in-depth study, and this thesis will focus on the case of the United States. This thesis consults materials such as the archives of the Ministry of Foreign Affairs, magazines, oral materials, memoirs and reminiscences of those who were involved in Taiwan Independence Movement. It resorts to a more systematic methodology to explore how the KMT government faces the challenges that the overseas Taiwan Independence Movement brings about. It attempts to uncover the strategies the KMT government adopts in different stages in the process of dealing with various actions launched by the activists. By analyzing the primary sources and focusing its perspective on events "outside the island ", this thesis not only gives an “official perspective” on the development of the overseas Taiwan Independence Movement, but also provides a more comprehensive viewpoint about the ruling mechanism of the KMT government in Taiwan.
