Exploring the delays in land registration within township establishment process for low income housing developments in South Africa, a case study in Seshego/Polokwane: Limpopo

Mashego, Teresa Molatelo January 2017 (has links)
Thesis is submitted in partial fulfilment for the degree of Master of the Built Environment in Housing to the Faculty of Engineering and the Built Environment, School of Architecture and Planning at the University of the Witwatersrand, Johannesburg, 2017 / The research report is based on the complex nature of land registration within a township establishment process in South Africa. Post 1994 democratic government have placed a great emphasis on land tenure security. Therefore it becomes crucial for government departments to identify, acquire and expropriate land for the provision of affordable integrated human settlements. The political drive for low income housing developments results in community pressured projects, disregarding the opening of a township register which enables individual title transfers. Several townships established on municipal owned land are incomplete wherein the General Plan is approved but not registered at the deeds office, hampering deed of transfers to allocated beneficiaries. Land exchanges, employer housing allowance, family inheritance and insurance contracts necessitate land ownership declaration. The various land tenure security approaches are explored and argued for formal recognition since they have been proven to be working successfully in other parts of the world. / XL2018

A tributação do ISS na sociedade da informação / The taxation of Brazilian Municipal Services Taz (ISS) in the information society.

Garcia, Regina Vitoria Soares 27 May 2013 (has links)
This study aims to analyze and identify disturbances that appear on the material and spatial criteria of incidence matrix-rule model of the Service Tax, arising from structural change resulting from the incorporation of new information and communication technologies (ICTs) in electronic trade transactions. The telematic resources not only deprived the business transactions of physical contact between the individuals involved, but relativized conditions of time and space inherent in all legal facts. Therefore, we sought to examine simultaneously, in a similar way, the issue of taxation of electronic commerce in the Brazilian States, through the International Tax Law, and the reality experienced by Municipalities in the law regarding the taxation of services affected by the same technological innovations. Thus, the study was guided by the definition of connecting factors, revealed in concepts such as permanent establishment and establishment rendering to delimit the jurisdiction imposing on legal facts inherent to electronic transactions. The study begins with the definition of legal and tax issues relating to electronic commerce, establishing its concept and analyzing its specific types and characteristics, studying the legal regime of digital assets, object of direct e-commerce transactions. Still in the preliminary study, we address aspects of the Brazilian Federation, defining the reality of Municipalities and analyzing their role in the Brazilian Federation, devising the composition of their own incomes and effective participation and potential tax revenue. This analysis is concomitant to that of grant of jurisdiction imposing in Brazil, and in comparative law, ending by revisiting the themes of partition within the competence of taxes on consumption and the dichotomy type-concept. Finally, after a preliminary analysis of these issues and based on an adequate theoretical support, we studied the specific Services Tax and the new reality in the provision of services arising from the restructuring of the companies, the redistribution of work steps, and the relativization of physical presence in trade relations, analyzing the changes in the concepts of service and establishment rendering in the definition of the powers of Municipalities. At the end, we will be investigating the possibility of applying the solutions used in the international law and doctrine proposals for the concretion of the concept of permanent establishmet, applied to that of establishment rendering under domestic law, in particular the configuration of data servers and websites like setting. In conclusion, after the proposal of setting criteria for material and spatial transactions in e-commerce, we dedicate a brief study of the practical application of the proposed mechanisms to some services that were modified by the incorporation of virtual media.

Effects of migration on municipal planning : a case of Greater Tubatse Local Municipality in Limpopo Province

