La thèse a pour sujet la green economy dans le droit de l’Union européenne et se centre sur l’analyse d’un thème qui a été abordé au niveau juridique ces derniers temps. Partant, l’objectif de la recherche vise à délinéer un cadre juridique pour la green economy par rapport à l’Union européenne, en étudiant la signification de ce terme, en en identifiant les liens avec le droit primaire de l’Union, en examinant la façon dont l’Union utilise son droit (dérivé) pour favoriser la transition vers une green economy et enfin, en imaginant des scénarios juridiques (probables ou souhaités) susceptibles de se manifester en vertu de la prise en compte des exigences de la green economy par l’Union européenne. / The subject of the thesis is the green economy within European Union (EU) Law; the research thus deals with a theme which started been considered only recently. Therefore, the main purpose of the thesis is to define a juridical framework for the green economy within the EU, by studying the meaning of this concept, identifying links with the EU primary Law, examining the way the EU uses its (secondary) law to boost the transition to such model, and prospecting possible (or desirable) scenarios which might appear as a consequence of the taking into consideration of the green economy by the EU itself.

Along with the Environmental Law, the Legal Reserve - in order to fulfill the Property Social Role ¿ allows rural landowners to make good use of natural resources and still preserve the environment in a rational way, besides providing shelter for the native flora and fauna of the region where it is located. Among important legal and environmental functions to the efficiency of environmental preservation, the lack of incentives ¿ which benefit rural producers from voluntarily establishing the institution of Legal Reserve ¿ is one of the factors that prevent an environmental reserve from existing in the majority of the rural properties within the national territory. Thus, it is essential that producers and people in general realize the importance of the Legal Reserve in rural properties, where the natural resources are preserved for present and future generations of Brazil. / Este estudo trata a Reserva Legal como um dos componentes mais importantes para a preservação dos recursos naturais de nosso país. Engajada ao Direito Ambiental, para cumprir com a função Social da Propriedade, a Reserva Legal permite que o proprietário rural usufrua dos recursos ali presentes e ainda preserve o meio ambiente de forma racional ¿ além de proporcionar abrigo para a flora e fauna nativa da região em que a mesma se encontra. Em meio a funções ambientais e jurídicas importantes para que a preservação do meio ambiente seja eficaz, a falta de incentivos que beneficiem o produtor rural para implantar, de maneira voluntária, a instituição da Reserva Legal é um dos fatores que impedem atualmente que haja uma reserva ambiental na maioria das propriedades rurais existentes no território nacional. Desta forma, é imprescindível que os produtores e as pessoas em geral percebam a importância da Reserva Legal na propriedade rural, onde os recursos naturais sejam preservados para as gerações presente e futura de nosso país.

The definition of the environment and the evolutionary steps that trod International Environmental Law, an indication of its key moments, while defining standards, treaties and conventions on environmental protection, as it is known, are topics discussed throughout this dissertation. The issue of international trade, specifically the importation of plants and seeds and rules that this activity is submitted, according to the Brazilian legislation, based on the determinations of the United Nations is also an integral part of this job. / O Direito Internacional Ambiental, a sua evolução e os momentos mais marcantes, no que à elaboração de normas e princípios base diz respeito enquanto ramo do Direito Internacional Público, tem conhecido uma evolução nos últimos anos, sobretudo devido à cada vez maior atenção que a temática ambiental vem ganhando no mundo, seja porque as condições ambientais se têm deteriorado a cada ano que passa, seja porque existe uma maior consciência de que é necessário tomar precauções para que se possa remediar o que já foi feito de errado e prevenir o futuro. A definição de meio ambiente e os passos evolutivos que o Direito Internacional Ambiental trilhou, a indicação dos seus momentos chaves, enquanto definidor de normas, Tratados e Convenções na defesa do meio ambiente, tal como se conhece, são temas abordados no decorrer desta dissertação. A questão do comércio internacional, mais concretamente a importação de plantas e sementes e as regras que essa atividade está submetida, em função da legislação brasileira, com base nas determinações das Nações Unidas é também parte integrante deste trabalho.

