O presente trabalho tem como objetivo demonstrar como a atual legislação de tratamento do trabalhador imigrante fornece elementos que constroem a figura de um ideal de imigrante qualificado. O recorte analítico privilegia o período a partir do ano de 1980, ano este em que a Lei nº 6.815 foi estabelecida, até 2014, momento ainda de vigência da Lei e ano de apresentação deste estudo. Traça, inicialmente, um panorama do contexto migratório internacional para o Brasil sob a ótica da imigração qualificada para o trabalho, detectando as origens do processo imigratório de trabalhadores em seus aspectos históricos. Em seguida, apresenta evidências historiográficas como as principais orientações da legislação imigratória brasileira voltada para o trabalhador imigrante, até os anos 1980, destacando ao longo dos anos o estabelecimento de perfis imigratórios desejáveis, bem como a criação do Estatuto do Estrangeiro, também em 1980. Analisa a construção da figura do imigrante qualificado na perspectiva do Estatuto, e no Projeto de Lei 5.655/09.Por fim, neste estudo pode-se perceber que o Estado constrói e difunde, de modo vertical e unilateral, na legislação imigratória brasileira, atributos - muitos deles estereotipados - que devem ter o trabalhador imigrante. Aquele que detém alguma forma de conhecimento tem sua entrada priorizada e é aceito como membro do status quo, tendo assim, seu papel social limitado à mão de obra. _______________________________________________________________________________________ ABSTRACT / Brazil is one of the main focuses of immigrants, skilled and unskilled, in South America. It aims to show how the current political treatment of immigrant workers provide elements that build the ideal figure of a high-skilled immigrant. The analytical approach focuses on the period from 1980 - this year when Law No. 6815 was established - until 2014, when even the enactment of Law and year of submission of this study. Initially draws an overview of the international migration context for Brazil from the perspective of a high-skilled immigration for job, detecting the origins of the immigration process workers in their historical aspects. Then, presents evidence of historiographical Brazilian immigration legislation facing the immigrant worker such as the main orientations of labor immigration legislation until the 1980s and the creation of the Statute of the Alien, also in 1980. Analyzes the construction of the figure of a high-skilled immigrant in the Statute’s perspective and the Draft Law 5.655/09. Finally, in this research we can notice that the State builds and spreads, in a vertical and unilateral way through Brazilian’s immigration legislation features - many of them stereotypes – that should have the immigrant workers. One who holds some form of knowledge has prioritized its entrance and is accepted as a member of the status quo, and thus, his social role is limited in a workforce.
