The master thesis examines the phenomenon of lustration laws in Ukraine as a legal measure of transitional justice. It maps the history of unsuccessful attempts to adopt lustration laws from the independence in 1991 until the Euromaidan revolution in winter 2014. It then analyses the two lustration laws adopted in 2014 and their implementation between years 2014 and 2017. Finally it analyses the legal review that the laws have faced or are likely to face in the future. It comes to a conclusion that Ukrainian laws were not adopted after the independence in 1991 because of structural reasons and after the Orange Revolution in 2004 due to a lack of political will. In the second part, the thesis concludes that Ukrainian lustration laws adopted after Euromaidan were some of the most extensive ones in the region of post-communist Europe. Nevertheless, their implementation fell short of meeting most of their goals. In the third part, the thesis concludes that the laws might be spared constitutional review, but they are likely to face a negative scrutiny before the European Court of Human Rights.

Les techniques lustrales dans les écrits bibliques

Cette étude se place de prime abord dans le contexte d’une étude exégétique des textes bibliques, bien que les techniques lustrales ndembu soient à l’origine de cette recherche. L’étude porte sur l’analyse des textes bibliques relatifs à l’emploi des trois liquides que sont l’eau, le sang et l’huile dans les rites de purification. Ces liquides sont les agents de purification dans les dits rituels. Par l’aspersion ou le bain, l’eau purifie; et dans tout sacrifice, le sang, principe de la vie est répandu sur l’autel. L’eau et le sang jouent le même rôle, celui d’enlever la souillure ou le péché. L’usage de l’huile, peu fréquent, est plus marqué dans les rites de consécration des choses ou des personnes qui seront au service de Dieu. Les lustrations du Nouveau Testament font suite à celles de l’Ancien Testament. L’eau est employée dans le baptême pour sa valeur purificatrice. Le sang de Jésus purifie définitivement du péché. L’onction d’huile est donnée aux croyants par Dieu en Jésus Christ. Par le baptême (l’eau), sous l’action de l’Esprit Saint (onction) les croyants sont purifiés par le sang de Christ.
