Šiame magistriniame darbe autorius gvildena iki šiol teisinėje literatūroje mažai nagrinėtą elektroninių aukcionų temą. Ši tema nagrinėjama trimis aspektais. Pirmiausia, išnagrinėjami tradiciniai aukcionai, kaip e. aukciono pagrindas. Ištiriama aukcionų teorija, aukcionų rūšys, atsižvelgiama į tai kaip jie reglamentuojami Lietuvoje, išskiriami esminiai požymiai ir pagal juos atskleidžiama aukciono sąvoka. Sekančiame etape išnagrinėjamas e. aukciono, tradicinio aukciono ir e. komercijos santykis. Ištiriama, kuo pasižymi ir kokių ypatumu turi e. aukcionai, kokią įtaką jie daro teisiniams santykiams ir kaip juos keičia. Daug dėmesio skiriama ne tik teisės aktų analizei, bet ir teismų praktikai. Atsižvelgiama kokios bylos buvo nagrinėjamos pasaulyje, kokie sprendimai buvo priimti ir kas išdėstyta bylos argumentuojamoje dalyje. Pagal tai pateikiamos autoriaus rekomendacijos, kaip galėtų būti reguliuojama aukcionų veikla Lietuvoje. Galiausiai, nagrinėjamos teisės pažeidimų e. aukcionuose problemos. Darbe pateikiama teisės pažeidimų teorinė medžiaga, problemos aktualumas, bei pasaulyje vyraujantys įvairių įstaigų, įmonių ir organizacijų sprendimai šiai problemai spręsti. Atsižvelgiama į tai ar šie sprendimai galėtų būti pritaikyti Lietuvoje, kokios kliūtys iškyla jų įgyvendinimui ir kaip jas reikėtų panaikinti, koks turėtų būti valstybinis reguliavimas neteisėtoms veikoms užkirsti. Taigi, šis darbas yra vienas pirmųjų žingsnių į Lietuvoje dar naują ekonominio gyvenimo sritį... [toliau žr. visą tekstą] / This Master’s thesis is a research on the online auctions law. The paper consists of three parts. In the first part the author introduces traditional auctions as the basis of online auctions. There is the analysis of the auctions theory, regulation, essential features and clear definitions. In the second part comparative analysis is made on the traditional auctions and online auctions. A closer look reveals that there exist considerable differences that may cause legal controversy. Much of attention is paid to the court ruling in different law systems and countries such as Australia, Germany, UK, USA and etc. The last chapter of the work is designed for fraudulent activities in online auctions, and research of legal regulation solutions to dissolve it.

The Effect of Consumer Shopping Motivations on Online Auction Behaviors: An Investigation of Searching, Bidding, Purchasing, and Selling

The purposes of the study were to: 1) identify the underlying dimensions of consumer shopping motivations and attitudes toward online auction behaviors; 2) examine the relationships between shopping motivations and online auction behaviors; and 3) examine the relationships between shopping attitudes and online auction behaviors. Students (N = 341) enrolled at the University of North Texas completed self-administered questionnaires measuring shopping motivations, attitudes, online auction behaviors, and demographic characteristics. Using multiple regression analyses to test the hypothesized relationships, shopping motivations and shopping attitudes were significantly related to online auction behaviors. Understanding the relationships is beneficial for companies that seek to retain customers and increase their sales through online auction.

The aim of the thesis is the analysis of valid legal regulations in the area of consumer protection during internet trading. The introduction part deals with definitions of basic concepts as are consumer and his rights, consumer protection, activities of consumer protection organizations and definitions of electronic business and internet trading etc. The basis of the thesis is the analysis of intrastate, European and international legal regulations which concern the given issue. The emphasis is, above all, put on those rights and duties which are applied mostly by internet business users. The work also deals with the process of contracting on the internet. Particularities of e-contracting have an important influence on the validity of transactions and primarily on the moment of contraction. The last part deals with internet auctions, which are gaining popularity, and thus consumers protection is also a current issue. Room for evaluation of legal preparedness in the area is given to within the whole thesis.

Bayesian Inference in Structural Second-Price Auctions

The aim of this thesis is to develop efficient and practically useful Bayesian methods for statistical inference in structural second-price auctions. The models are applied to a carefully collected coin auction dataset with bids and auction-specific characteristics from one thousand Internet auctions on eBay. Bidders are assumed to be risk-neutral and symmetric, and compete for a single object using the same game-theoretic strategy. A key contribution in the thesis is the derivation of very accurate approximations of the otherwise intractable equilibrium bid functions under different model assumptions. These easily computed and numerically stable approximations are shown to be crucial for statistical inference, where the inverse bid functions typically needs to be evaluated several million times. In the first paper, the approximate bid is a linear function of a bidder's signal and a Gaussian common value model is estimated. We find that the publicly available book value and the condition of the auctioned object are important determinants of bidders' valuations, while eBay's detailed seller information is essentially ignored by the bidders. In the second paper, the Gaussian model in the first paper is contrasted to a Gamma model that allows intrinsically non-negative common values. The Gaussian model performs slightly better than the Gamma model on the eBay data, which we attribute to an almost normal or at least symmetrical distribution of valuations. The third paper compares the model in the first paper to a directly comparable model for private values. We find many interesting empirical regularities between the models, but no strong and consistent evidence in favor of one model over the other. In the last paper, we consider auctions with both private-value and common-value bidders. The equilibrium bid function is given as the solution to an ordinary differential equation, from which we derive an approximate inverse bid as an explicit function of a given bid. The paper proposes an elaborate model where the probability of being a common value bidder is a function of covariates at the auction level. The model is estimated by a Metropolis-within-Gibbs algorithm and the results point strongly to an active influx of both private-value and common-value bidders. / <p>At the time of the doctoral defense, the following papers were unpublished and had a status as follows: Paper 1: Epub ahead of print.
