Aubé, Erwan 20 December 2013 (has links)
The crossover study of insurance and civil liability related to faulty products yields an analysis of the specific provisions set down in articles 1386-1 and the following of the Civil Code along with the different principles of civil liability that they complete and the specificities of insurance law. The coherence of the new set of provisions recently added to the Civil Code is thus considered through a more precise outlining of their implementation and by examining, within the light of case law, the possible extensions of their scope of application. The implementation of these new provisions has been a source of uncertainty, regarding the proof a product's safety defect or compliance with delays imposed by the legislator. In a correlative manner, the application of measures specific to insurance law require that a number of demands be met, relative to the notification of a claim or the compensation methods used by the insurer.

Legal Liability of U.S. Credit Rating Agencies under Section 11 of the Securities Act: The Long and Winding Road toward Accountability

Sisi , Zhang 31 December 2010 (has links)
This paper argues that credit ratings have contributed to the current financial crisis. In United States, the previous “reputational model” as well as the current proposals aimed at reducing reliance on rating agencies, enhancing competition and increasing transparency is not sufficient to improve the integrity of rating agencies. This paper suggests that imposing stricter liability on rating agencies is necessary. The proposal to eliminate the exemption of NRSROs under Section 11 of the Securities Act is necessary but not sufficient for holding rating agencies accountable. The first amendment defense always shields rating agencies from legal liability, while the absence of a common standard make it hard to impose liability for negligent ratings. Finally, this paper suggests that the courts should not award the rating agencies First Amendment protection and consider the distinguished characteristics of rating agencies, when examining the professional liability of the agencies.

International product liability law and uniform sales law

Sewerin, Diana. January 2000 (has links)
Any contract for the sale of goods between international commercial traders may be subject to the U.N. Convention on Contracts for the International Sale of Goods (CISG). If a buyer suffers damages as a result of a breach of contract, she is entitled to damages under the Convention. The issue in this thesis is whether a buyer may also invoke product liability actions under national tort law if a defective good causes bodily injury or property damage. The provisions of the CISG generally displace national law governing the rights and obligations deriving from a contract of sale. Despite the desirability of removing the uncertainties of foreign liability regimes from international trade, domestic rules of product liability remain, in general, applicable. Only if national tort actions interfere with the core of the Convention's liability regime, must the domestic law be modified.
