This diploma thesis deals with problems of misusing of company computers by employees. Specifically describes the factors affecting computers misuse, various forms of its misuse and protections against its misuse, the impact on employers and related regulations. The thesis also outlines possible ways how to control employees and penalties for computer misuse. Thesis tries to provide some recommendations for regulation of using of company computers and also an estimation of future development.

THE SHARING ECONOMY AND DIGITALIZATION: CHALLENGE FOR COMPLEX MODIFICATION OF LABOR LAW? ABSTRACT This diploma thesis discusses the phenomenon of last decade called sharing economy, which has many different forms and names. In its purest meaning, the sharing economy concerns behavior of economically active entities that, in order to reduce their own costs or to use their spare capacity, share free resources. As the best examples of sharing economy, we can name capital platform Airbnb, where people share their unused immovable in order to generate profit or work platform BlaBlaCar trough which people reduce their car costs while travelling one-off long-distance trips. However, as mentioned above, sharing economy has many different forms. One of them, which cannot be recognized as its pure form, is provided by Uber. Uber, as well as BlaBlaCar, created mobile platform trough which providers of transport services can get in touch with users of these services. Despite this similarity, there are several significant differences from which one can conclude that Uber is not a classic provider of information technology services, such as BlaBlaCar. The title of my diploma paper is summing up of state employment policy in the Czech Republic, on the current applicable legislation. And it take into account the active employment policy and passive employment policy. The purpose of the paper is to create a compact image of labour market in the Czech Republic. This paper chart unemployment in southern Bohemia, in the Písek region gives to understand that authoress will occupy with the unemployment problems of the Písek region. My survey is based on the data from Labour Market Situation Report from several Bureaus of Labour, data from Czech Statistic Office and Ministry of Labour and Social Issues. The practical part of the theses covers the situation on the labor market in Písek region. The second part of this thesis includes a possible solution for solving unemployment, active employment policy and passive employment policy. This is a sample illustration creation of project design which concentrates on employment support by means of a new requalification program for long-term unemployed people, in the concrete this employment policy of the Písek employment bureau. This one project, the function and principles of the regional and structural politics of the European Union, financed of European Social Fund.

The topic of this diploma thesis is Temporary agency work in the Czech Republic. Diploma thesis is logically divided into two main parts. The first part is predominantly theoretical. Within this topic the basic definitions and its mutual relationship are analyzed in detail. The thesis is mainly focused on analysis of current legislation and its history from 2004 till present. The second part of the diploma thesis is based on the survey published through questionnaire. The questionnaire has logical structure and therefore it is possible to deduce the position and experience of the respondents with the held topic. In conclusion, there are proposals to improve the current regulation of temporary agency work which could contribute to an increase of positive attitudes towards agency employment in the Czech Republic.

PERFORMANCE OF DEPENDENT WORK THROUGH DIGITAL PLATFORMS ABSTRACT This thesis discusses the issue of work performance through digital platforms, especially regarding whether it is possible to classify such activity as "dependent work", particularly with regard to the laws of the Czech Republic. The thesis responds to the current legal "vacuum" surrounding the performance of work through digital platforms and the legal status of persons who perform such activity (referred to in the thesis as workers). The mentioned legal "vacuum" stems primarily from the absence of sufficient legal regulation in the given area and the "unconventionality" of such a way of performing work. Digital platforms describe their workers as independent entrepreneurs, and this practice is quietly tolerated by the Czech Republic (e. g. administrative authorities). However, there can be more than reasonable doubts about the veracity of such proclamation. Therefore, the thesis firstly analyzes the characteristics and conditions of dependent work according to the laws of the Czech Republic, which are then applied to the reality of the performance of work through digital platforms. Thesis title: The responsibility of an employee for damage The subject of the thesis is the responsibility of an employee for damage. The thesis offers in the first place a comprehensive summary of the current legislation of the topic. The main purpose of the thesis is to summarize the legislation of the labor- law and of the employee`s responsibility for any damage done to the employer where for this purpose there are analyzed particular sorts of the responsibility distinguished by the Labor Code. In details there are described first of all specific conditions that must be fulfilled to claim the responsibility on the employee for the damage, the possibility of the employee to disclaim it is not neglected either. The thesis focuses on the main differences that distinguish the particular sorts of the responsibility from each other. An attention is given to the links between labor law and other legal codes, especially the civil one where the connection is the closest whereas the understanding of this mutual relation is very essential to understand the stated topic. Les effets du régime des services essentiels sur la négociation collective : études de cas dans les secteurs du transport en commun et de la santé et des services sociaux

