No. of bitstreams: 1 Fernando Tonet_.pdf: 2674901 bytes, checksum: 5355a634d5934bf7402eb53cefda2e0a (MD5) Previous issue date: 2018-10-17 / Nenhuma / A presente tese tem como objetivo apresentar à comunidade científica uma teoria geral do constitucionalismo sistêmico, partindo da análise dos novos modelos constitucionais desenvolvidos ao longo do incessante processo de globalização, que surge por meio do entrelaçamento comunicativo entre policontexturalidade, transconstitucionalismo e interconstitucionalidade, como uma observação e contribuição relevante às novas conotações das saliências existentes na dobradura do reflexo gerado pelas múltiplas culturas históricas de constitucionalidade, sob uma unidade sistêmica especializada. Existe uma delimitação estrutural e funcional que é exercida dentro desta unidade sistêmica específica (constitucionalismo sistêmico), que possui, também, uma semântica autopoiética de sentido. Tais aspectos são apresentados ao longo da presente pesquisa, desenvolvendo um aumento da capacidade de observação sistêmica, no sentido de que centro/periferia são (re)definidos operativamente, em um ultraciclo de comunicação. O método utilizado é o sistêmico autopoiético em um viés heterodoxo crítico, possibilitando, assim, uma nova configuração contemporânea de conceitos sistêmicos. Os resultados demonstram que as três formas constitucionais sistêmicas existem e são reflexivas em sua autopoiese. Porém, sem os aspectos conectivos do constitucionalismo sistêmico, são insuficientes para atender às expectativas normativas sociais isoladamente, necessitando de uma teoria geral para interconexão de seus objetivos e o aumento de sua capacidade de complexificação. / The present thesis aims to present to the scientific community a general theory of systemic constitutionalism, starting from the analysis of the new constitutional models developed throughout the incessant process of globalization, which arises through the communicative interweaving between polycontexturality, transconstitutionalism and interconstitutionality, as an observation and relevant contribution to the new connotations of existing projections in the folding of the reflex generated by the multiple historical cultures of constitutionality under a specialized systemic unit. There is a structural and functional delimitation that is exercised within this specific systemic unit (systemic constitutionalism), which also has an autopoietic semantics of meaning. These aspects are presented throughout the present research, developing an increase in the capacity of systemic observation, in the sense in which center / periphery are (re) defined operatively, in an ultracycle of communication. The method used is the systemic autopoietic in a critical heterodox bias, thus enabling a new contemporary configuration of systemic concepts. The results demonstrate that the three systemic constitutional forms exist and are reflexive in their autopoiesis. Without the connective aspects of systemic constitutionalism they are insufficient to meet social normative expectations alone, necessitating a general theory for the interconnection of their objectives and the increase of its capacity for complexity.
