Expansão judicial? : uma análise da judicialização da política nacional de assistência farmacêutica para além dos pressupostos liberais

Defesa: Curitiba, 31/03/2017 / Inclui referências : f. 103-112 / Resumo: Nos últimos quinze anos o judiciário brasileiro vivenciou um crescimento de demandas, a pleitear os mais diversos direitos. Nesse contexto, o presente trabalho tem como objeto de estudo o ativismo judicial na política nacional de assistência farmacêutica, e, para tanto, reconstrói as teorias modernas da separação dos poderes e identifica os seus limites descritivos em face do papel atribuído ao judiciário liberal, órgão supostamente cego aos anseios políticos. No segundo capítulo voltam-se os olhos ao caso brasileiro, ao despertar vivenciado pela ciência política e pelo Direito ao papel político exercido pelo Poder Judiciário. Nesse sentido, aponta-se a produção doutrinária nacional sobre o tema, durante meados da década de noventa, a fim de se identificar as interações da ciência política brasileira com a teoria liberal e seus mitos. Explora-se os limites dessas interações, colocando-se em xeque a possibilidade de se explicar a realidade brasileira sob-bases liberais, pois se de um lado o Brasil nunca adotou uma forma de Estado absenteísta, aos moldes europeus, pois nas diversas fases da história recente do Brasil o judiciário exerceu diferentes papéis políticos; de outro, o atual protagonismo atribuído ao judiciário parece ser melhor explicado por um processo de rupturas e de continuidades institucionais que marcaram a redemocratização e pelas condições institucionais setoriais favoráveis à proposição dessas demandas. Por fim, o terceiro e último capítulo pretende olhar para dentro do fenômeno, explorando a ponta da lança da judicialização, isto é, as recentes decisões judiciais modificadoras das políticas públicas do SUS em matéria de medicamentos. Assim, pesquisou-se todas as decisões proferidas no âmbito do Tribunal de Justiça do Estado do Paraná e do Tribunal Regional Federal da 4ª Região, nas demandas oriundas do Estado do Paraná, no período de um ano, a fim de identificar os fatores atuais, desencadeadores da judicialização de diversas políticas de assistência farmacêutica no SUS, sem, contudo, limitar a questão à evidente escassez de recursos, inerente à condição nacional. Nesse sentido, conclui-se que a judicialização pode representar, dentro dos limites do levantamento empreendido, tanto um conflito federativo, resultado do debate para se estabelecer quem deve pagar por esses tratamentos, especialmente os mais caros, como também o resultado da iniciativa de laboratórios, profissionais da advocacia e pacientes beneficiados nessas demandas. PALAVRAS-CHAVE: liberalismo, judicialização, ativismo judicial, medicamentos. / Abstract; In the last fifteen (15) years, the Brazilian judiciary experienced a growth in lawsuits claiming the most diverse rights. In this context, the present study aims to study judicial activism in the national policy of pharmaceutical assistance and, to this end, to reconstruct as modern theories the separation of powers and identify their descriptive limits, regarding the role attributed to the liberal judiciary, Organ supposedly blind to political yearnings. In the second chapter we turn our eyes to the case of the Brazilian, live lived by political science and the right to political exercise by the Judiciary. In this sense, the national production on the theme during the mid-1990s is aimed at identifying the interactions of national political science with a liberal theory and its myths. It explores the limits of interactions, putting in check a possibility of explaining a Brazilian reality on a liberal basis, on one side of Brazil has never adopted a form of state absentee to the European molds, to show that in the various phases of recent History Of Brazil or judiciary played different political roles; On the other hand, the current role attributed to the judiciary seems to be better explained by a process of ruptures and institutional continuities that marked a redemocratization and sectoral institutional savings to favor the proposition of these demands. Lastly, the third and last chapter seek a study of the phenomenon, as a reference framework for the determination of risk. Thus, all decisions made in the Tribunal of the Court of the State of Paraná and of the Federal Regional Court of the 4th Of the United Nations of the State of Paraná, with a term of one year, an aim to identify the current elements, triggering the judicialization of several pharmaceutical research policies in the SUS, without, however, limiting the issue of evident shortage of resources inherent to the condition national. In this sense, it ends up concluding that the judicialization can represent, within the limits of the survey undertaken, both a federative conflict without meaning to establish who should pay for these treatments, especially, more expensive, as the result of laboratories, lawyers and patients. "Na minha mão não morre" : uma etnografia das ações judiciais de medicamentos

Defesa: Curitiba, 17/10/2016 / Inclui referências : f. 207-214 / Resumo: Este trabalho é um estudo etnográfico de ações judiciais de medicamentos, processos nos quais o Estado - seja ele representado pela União, estados-membros ou municípios é demandado por um "paciente" a fornecer medicamentos pela via judicial. A intenção é compreender como se faz o direito à saúde, numa aproximação teórica àquela desenvolvida por Latour (2010). Para isso, são percorridos os caminhos desses processos, desde o paciente, sua doença e o receituário médico inacessível para compra, até se encontrar o Estado em diferentes posições: em demanda, através das instituições que têm a competência legal para processarem o Estado (Ministério Público Estadual e Defensoria Pública da União); em defesa, por meio da atuação da Procuradoria Geral do Estado e do Setor de Demandas Judiciais, da Secretaria de Saúde do Estado do Paraná, que faz o cumprimento das decisões; em deliberação, através das discussões promovidas pelo Comitê Executivo de Saúde no Estado do Paraná, ao produzir suas "recomendações" e "enunciados"; e, finalmente, o Estado em decisão, pela análise dos processos que tramitam no Judiciário e que se destinam a uma decisão de um magistrado, a comandar o fornecimento (ou não) do medicamento pleiteado. A pesquisa possibilitou encontrar um processo de transformação do direito à saúde em direito à vida, que se manifesta não apenas a partir de um texto legal cujas disposições se constroem na prática dos processos, mas também pela diversidade de elementos que mobiliza, especialmente os sentimentos dos agentes públicos que laboram com tais demandas. A pesquisa de campo foi realizada de janeiro de 2015 a fevereiro de 2016 em instituições públicas das cidades de Cascavel e Curitiba, ambas no estado do Paraná, compreendendo observações, entrevistas e análise de documentos. Estado. / Abstract: This work is an ethnographic study about lawsuits on medicines, proceedings in which the state - whether it is represented by the Union, member states or municipalities is demanded by a "patient" to supply medicinal products by the court. The intention is to understand how the right to health is done, as a theoretical approach to the one developed by Latour (2010). For this, the paths of these processes were covered, from the patient, the disease and medical prescription inaccessible to purchase, to the point where they meet the state at different positions: on demand, through the institutions that have the legal authority to sue the state (Ministry State public Union and the public Defender's Office); in defense, through the Attorney General's acting state and Contingencies Industry, the Secretary of the State of Paraná Health, which is the fulfillment of decisions; in deliberation, through the discussions held by the Health Executive Committee in the State of Paraná, to produce their "recommendations" and "statements"; and finally, the state decision, the analysis of the proceedings before the courts and the ones which have to be decided by a magistrate, to command the supply (or not) of the claimed product. The research allowed to find a process of the transformation of the right to health into the right to life, which manifests itself not only from a legal text whose provisions are built on the practice of the processes, but also by the diversity of elements that it mobilizes, especially the feelings of public officials who work with such demands. The field survey was conducted from January 2015 to February 2016 in public institutions in the cities of Cascavel and Curitiba, both in the state of Paraná, comprising observations, interviews and document analysis.