Au Québec, les négociations collectives dans les secteurs public et parapublic ainsi que dans les services publics sont assujetties aux règles du Code du travail (L.R.Q. C.-27). Certains secteurs dispensant des services dits essentiels, comme le transport en commun et le secteur de la santé et des services sociaux, ont à respecter des règles particulières, différentes de celles des autres secteurs assujettis au régime général édicté par le Code. Ces règles particulières constituent ce qu’on appelle le régime des services essentiels. Les négociations dans les services essentiels comportent des particularités importantes – considérations politiques et absence de substituts des services publics pour la population – qui les distinguent de façon notable des négociations qui se déroulent sous l’égide du modèle général de négociation collective édicté au Code et applicable dans les autres secteurs (Bergeron et Paquet, 2006). Quels sont les effets du régime des services essentiels sur la négociation collective dans le secteur du transport en commun et de la santé et des services sociaux? Dans le cadre de cette recherche, nous avons examiné les effets du régime des services essentiels (les règles du Code du travail et les décisions du Conseil des services essentiels) sur différents aspects de la négociation collective : 1) la mobilisation, 2) le rapport de force, 3) les moyens de pression, 4) le déroulement des négociations, 5) l’arrêt de travail, 6) les résultats de la négociation collective et 7) le climat de travail. Afin d’étudier ces négociations atypiques dans notre système de relations industrielles, nous avons réalisé deux études de cas (secteur du transport en commun et secteur de la santé et des services sociaux). Les résultats indiquent bien que le régime des services essentiels influence le processus de négociation collective dans ces secteurs. Par contre, la comparaison des deux secteurs montre que les règles additionnelles auxquelles est assujetti le secteur de la santé et des services sociaux n’apparaissent pas affecter de façon déterminante le processus de négociation collective. / In Québec, collective bargaining in the public sector is to follow the rules established by the Labour Code (L.R.Q. Those rules are referred to as the essential services legislation. Negotiations occurring within this structure have noticeable differences - the exclusion of political considerations, on the one hand, and the lack of a replacement for public services for the public, on the other hand – that distinguishes them from the more common framework of collective bargaining established by the Labor Code for other sectors of activity (Bergeron et Paquet, 2006). We ask the question: what are the impacts of the essentials services legislation on collective bargaining? For this research project, we have analysed the impact of the essential services legislation (rules by the Labor Code and decisions rendered by the Essential services board) on different aspects of collective bargaining: 1) mobilization, 2) power bargaining, 3) pressure tactics, 4) flow of negotiation, 5) work stoppage, 6) results of collective bargaining and 7) work climat. We carried out two case studies in order to study the atypical negotiations in our industrial relations system. The first study was in the public transit sector and the second in the health and social services sector. The results demonstrate that the essential services legislation influences collective bargaining. But the additional constraints in the social services sector do not seem to influence, on a larger scale, the collective bargaining for that sector of activity.

1 Abstract and keywords in the English language Comparison of Czech and Slovak legal regulation of leave Abstract The dissertation contains an overview of labor law legislation, especially the regulation of holidays, in the territory of historical Bohemia, Moravia and Silesia on the one hand and in the territory of today's Slovakia on the other hand. For a better understanding of the issue, an overview of the development of working conditions and labor protection in a given time context in both cultural areas is also provided. I believe that the presented comparison of legal regulations in both territories is an interesting excursion not only in terms of labor law itself, but also in the field of legal history. I believe that in the presented summary of the work it provides important and interesting expanding knowledge in the field of labor law and social security law. In my opinion, similar work was lacking in our market, and therefore it can be assumed that in this direction it will contribute to its enrichment if it is possible to realize its book edition, which is under negotiation. An overview of the material described above is given in twelve chapters since the beginning of the 14th century, when labor relations developed in the Czech lands, about which written reports already exist.
