Board transformation and EE scorecard target attainment : progress made and barriers faced with transformation by JSE listed companies in the South African Mining Industry

The political and economic pressures for transformation in South Africa have been documented in an array of policies, pieces of legislation, regulatory and statutory frameworks, and also in governance codes for both public and private companies. Specifically for the mining industry, the Mining Charter comprises of transformation targets and measurement criteria that are presented in a scorecard to be achieved by the mining industry by 2014. Additionally, the King reports on governance have specific requirements that listed companies must meet in terms of employment equity and demographic representation to achieve board diversity and independent boards. The aim of this study was to report on the board transformation status in the mining industry, as well as the progress that has been made towards meeting transformation targets. The 2011 annual reports were used to capture profiles and composition of board of directors in Johannesburg Stock Exchange (JSE) listed mining companies. Interviews were used to gain insight on the transformation status, initiatives undertaken and challenges of transformation in the mining industry. The research findings from the analysis of board members demographic and career profiles shows that little has been achieved to ensure equal representation and diversity on the boards of directors. Further analysis of the status of transformation by JSE listed mining companies to realise transformation, shows that transformation in the mining industry is still a major challenge. Whilst some initiatives have been undertaken and some progress has been made, this study reveals that the barriers to transformation in the South African mining industry are racial issues and tensions based on colour, the lack of skills caused by the education system, a war for talent, a lack of mentorship and no stakeholder engagement between the mining industry and government / Business Management

A framework for the sustained policy implementation of the Mining Charter of 2002 : the role of women in the South African mining industry

(Public Management and Governance) / This study focuses on a framework for the sustainable policy implementation of the Mining Charter of 2002, with specific reference to the role of women in the South African mining industry. The goal of this empowerment charter is to create an industry that will reflect the promise of a non-racial South Africa. This includes ensuring a ten percent participation of women by 2009. The main research question addressed by this study is: What are the factors involved in determining the sustained implementation of the Mining Charter of 2002 and how can it be effectively implemented and strengthened in order to ensure the compliance by the mining employers in terms of the role and targets for women in the mining industry? The thesis provided an integrated focus on outputs in terms of implementing reform policies with regard to the employment of females in the mines. Furthermore, it investigates certain outcomes in terms of how the mining environment has adapted to female employment and policy conversion processes in terms of what the barriers are to the successful implementation of the Mining Charter of 2002. This ensured that both policy products and processes were subjected to systematic and integrative evaluation. The problem was also viewed from the current level of success in implementing similar empowerment policies in other countries, such as Australia, the United Kingdom, Japan, as well as certain African countries. The thesis also aimed to develop a substantive theory for an organisational change process in terms of the conditions of women working underground in the mines. This will enable mining employers to identify selected resource inputs, as well as process outputs and outcomes. Ultimately, this will ensure sustained compliance to the spirit and requirements of the Mining Charter, within the context of the transformation of the South African society and legislation as a whole. A modernist qualitative research methodology was followed, where casing was applied as the research design and grounded theory as the research strategy. A qualitative coding paradigm was developed in terms of the physical, social, cultural and psychological construction of employees in the mining environment’s perceptions, experiences, attitudes and behaviour with regard to the implementation of the Mining Charter of 2002. The findings of the empirical study generally indicated that the picture that scholars and role-players (for example the women working underground) paint on the South African mining industry with regard the employment of women in the mines – specifically in an underground environment – is not as bleak as one might think. However, some improvements are still needed in order to comply with targets, as well as creating better working conditions for women employed in the mining industry. The study contributed to the development of theory and research methodology. Furthermore, on a practical level, it contributed to the disciplinary fields of Public Management and Public Governance.

Empowerment through mine community development: how the politics of development perpetuate poverty in mining areas – a legal theoretical analysis

The Mineral and Petroleum Resources Development Act (“MPRDA”) and the Broad-Based Socio-Economic Empowerment Charter for the South African Mining and Minerals Industry (“Mining Charter”), created in terms of the MPRDA, aim to address the exploitative legacies of past discriminatory practices in the mining industry. Impoverished mining communities stand to benefit from empowerment under the Mining Charter in the form of mine community development – one of the elements that constitute a mining right holder's commitment under the Mining Charter. Despite this legislative intervention and the relative wealth generated by the extraction of mineral resources, poverty and conflict have become the stereotypical images associated with mining areas. This project aims to determine why the empowerment of mining communities through mine community development perpetuates poverty from the past and creates new inequalities. To answer this main question, it is considered how the historical context within which the relevant policy and legislation were created, affected legislative drafting. Second, the effects of promoting development and empowerment in legislative provisions are explored to determine which worldviews and underlying values are being promoted by the legislative instruments under discussion. Furthermore, it is considered how these worldviews and underlying values affect how mining communities, subjected to harsh socio-economic living conditions, are depicted in legislative provisions. Here, it is specifically considered what the notion of “community” signifies in a development context and how “community” is represented in legislation. The thesis is a theoretical exposition of the ideological assumptions underlying the concepts “development”, “empowerment”, “community” and “poverty”. It is shown that “mine community development” is an inherently contradictory notion in South African law. The development paradigm implies the universalisation of values, effectively creating “the poor”, and causing vagueness and paradoxes. It results not only in a perpetuation of poverty and inequality from the past but also in the creation of new inequalities, as is evident in the differentiation drawn by the Mining Charter between different types of communities in mining areas. Measures currently being enforced by the legislation under discussion, are in desperate need of reconsideration.

The rebellious and ungovernable Barberton community against Barberton Mines (Pty) Ltd

Text in English / This is a study of community protest against Barberton Mines (Pty) Ltd. It is a study of conflict and conflict resolutions. Barberton Mines (Pty) Ltd is one of the three gold mining companies in Barberton, and is in dire need of a bankable community/stakeholder relation management strategy, which should at least reduce, if not eliminate, the endless violent community protests against its operations. Methodologically, the study is predicated on a qualitative approach backed by oral interviews and the use of a survey. The study reveals that as much as the community appreciates Barberton Mines for its delivery in socio-economic development initiatives, Barberton Mines’ recruitment and procurement departments are not doing any justice in terms of preferred policy in favour of the locals/Barberton community. This is a key source of conflict. The results also reveal that the Barberton Mines Transformation Trust (BMTT), a vehicle established for socioeconomic development in Barberton, is considered to be ineffective by the community and is one of the causes of the conflict. The resolutions of the conflict include the effective implementation of the mining legislation and unrolling of the Mining Charter. The effectiveness and lack thereof of these conflict resolutions are subjected to analysis in this study. / Development Studies / M.A. (Development Studies)