Phala, Hlabishi Lemon January 2017 (has links)
Thesis (MPA.) -- University of Limpopo, 2017 / The purpose of this qualitative research was to investigate the effects of migration on municipal planning using the case of the Greater Tubatse Local Municipality in the Limpopo Province. The research derives its origin from the notion that municipal planning, which does not consider population dynamics, is incomplete. Municipalities in South Africa are mandated to provide services to community members within their jurisdiction with limited available resources. To achieve this municipalities are expected to develop plans, referred to as Integrated Development Plans (IDPs). The IDPs are informed by various aspects for their completeness, namely: alignment with the national development perspective and consideration of population dynamics. The research was designed to explore the experience and understanding of municipal officials who are responsible for planning activities in the Greater Tubatse Local Municipality and the manner in which migration affects such municipal planning. This qualitative research employed a phenomenological method as the most appropriate to capture the perspective, understanding and experiences of individuals who were differently involved in migration and municipal planning processes. The research revealed how migration affects planning within municipal invironment in South Africa by using the experiences of municipal officials who are involved in planning activities in the Greater Tubatse Local Municipality. Among others, the research revealed the following findings, namely; (1) Migration in the Greater Tubatse Local Municipality is caused by several factors such job opportunities in the mines, better services in towns and townships among others,(2) the Greater Tubatse Local Municipality does not consider migration during community consultation processes, needs prioritisation and resource allocation, (3) the Greater Tubatse Local Municipality does not have effectivemigration data management system, (4) there is a lack of co-operation between the Greater Tubatse Local Municipality with otherspheres of government which are responsible for migration management, (5) Powers and functions delegated to the Greater Tubatse Local Municipality inhibit migration management and municipal planning and (6)there is sufficient legislative framework regulating migration management and inter-governmental relations in South Africa, however there is no implementation of such legislative framework by government officials. iii The overall experience of participants with regard to migration and municipal planning generally confirms findings of previous researches (Blase & Landau, 2014; Hofisi, 2014; Netswera & Phago, 2011) who for example, argue that migration is not taken into consideration during municipal decision making processes, need prioritisation and resource allocation. However, unlike the findings in previous researches (Friedementle & Misago, 2014; Mpehle, 2014) which highlight that municipal officials have negative attitudes towards migration this research revealed that municipal officials in the Greater Tubatse Local Municipality appreciate migrants. Municipal officials interviewed in this research appreciate migration and the challenges it poses to the municipality. Furthermore, contrary to what some reports highlight, participants in this research did not experience xenophobic attacks in the area despite the high prevalence of migration. Participants recommended that more powers and functions such as provision of water, electricity, migration management and others should be devolved to local municipalities as the sphere closest to the people. Participants further recommended that a dedicated research unit be institutionalised within municipalities to collect data which will supplement those of Statistics South Africa, and that other spheres of government should co-operate and capacitate local municipalities. This qualitative research is significant because the data gathered were analysed to develop themes which provide insight into how migration affects municipal planning, which planners in municipal environment can learn from and apply. It also contributes to a growing body of scholarly work and provides a conduit for future studies concerning the central phenomena - migration and municipal planning. This is vital, given the increasing pressure exerted by migration on municipalities and their limited resources.

The impact of Extended Public Works Programmes on poverty alleviation in the Bushbuckridge Municipality in the Mpumalanga Province

Mothapo, Matšatši Frederick January 2011 (has links)
Thesis (M.Dev.) -- University of Limpopo, 2011 / The study focused on the existence of Extended Public Works Projects (EPWP) and beneficiation in the village of Croquetlawn and Tsemamarhumbu village of Mkhuhlu in the Bushbuckridge Municipality. Many rural households live in situations of high unemployment and abject poverty, especially in the rural neighbourhoods of South Africa. The introduction of labour intensive projects of government in infrastructural development, under the auspices of the Department of Public Works, has brought a great relief in redressing unemployment and poverty in the country. While the provision of these short-term based jobs is life-saving, the question is whether or not these projects (EPWP) will provide a sustainable solution to unemployment and poverty with the skills and information they provide to the employees. The methodology used in this study was both qualitative and quantitative in nature. A small sample size of 40 people was selected using purposive sampling, targeting mainly beneficiaries of EPWPs, Municipal officials, CBOs, traditional leaders (indunas) and Ward Councillors. It is worth pointing out that the study findings indicated the positive impact of the EPWPs on beneficiaries; even though challenges were still enormous. At the delivery or grassroots point, the institutional arrangement of the Programme is virtually weak and non-existent in most instances resulting in poor governance. It is recommended that during the programme design stage, institutional arrangements and mechanism must be improved by the involvement of community structures to enhance good governance. It is recommended that gender mainstreaming forms part of the project management and programme design. This implies that vulnerable people such as women and orphaned children are given a special status in the programme. The programme design should also in the main address human basic needs related to infrastructural projects. Labour intensive programmes can create a greater demand for local products and services than do high technology programmes which may heavily rely on imported technology and equipment.

Implementation of road infrastructure development projects in rural areas of South Africa : a case of Polokwane Municipality in Capricorn District

Mamabolo, Malemela Angelinah January 2013 (has links)
The South African government is obliged to render basic services for the people through local government municipalities. These basic services include among others the development of adequate roads, clean water and electricity. The responsibility of the delivery of these services was given to the municipality after the 1994 general elections, with the belief that it is the government that is closer to the people on the ground than the national and provincial governments. The issue of the provision of quality roads in rural areas of South African still remains a critical challenge. The issue addressed in this study is the provision of quality roads provided in Polokwane Municipality. The study focused on the implementation of roads infrastructure development project in rural areas of South Africa and the provision of roads in the rural areas of Polokwane Municipality in Capricorn District, with a special focus on the provision of roads in the rural villages of Thabakgone, Komaneng, Segopje and Ga-Molepo. The study used data collection instruments such as interviews, questionnaires and supporting documents, such as Polokwane Integrated Development Plan and relevant scientific articles to collect data in the four selected villages. The findings of the study revealed that the provision of roads infrastructure in the municipality is of substandard quality, and that the provision of quality roads in the areas is required.
