The main focus was the reflection about the paths that led to the law approval. This research tried to identify many legislative initiatives that happened before with similar purposes to the law in 2003 and the paths of elaboration of the law project, its due process and its approval in the Congress. Follow some of historical movements, during the XX century, like the education problems and claims that were put in the black movement meant delineate relations between the legislative process and the claims of the black movement / A presente pesquisa aborda as dimensões do processo histórico que resultou na aprovação da Lei federal nº 10.639, de 9 de janeiro de 2003, que trata da obrigatoriedade da introdução de conteúdos de História e Cultura da África e de História e Cultura do Negro no Brasil no currículo do sistema de ensino da rede pública e privada do país. O foco central deste estudo foi a reflexão sobre os caminhos que levaram à aprovação da referida lei. Buscou-se identificar as diversas iniciativas legislativas anteriores com propósitos semelhantes à lei de 2003, bem como os caminhos de elaboração do projeto de lei e seu processo de tramitação e aprovação no Congresso Nacional. Acompanhar alguns dos momentos históricos nos quais, no decorrer do século XX, as questões da educação e das reivindicações sobre o ensino se colocaram nas lutas dos Movimentos Negros significou traçar relações entre o processo legislativo e as lutas desses Movimentos
