An analysis of actual cost data for surface mine rehabilitation projects in South Africa and comparison with guideline values published by the Department of Mineral Resources

A research report submitted to the Faculty of Engineering, University of the Witwatersrand, Johannesburg, in partial fulfilment of the requirements for the degree of Master of Science, / In 2004, the Department of Minerals and Energy (DME, predecessor to the current Department of Mineral Resources - DMR) published a guideline to calculate the amount that a mining right holder would require for financial provision at mine closure. This research report reviews the guideline, specifically focussing on the “rules-based approach” for determining the quantum of financial provision. Some authors have recorded the misapplication of this guideline in practice and their research supports a conclusion that the guideline does not provide adequately for the real costs of mine closure. This research report makes a comparison between the DME guideline master rates for mine closure costs and actual tendered prices for those same elements of mine closure in the period from 2009 – 2016. The analysis of the actual tender prices for the various master- and component rates in comparison with the DME guideline rates delivered mixed results. While the actual tender values exceeded the guideline master rates in most cases, there were notable exceptions where the actual tender results lagged the master rates. The data obtained from the actual tender prices for mine rehabilitation projects by a third party suggests that the use of CPI to escalate mine rehabilitation costs was very quickly overtaken in reality by higher annual costs and rate increases for most of the DME guideline master rates that relate to surface mining. It means that the DME guideline master rates were not reflective of actual rehabilitation costs by the time that the use of the DME guideline was superseded by the publication of new regulations by the Department of Environmental Affairs in November 2017. Whilst no perfectly linear and distinct relationship could be deduced, the results broadly support the findings of several authors that the actual costs to rehabilitate a mine are much more than the DME guideline document would lead a mine to provide for. The application of a rules-based approach remains an exercise mired in controversy and with many potential inaccuracies. The new NEMA regulations for financial provision completely negate the need for a guideline and relevant State Departments and mining companies alike are consequently dependant on third parties to prepare closure cost estimates. / E.R. 2019

Towards the development of an organisation development model for the mining industry

Litt. et Phil.(Leadership in Performance and Change) / The aim of this study was to develop an organisation development model to support organisational change and transformation in a dynamic, continuously changing business environment, specifically for the mining industry in South Africa. Literature revealed that there is a tendency to employ universal and generic models to challenges of organisational change, whereas successful 00 needs a situation specific or contextualised approach. The field of OD reflects a paucity of empirical research, necessitating a greater research competence and more in-depth, robust empirical 00 studies to answer to 'contemporary contextual and environmental challenges. A further call is voiced towards OD to resolve organisational change challenges from a systemic perspective, which has been a central tenet of the field. A number of research participants from a South African company that has been implementing organisational change and transformation interventions in the mining sector, were selected by means of purposive sampling. A modernist qualitative approach with the case study as research strategy was utilised during the development of the model. Various data collection techniques were utilised with grounded theory as a data analysis technique to explore and systematically develop the concepts and categories of the model. Atlas.ti, together with manual coding procedures were utilised to systematically organise and analyse the rich descriptive data. Credibility, transferability, dependability and confirmability were ensured by following the guidelines presented in the literature. In the literature study, the sample's narrative was critically contrasted against the established scientific knowledge base of OD, considering specifically taxonomies, models and theories related to the emergent OD model. The resulting model deviates from the established perspectives on OD, in that it reflects a hybrid of several fields of study endeavour. The latter is consistent with a business practice perspective that integrates and deal with a single application domain, compared to a science-informed perspective which conducts research largely within defined (and confined) disciplinary boundaries. The OD model has implications for the mining industry in South Africa, and the development of grounded theory should facilitate the application thereof in future research.

In this study, an analysis of laws pertaining to environmental protection in the mining in Tanzania is done. The study develops understanding of various environmental laws and institutions for the purposes of setting context and clarity for the subsequent chapters. The major discussion evolves around environmental protection offered in Tanzania mining and investment laws. In understanding this, a detailed discussion of coverage of environmental issues in the Tanzania Mining Act, 5 of 1998 and the Tanzania National Investment Act, 26 of 1997 is made. After this discussion, the recommendations are given. Despite Tanzania mining, especially large-scale mining being one of the main growing industries in Tanzania, it is concluded that environmental management in mining has been hindered by inadequate legal protection, lack of coordination, insufficient funding and expertise. As a result there has been uncontrolled extraction of minerals and the use of unsafe mining methods and severe environmental damage and appalling living conditions in the mining communities. The challenge associated with the mining sector today in Tanzania is ensuring sustainability and integrating environmental and social concerns into mineral development programmes. Sustainable mining development requires balancing the protection of the flora and fauna and the natural environment with the need for social and economic development. To address the environmental problems associated with mining, the Government's policy is to reduce or eliminate the adverse environmental effects of mining, improve health and safety conditions in mining areas, and address social issues affecting local communities.
