Muito embora elevados ? categoria de direitos constitucionais, esses direitos sociais dos trabalhadores t?m na interpreta??o judicial dos elementos caracterizadores do v?nculo empregat?cio, por vezes, um descompasso com o ordenamento jur?dicoconstitucional, quando, ao decidir, n?o ponderam tais elementos, ocasionando preju?zos econ?micos e sociais para todos os trabalhadores, afetando, portanto, o pr?prio fundamento constitucional de prote??o do trabalhador, havendo, portanto, situa??es nas quais deve haver parcela de indisponibilidade dos direitos por parte do empregado. Diante disso, identificar os elementos caracterizadores do v?nculo empregat?cio significa possibilitar a imediata constata??o jur?dica acerca de eventual ilegalidade perpetrada pelo empregador, justamente pelo fato de a senten?a que o reconhece ser meramente declarat?ria, observando, portanto, com os elementos que comp?em o sistema jur?dico-normativo de modo a se estabelecer a caracteriza??o do v?nculo empregat?cio em compasso com a efetiva observ?ncia e garantia dos direitos sociais e, portanto, limitador da atua??o do empregador no que pertine ? contrata??o e dispensa do empregado. Este ponto ? que se tem como elemento principal deste trabalho, o que ? ponto fundamental da exegese da tem?tica para se limitar ? autonomia da vontade. N?o se nega, pois, a necessidade de se estender os efeitos dessas garantias decorrentes do contrato de emprego. ? nesse contexto, portanto, que saltam as garantias do trabalhador, consubstanciadas, em especial, na Consolida??o das Leis do Trabalho, e, principalmente, na Constitui??o Federal e nos instrumentos internacionais de prote??o para garantir o direito fundamental a uma rela??o de emprego protegida, na qual o avan?o tecnol?gico, social e econ?mico reflete diretamente, a exemplo da parassubordina??o, e que reclama resolu??es cada vez mais sistem?ticas, especialmente quando se evidenciam as lacunas axiol?gicas, as quais elevam o debate acerca da necessidade de uma utiliza??o crescente dos precedentes jurisprudenciais de forma a amparar as decis?es judiciais, muitas vezes eivadas de aspectos de inconstitucionalidade, tudo em observ?ncia ? integra??o das normas, buscando a efetiva??o jur?dica desse v?nculo e propiciando seguran?a jur?dica, da? surgindo, portanto, a ess?ncia do tema: discutir at? que ponto a descaracteriza??o do v?nculo empregat?cio limita a efetividade dos direitos sociais e quais seus efeitos jur?dicos, uma vez que a norma constitucional relativa ?s garantias sociais protege de igual forma a admiss?o do trabalhador. / The Federal Constitution, in Article 1, sections III and IV, lifted the work as the foundation of the Federative Republic of Brazil, including work as a social guarantee in Article 6, listing in its Article 7 minimal guarantees role with respect to social rights of workers. Although elevated to constitutional rights, these social rights of workers have in the judicial interpretation of the characteristic elements of the employment relationship, sometimes a mismatch with the legal and constitutional order, when, in deciding not ponder such elements, causing damage economic and social benefits to all workers, thus affecting the very constitutional basis of worker protection, there is therefore situations in which there must be part of unavailability of rights by the employee. Therefore, identifying the characteristic elements of employment, means allow immediate legal finding about possible illegality perpetrated by the employer, precisely because the sentence recognizes be merely declaratory noting, therefore, the elements that make up the juridical system normative in order to establish the characterization of employment in step with the effective observance and guarantee of social rights and therefore the employer's performance limiter as pertains to hiring and employee dismissal. This point is it's main element of this work, which is fundamental for the exegesis of the theme to limit the autonomy of the will. There is no denying, therefore, the need to extend the effects of these guarantees in the employment contract. In this context, therefore, jumping the guarantees of employees, embodied in particular in the Consolidation of Labor Laws, and especially in the Federal Constitution and international protection instruments to ensure the fundamental right to secure employment relationship, where technological advancement, social and economic, reflect directly, such as the parassubordina??o, and claiming more and more systematic resolutions, especially when evidence gaps' values, which elevate the debate about the need for increased use of precedents of order to support the judgments, often beset with aspects of unconstitutionality, all in compliance with the integration of standards, seeking legal enforcement of this bond and providing legal certainty, there emerged, so the essence of the theme: discuss to what extent the distortion of employment limits the effectiveness of social rights and what its legal effects, since the constitutional standard for social guarantees protects equally worker admission.
