A criminological analysis of the transfer of juveniles to adult correctional centre

Many young people in South Africa are involved in crime, especially violent crime. This statement is supported by statistics obtained from the Annual Report (2013:37) of the Judicial Inspectorate for Correctional Services which indicates that 26 282 young people were serving sentences in South African Correctional Centres at the end of the 2012/13 financial year. This annual report of the Department of Correctional Services (2013:13) indicates that at the time of the report, 11 000 offenders were sentenced to life imprisonment and a third of them were youth offenders. The majority of these young people have to be transferred from juvenile facilities to adult centres to continue their incarceration when they turn twenty one. This transition holds a number of challenges, both for these young people and the Department of Correctional Services. Young people are confronted with the reality of possibly falling victim to HIV/AIDS, gangs, sodomy and rape in overcrowded, adult correctional facilities. The Department of Correctional Services encounters problems in assisting these young people to adjust to this transition and the protection of these young people from assault and abuse by older inmates remains an institutional concern. The main aims of this research are to examine: the age at which juveniles are transferred to adult correctional centre to continue with their sentences; the factors taken into account before transfer; the challenges faced by youth offenders in adult correctional centre; and the needs of youth offenders in adult correctional facility. The study addresses the following questions: • At what age are youth offenders transferred to adult correctional centre? • What other factors besides age are considered before youth are transferred to adult correctional centre? • Are there any preparatory measures in place to assist youth with the transfer? • Are there any induction programmes available to assist youth adjusting in adult correctional facility? • What are the challenges faced by youth in adult facility? • What are the needs of youth offenders in adult facility? / Criminology and Security Science / M.A. (Criminology)

Pois, mesmo diante das normativas do Estatuto da Criança e do Adolescente e do Sistema Nacional de Atendimento Socioeducativo, que apontam para a internação somente em último caso, as instituições socioeducativas de privação de liberdade se consolidaram no país e em maior número no estado de São Paulo. Desse modo, a presente pesquisa teve como objetivo trazer o perfil, a trajetória e as representações dos jovens egressos das unidades socioeducativas da Fundação CASA, sobre o período de cumprimento da medida de internação e da medida socioeducativa em meio aberto de Liberdade Assistida. Como conclusões, a pesquisa aponta que as práticas da antiga FEBEM, ainda permanecem vigentes no cotidiano das unidades masculinas e femininas da Fundação CASA e nas representações dos jovens sobre a instituição. Quando em liberdade, a medida socioeducativa de internação amplia o status positivo dos jovens frente ao crime e o status negativo frente à instituição escolar e ao mundo do trabalho. E, a medida de LA que poderia vir a possibilitar a vivência de outras trajetórias para os jovens inseridos nas medidas socioeducativas, vem se constituindo como uma ampliação da pena, que aumenta a possibilidade de reincidência e de institucionalização. / The Brazilian childcare system has experienced significant growth in the number of young people fulfilling educational measures commital. As even before the regulations of the Statute of Children and Adolescents and the National Socio-Educational Services System, which point to the commital only in the latter case, the socio-educational institutions of deprivation of liberty were consolidated in the country and in greater numbers in the state of São Paulo. They can, this research aimed to bring the profile, the trajectory and the representations of young egression of social and educational units of the CASA Foundation, over the period of performance of the detention procedure and socio-educational measures in freedom of probation. As conclusions, the research shows that the practices of the former FEBEM, still remain in force in the daily lives of male and female units of the CASA Foundation and representations of young people on the institution. When released, the socio-educational measure of commital increases the positive status of young people against the crime and the negative status front of the school and the world of work. And the measure of probation that it could enable the experience of other paths for young people entered the educational measures, is becoming as an extension of the sentence, which increases the chance of recurrence and institutionalization.

Youth resilience in the face of violence : an educational perspective

M.Phil. / This is a study that seeks to understand what makes two children raised in the same crime and violence ridden environment grow to be different, one actually becoming angry and resentful and thus ending up in prison, having committed serious crime, the other one transcending his adversity and becoming an admirable leader in his community. The exploration of contributory factors, leading young people to get involved in violent behaviour is examined and protective elements in the social environment that enabled those to transcend their adversity are also explored. The stories of juvenile prisoners about their lives provide insight into how the family prepares the ground for violent behaviour. The study found from focus groups with high school learners that inner strength, positive self- esteem and focusing on target goals play a critical role in helping young people overcome their challenges, this confirms earlier research in longitudinal studies. The findings will help in the development of intervention programmes based on the experiences of the South African youths. It is also envisaged that this will enable the voices of young people to be heard.
