Ce mémoire vise à circonscrire la notion de terrorisme en droit international humanitaire, qui interdit le terrorisme de façon inconditionnelle et absolue dans un contexte de conflit armé, et à déterminer si la violation de cette interdiction constitue un crime de guerre. Dans la mesure où il s'agit d'un crime, il importe d'en cerner les éléments constitutifs. Cet exercice nous permettra non seulement d'éclaircir l'état du droit concernant ce crime de guerre, mais également de jeter les bases d'une éventuelle définition de ce même crime commis en temps de paix ou comme crime contre l'humanité. / The purpose of this thesis is to examine the notion of terrorism in international humanitarian law, which prohibits unconditionally this method of war in a context of armed conflict, and to determine if a violation of this prohibition can constitute a war crime. If it is indeed a crime, it becomes important to determine its constitutive elements. This exercise will allow us to highlight the state of the law concerning this war crime, but also to draw the lines of a future definition of this crime when it is committed in peacetime or as a crime against humanity.
