Entrevista a Javier Neves Mujica: arbitraje potestativo

Tras la introducción del artículo 61-A al Reglamento de la Ley de Relaciones Colectivas de Trabajo, el número de arbitrajes en materia laboral ha aumentado de manera considerable, tan es así que hoy se constituye como una de las novedades más resaltantes que se ha producido en materia de solución de conflictos laborales. Son muchas las opiniones que se han emitido a raíz de la emisión de esta norma. Algunos a favor del arbitraje potestativo y otros en contra, llegando incluso estos últimos a sostener que el Decreto Supremo, que introduce esta norma, sería inconstitucional. Dadas estas circunstancias, decidimos entrevistar al profesor Javier Neves, experto en Derecho Laboral, quien nos expuso su punto de vista respecto a la naturaleza del arbitraje potestativo y a las implicancias que de este se derivan. Since the promulgation of Article 61-A of the Regulations of the Collective Labor Relations Law, the number of labor arbitrations has increased considerably to the extent that today they are considered to be one of the most important innovations that have been implemented for the solution of labor conflicts in Peru. Many different opinions about this norm have been published since its promulgation; some favor facultative arbitration and others are critical, even going to the point of sustaining that the Supreme Decree that promulgated this norm is unconstitutional. As a result of this controversy, we decided to interview Professor Javier Neves, an expert in Labor Law, who discusses his point of view on the nature of facultative arbitration and its implications.