The role of legal frameworks in enabling transparency in water utilities' regulation

This thesis evaluates transparency in the context of water utilities’ regulation by comparing legal frameworks in three jurisdictions: Victoria (Australia), England (United Kingdom) and Jakarta (Indonesia). Each of these jurisdictions is selected because of their particular ownership and regulatory model. The thesis analyses whether specific ownership or regulatory models will have implications for transparency. The terms “transparency” and “water utilities’ regulation” are first defined and form the thesis’ analytical framework. This is then applied against the three jurisdictions compared. By evaluating each of the three jurisdictions, the thesis expects to provide explanation on how transparency is enabled or inhibited by the legal frameworks. The thesis recommends a solution by comparing the three jurisdictions and generating “lessons learned”.

Německý daňový systém / German tax system and its consequential obligations for the Czech exporters

The topic of this master thesis is the German tax system which is a relatively complicated entity. The aim of this thesis is to provide the updated and practical information useful for the Czech exporters and for their business activities in Germany. The thesis consists of five chapters. The first chapter describes the main export features from the Czech Republic to Germany. Next chapter analyses the different legal forms of companies that can be set up in Germany. The third chapter presents the process of the tax harmonisation and co-ordination within the EU. Next two chapters create the practial part of the master thesis. Particular types of both direct and indirect taxes are object of the fourth chapter. Finally, the last chapter applies the theoretical knowledge gained from the previous parts of the thesis in form of examples and situations from the tax practice and real business life of the entrepreneurs who export their goods and services to Germany.

The environment, intergenerational equity & long-term investment

This thesis brings together two responses to the question ‘how can the law extend the timeframe for environmentally relevant decision-making?’ The first response is drawn from the context of institutional investment, and addresses the timeframe and breadth of environmental considerations in pension fund investment decision-making. The second response is related to the context of public environmental decision-making by legislators, the judiciary, and administrators. Three themes underlie and bind the thesis: the challenges to decision-making posed by the particular temporal and spatial characteristics of environmental problems, the existence and effects of short-termism in a variety of contexts, and the legal notion of the trust as a means for analysing and addressing problems of a long-term or intergenerational nature. These themes are borne out in each of the four substantive chapters. Chapter III sets out to demonstrate the theoretical potential of pension funds to drive the reduction of firms’ environmental impact, and, focusing particularly on the notion of fiduciary duty, explores the barriers that stand in their way. Chapter IV provides a practical application of the theoretical recommendations outlined in its predecessor. It provides a framework outlining how pension funds might implement a longer term, more sustainable approach to investing. The second half of the thesis, operating in the context of public environmental decision-making, is centred upon a particularly poignant legal notion with respect to the environment and time: the concept of intergenerational equity. Just as the first half of the thesis deals with the timeframes relevant to investment decision-making by pension funds within the bounds of fiduciary duty, largely a private law affair with public implications, the second half of the thesis is concerned with the principle of intergenerational equity as a means for extending the decision-making timeframe of legislative, judicial and administrative decision-makers. As previous analyses of the concept of intergenerational equity provide little insight into its practical implications when applied to particular factual situation, Chapter V sets out the structure of the principle of intergenerational equity as revealed by case law. Chapter VI brings together the issues from the first three papers by conceptualising intergenerational equity in resource management as an issue of long-term investment. Long-term environmental decision-making faces many obstacles. Individual behavioural biases, short-term financial incentive structures, the myopic pressures of the electoral cycle and the tendency of the common law to reinforce the (often shorttermist) status quo all present significant barriers to the capacity of both private and public decision-makers to act in ways that favour the longer term interests of the environment. Nonetheless, this thesis argues that there is reason for hope: drawing upon the three themes that underlie all of the substantive Chapters, it articulates potential legislative changes and recommends the adoption of particular governance structures to overcome barriers to long-term environmental decision-making.
