How to conduct e-mail reviews in GermanyWybitul, Tim 09 March 2016 (has links) (PDF)
Information from business emails is often very important for investigating breaches of rules or for court proceedings. However, strict legal requirements apply to the analysis and inspection of emails. The following overview sets out these requirements and describes the risks resulting from failure to comply with them, while focusing primarily on more recent
court rulings. The article also shows how employers can effectively mitigate or avoid legal risks when monitoring emails. One of the main focuses of the overview is on recommended actions to take in practice and a checklist for preparing for and implementing access to business email accounts.

The Methodics of Investigation of the Sexual Crime Acts (chosen issues) Summary This submitted diploma thesis deals with procedures of investigation of crimes rape and sexual abuse, which are two most serious offences within sexual criminal acts. In this work I analyze only some of the most essential moments of investigation, because the theme as a whole exceeds the required extent of the diploma thesis. Most attention is paid to contacts of the prosecuting and adjudicating bodies with the victim and to the acts in which the victim is involved. The introductory part analyzes basic contemporary and previous legal regulation of all sexual criminal acts given in the present criminal codes. Offences of rape and sexual abuse are explicated in more detail. Then the work brings a criminalistic characteristics of these offences with basic statistical data. It points out the fixed detection rate of these crimes over the last nine years. Within the criminalistic characteristics, the thesis shows typical ways of committing these crimes, typical offenders, victims and typical traces. It points out that most offenders committing rape and sexual abuse come from the backgrounds close to the victim. The work discusses the approach to the victims of rape and sexual abuse. It analyzes the reasons that lead to secondary...

Metodika vyšetřování vražd /vybrané problémy/ / Methods of investigation of murders (selected issues)Kofránková, Helena January 2011 (has links)
The subject of this diploma thesis is "Methodology of Murder Investigation (Selected Problems)". Because this is a very wide subject, it is not within the diplomate's reach to cover the matter completely enough for a diploma thesis and the thesis therefore focuses on the methodology of the investigation of serial murders. The first chapter is devoted to defining the term "serial murder" and the differentiation between serial, mass and spree killers is explained. The legal classification of serial killing within Czech criminal law is briefly outlined. The second chapter focuses on criminal character. It examines the typical characteristics of serial killers, their biological and social preconditions, the psychology behind a first murder and the profile of the serial killer. Further, the separation of serial killers into the organized and unorganized is shown, including characteristic features. From the perspective of criminal characterization, the work further discusses victims of serial killings, with an emphasis on themes of the methods of perpetration. Within this, differences between the terms ‚modus operandi' and ‚signature' are explained. The individual phases of killing are determined. Murder weapons, as well as classifications of the scenes of crimes and serial killers according to mobility...

Metodika vyšetřování trestného činu znásilnění /specifické problémy/ / Methodology of investigation of rape (specific issues)Šandová, Marcela January 2014 (has links)
Resume This thesis called Methodology of rape investigation (specific issues) is focused on problems with rape investigations, special attention is paid to treatment of authorities (and other persons) with victims in criminal proceedings. The reason for my choice of this theme is the lack of attention given to this topic (particularly handling with victims). Although in the last few years the situation is getting better, the specific investigating problems remain. The thesis is divided into five chapters, first two of them are more theoretical, other sections are rather practical and are based on my own empirical research from court cases which I have studied. Chapter One deals with the criminal view of rape, especially history of rape and legal definitions in Czech statutes. The next part of the chapter is focused on criminological aspects of this crime, i.e. possible causes of rape, typology of offenders and victims, definition of secondary victimisation etc. Chapter Two is about methodology of rape investigation, and is specialized on the most frequent investigating acts connected with rape, i.e. interrogation, examination of victim's body, crime scene examination, genetic expert opinion, psychiatric expert opinion etc. The end of the chapter reveals myths associated with rape. Next chapter is based on...

Cizojazyčné resumé The theme of this diploma thesis is the methodology of the investigation of sexual crimes and its selected issues. Given the large of this topic, I decided to focus only on methods of rape investigation, as a typical represenstative of this group of sexual crimes. The main objective is to identify the problems in the procedure of understanding and investigation. It focuses on the selected specifics which I attent to analyze and evaluate the current legal regulations. To clarify such a large topic, the thesis is divided into seven chapters. The introductory chapter deals with the current legislation of the rape and its historical evolution since the feudal period. This charter compares the Czech legal systém with foreign legal systems. The second chapter provides the statistical data and the typical criminalistics ways of committing this crime which is divided according to committting by adults and committing against children and adolescents. The third chapter deals with the rape from the criminological perspective and decribes the offender and the victim, their characteristics and presents typical characteristics on the case studies. Charles University in Prague Faculty of Pharmacy in Hradec Králové Department of Biochemical Sciences Candidate: Bc. Jana Stehnová Supervisor: Prof. MUDr. Jaroslav Dršata, CSc. Consultant: MUDr. Mgr. Sylvie Špitálníková, Ph.D. Title of diploma thesis: Laboratory investigation of thyreoidea in pregnancy Thyroid diseases are very common in the Czech Republic. It is reported that up to 46% of the population suffer with thyroid diseases. Women are afflicted with the desease 4 to 8 times more often than men, and particularly in pregnancy, hormones of the thyroid gland play an important role in developing, maintaining and progress of pregnancy. In this work, we focused on creating the reference intervals for TSH, fT4 and antiTPO in the first trimester of pregnancy, which are recommended as the main markers of thyroid assessment of thyroid function during pregnancy. Reference intervals created by us were compared with the recommended reference intervals of the supplied Roche diagnostics. Our reference file was compiled from a group of 81 pregnant women and divided into individual weeks of the first trimester (weeks 11, 12 and 13). Reference intervals were calculated according to the recommendation, such as 2.5th and 97.5th percentile of our reference group for each week and then the resulting average...
