La rhétorique constitutionnaliste. Généalogie du discours doctrinal sur la loi / The rhetoric constitutionnalist. Genealogy of the doctrinal speech on the law

L’objectif de l’analyse est d’éprouver les prétentions à la scientificité du discours constitutionnaliste contemporain. A ce titre, pour prendre au sérieux ces prétentions, il est apparu pertinent de reconsidérer la question du contrôle de constitutionnalité des lois dans le discours constitutionnaliste lui-même, l’introduction de ce contrôle ayant permis proprement la constitution d’un discours rigoureusement scientifique selon la doctrine. Dans ce cadre, on a ainsi choisi de privilégier deux moments de ce discours, qu’on trouve en aval et en amont de celui-ci : en aval, lorsque le constitutionnaliste décrit la jurisprudence du Conseil constitutionnel sur la crise de la loi ; en amont, lorsque le constitutionnaliste décrit les conditions d’apparition d’une justice constitutionnelle en France. On a donc sélectionné deux tranches de discours, qui se trouvent chacune aux extrémités du constitutionnalisme, pour leur valeur exemplaire. A partir de ce corps d’analyse, on souhaite montrer que le discours doctrinal est construit selon trois modes : descriptif, narratif, argumentatif. Ces trois modes mettent alors en place des rhétoriques singulières : respectivement, un faire voir, un faire croire, un faire savoir, qui permettent précisément de reconsidérer les prétentions à la scientificité du constitutionnalisme. / The objective of the analysis is to try the claims in the scientificity of the speech contemporary constitutionnalist. As such, to take seriously these claims, it seemed relevant to reconsider the question of the control of constitutionality of the laws in the speech constitutionnalist himself, the introduction of this control having allowed exactly the constitution of a speech strictly scientific. In this frame, we so chose to privilege two moments of this speech, which we find downstream and upstream to this one : Downstream, when the constitutionnalist describes the case law of the Constitutional Council on the crisis of the law ; Upstream, when the constitutionnalist describes the conditions of appearance of a constitutional justice in France. We thus selected two edges of speech, which are each in the extremities of the constitutionalism, for their exemplary value. From this body of analysis, we wish to show that the doctrinal speech is built according to three modes : descriptive, narrative, argumentative. These three modes set up then singular rhetorics : respectively, one to show, one to persuade, one to let know, who allow exactly to reconsider the claims in the scientificity of the constitutionalism.

Le choix de loi au sein du marché intérieur : libertés économiques de circulation et pluralité juridique étatique / Choices of laws in the international market : economic freedoms of movement and state's legal plurality

Les libertés économiques de circulation et la pluralité juridique au sein du marché intérieur sont-elles conciliables ? À cet égard, les positions doctrinales les plus antagonistes ont été soutenues. Il convenait donc s’en départir et de réfléchir à cette question en s’appuyant directement sur la jurisprudence de la Cour de justice. Celle-ci révèle une absence d’hostilité à l’égard de la diversité juridique, mais une défiance à l’encontre de certaines réglementations impératives dans un contexte de multiplicité juridique. Aussi, pour garantir le bon fonctionnement du marché intérieur, la Cour a développé un mécanisme, la reconnaissance mutuelle, par lequel elle remet en question l’impérativité des droits nationaux et ouvre parallèlement et indirectement de nouvelles facultés de choix de loi aux opérateurs économiques. Dans le même temps, la Cour a cependant développé une notion d’abus de droit. Par celle-ci, la Cour sanctionne le recours aux libertés de circulation qui ne serait pas conforme à leur fonction, par les personnes privées. Ce faisant, elle Cour pose une limite, de source communautaire à ces mêmes facultés de choix de lois. La sanction de l’abus de droit n’est cependant à l’heure actuelle pas satisfaisante, la Cour de justice appréciant non seulement le comportement de l’opérateur économique, mais également le contenu du droit national. Nous proposons donc que la Cour de justice modifie sa jurisprudence et sanctionne les utilisations anti-fonctionnelles des libertés de circulation en déniant purement et simplement aux opérateurs économiques le droit de se prévaloir du droit communautaire, indépendamment du contenu du droit national évincé ou choisi.Ce faisant, la Cour de justice ferait légitimement émerger de nouvelles facultés de choix de loi et concilierait libertés de circulation et pluralité juridique en respectant mieux les compétences étatiques. / Are economic freedoms of movement and legal plurality compatible within the internal market? In this respect, the most conflicting doctrinal positions were supported. It is then necessary to look at this matter by examining the case law of the Court of justice. It reveals an absence of hostility towards the legal variety, but mistrust against imperative regulations in a context of legal plurality. So, in order to guarantee the smooth running of the internal market, the Court developed the mechanism of mutual recognition, by which it questions the fact that national rights are mandatory and opens at the same time and indirectly of new faculties of choice of law to the economic operators. At the same time, the Court however developed a notion of abuse of rights. By this, the Court punishes the use by private individuals of freedoms of movement which would not be in accordance with their function. Making it, the Court puts a limit, of community origin, for these same faculties of choices of laws. However, the penalty of the abuse of rights is currently not satisfactory, because the Court of justice not only appreciates the behaviour of the economic operator, but also the contents of the national law. We thus propose that the Court of justice modifies its case law and sanctions the anti-functional uses of the freedoms of movement by denying purely and simply to economic operators the right to take advantage of the community law, independently of the contents of the eliminated or chosen national law. By this, the Court of justice would legally bring to the foreground new faculties of choices of law and would reconcile freedoms of movement and legal plurality by respecting the state powers better.

Le présent mémoire a pour but d'évaluer la pertinence d'introduire la médiation dans le domaine de la responsabilité médicale au Québec. Dans un premier temps, l'étude des modes actuels de résolution des conflits dans ce champ bien établi est effectuée. L'auteure analyse ensuite les besoins des différents acteurs impliqués d'un tel différend et explore les caractéristiques de la médiation afin de déterminer dans quelle mesure cette avenue peut présenter un intérêt. Bien que l'expérience extérieure s'avère positive à cet égard, l'implantation du mécanisme au Québec se heurtent à certains obstacles qui en freinent la mise en oeuvre. Tenant compte de ceux-ci, le dernier chapitre du mémoire se consacre à l'étude des considérations pratiques propres à favoriser le recours à ce mode amiable de résolution des conflits. Sont aussi présentés des critères utiles afin de permettre un tri stratégique des dossiers les plus susceptibles d'en profiter et enfin, les paramètres possibles d'un scénario de médiation.
